Straight TalkLong March for a Short Cause

  To begin with let us congratulate all those who were involved with the movement for the trial of perpetrators accused in crimes against humanity and war crimes they committed in 1971. A special tribute is due to Shahid Janani Jhanara Imam on this day for initiating the movement in the early nineties for the trials of the criminals of 1971. At last the Commander-in-Chief of Jamaat-e-Islami in Bangladesh in 1971 Ghulam Azam has been arrested on last Wednesday and sent to jail by the International Crimes Tribunal. This is one day that the people of Bangladesh have waited for long forty years. Now the nation will wait for the trial to begin and conviction to take place. A special thanks to the present government for taking this bold and much awaited step.

The opposition in the National Parliament BNP completed its two day long march to Chittagong on the day Ghulam Azam's charge sheet was accepted by the Tribunal. To conclude the long march BNP chairperson addressed a big public rally in Chittagong's Polo Ground on 9 January 2012. Before the public meeting I happened to be in Chittagong for few days and as a person who was born and brought up in this historic Chittagong city I was saddened and frustrated to see an expression of vulgarity and excesses committed by the local leaders of the four party alliance and the Mayor of the Chittagong City Corporation obviously by spending public money. Any one belonging to Chittagong feels proud because this city is considered as the citadel of revolutionary activities in different periods of history. In 1857 after the sepoys revolted in Barackpore of West Bengal against the colonial British rulers under the leadership of Mangal Pandey, it was sepoy Rajab Ali in Chittagong who fired the first shot in the eastern part of the sub-continent to announce their participation in the revolution. In the 1930s the youth of Chittagong under the leadership of Mastarda Surya Sen took up arms to free the country from the British. The battle of Jalalabad fought between these youths and the British forces have created a new chapter in our history of valour and courage. Chittagong is the only district in British India which was freed through an armed struggle by these young men and women and remained so for about three days until it was reclaimed by the stronger British Forces. Chittagong produced the first woman martyr, Prithilatha Wadadar in British India. Chittagong also gave birth to such revolutionaries like Kazem Ali Master, Moniruzzam Islamabadi, Jatra Mohan Sen and Joytindra Mohan Sen. In 1971 the first declaration of Independence of Bangladesh by Bangabandhu Sheikh Mujibur Rahman was read out from Chittagong on 26 March by Awami League leader M A Hannan. Mahatma Gandhi acknowledging the spirit of this port city said 'Chittagong to the Fore.' The same Chittagong on 9 January witnessed a show of different kind.

Though BNP launched the road march to Chittagong on expensive air-conditioned cars and SUVs, in reality it was a mile long car rally. This was their fourth such rally, the previous ones being to Sylhet, Rajshahi and Khulna all presumably called to protest against the 'misrule' of the present government and to 'save' the country being 'taken over' by India. But in reality it was a demonstration of strength to come back to power and abandon the trial against the criminals of 1971. A couple of weeks before this rally, Barrister Moudud demanded in public that the International Crimes Tribunal be disbanded and those arrested for committing such crimes be freed. These were the two agendas on the card, one of BNP and the second one of their close ally Jamaat. The total budget for the entire Chittagong show according to the media reports was ten crores, though BNP says it was only two. Whatever is the figure it is known that the bulk of the money came from Jamaat's coffer as presently their existence is at stake. The whole of Chittagong was covered with digital banners and festoons and the Chittagong City Corporation Mayor Monzurul Alam was quite generous with the tax payers' money in pressing all the logistic services of the Corporation for making the public show a success. Before he got elected the incumbent Mayor promised that once elected he would not raise the holding tax of the residents of the city, but before the turn of the year after his victory raised the tax, in some cases by tenfold.

The Chittagong show was more of a Jamaat-e-Islami show. The whole city was covered with coloured posters, festoons and banners of Jamaat demanding the release of their arrested leaders and withdrawing of cases filed against them. Few former Freedom Party leaders jumped the BNP bandwagon and declared their allegiance to BNP. Surprisingly even the now defunct Muslim League surfaced and put up few green coloured posters protesting the 'misrule' of the present government and demanding installation of a Nationalist Islamic Party in power! They did not forget to declare their support to BNP's stand against the party in power, Awami League.

BNP Chairperson Begum Khaleda Zia spoke for 45 minutes in the Chittagong rally. What she said was the run of the mill stuff and half of her speech was India bashing. It was also the same old story amplifying the 'failure' of the present government and her pledge what she and her party would do if voted to power again. She and her party was in power twice before but did not say why she could not deliver during that time. However for the first time she said that during her previous rule there may have been some mistakes and promised that they will not be repeated in future. She fell short of apologising for all the misdeeds and corruptions committed during her time. Surprisingly also for the first time she brought the Bangladesh Armed Forces in her speech this time and mentioned the 'disappearance' of army officers and said 'even army officials are now disappearing. Many officers have lost their jobs.' She promised those who lost jobs in the army, police and civil administration during this tenure, will be taken back. (Will this include the son of Ghulam Azam?). Coincidently, in the morning of January 9, the banned Islamist militant outfit Hizb-ut Tahrir Bangladesh had sent leaflets in sealed envelopes to several local daily newspaper offices reading the same allegation attributed to Khaleda. The leaflets also asked the army to come forward to oust the ruling Awami League-led government. By all definition this is a near seditious comment, coming from no less than a person other than the Leader of the Opposition in Parliament and to many it was tantamount to instigating both the armed forces and civil administration. It would have made some sense if she would declare how many army officers lost jobs during her previous tenure and would they also be taken back. She could also have gone back and declared how many army personnel were hanged on flimsy grounds during her husband General Zia's rule and would they be compensated. As expected the following day the Inter Service Public Relations (ISPR) came down heavily on the comments by Begum Zia and in a press release said 'addressing a rally at the Polo Grounds Zia made false allegations that army officers are being abducted to destroy the army….(the remarks) are misleading and provocative. The nation does not expect such false, provocative and irresponsible statements from a person who is holding a responsible position as that of leader of the opposition.' Through Begum Zia's speech an evil attempt was made to tarnish the image of a well-disciplined force like the army and create chaos the ISPR observed. No doubt that Begum Zia through her speech attempted to instigate the armed forces against the government and fish in troubled water as is currently happening in Pakistan. The similarity between the contents of Hizbut leaflet and Begum Zia's comments regarding the armed forces needs to be scrutinized more carefully. She still cannot forget for being thrown out by a court order from her cantonment residence which she occupied for about two decades.

Honestly speaking it was the Jamaat that benefitted the most out of the BNP rally in Chittagong, and even some of their leaders who were in hiding for avoiding arrest came out of their hideouts and spoke using the BNP rally. Though Salahuddin Quader Chowdhury was not on stage as he is in custody being tried by the International Crimes Tribunal, his entire family was on and his wife and son demanded unconditional release of SQC. People will not be surprised if in the near future the family members of Ghulam Azam demand his release from a BNP platform.

Though BNP's two day car rally clogging the vital Chittagong-Dhaka national highway that links the port city to the capital causing immense misery to the people, it must be thanked that finally BNP has thought of shunning the politics of hartal, at least for the time being. Only if they could realize the truth that hartal and other forms of violence will not take them to power. For such a short agenda one needs to be more pragmatic and practice something more pro-people. Finally the government needs to be felicitated for facilitating the BNP and their allies for holding the car rally and public meetings peacefully, though peace was marred in all venues of meetings because of the inner feuding of the BNP-Jamaat alliance.

Zia's Legitimacy to the Declaration of Independence

It is now clear that Mujib surrendered without declaring the independence of Bangladesh leaving people in total confusion. People were not going to wait for Mujib for ever especially when the Pakistani army was committing genocide which Mujib didn't see. At this moment, the frustrated AL leaders were looking for an effective leader to make the declaration. By this time, the spirited Zia already unilaterally declared independence to avert the crisis. AL leaders chose Zia to make the declaration again. It again shows the Mujib didn't declare independence and AL leaders had to find Zia to do it. Why Al leaders stoped searching for a leader to make the declaration? The answer is it was a war time situation, Zia was an army commander and the elected leader Mujib was not there to do anything.
Zia's declaration merits special significance for several reasons:
(1) He was a war time army commander who didn't need an election to be a leader. Fiedal Castro and many others were not needed to be elected to fight the enemy. In Mujib's betrayal for not clearly declaring the independence, after repeated request from colleagues, and even after request from commanders like Osmani, somebody had to do it.
(2) Zia's legitimacy was also reinforced by AL leader's choice of Zia (not any xyz) to make the declaration. Mujib demanding confederation was no more the fittest person to make the declaration. The march forward to the next level was made by Zia.
(3) He was not an ordinary "radio announcer" but a commander who made it clear and simple that Bangladesh is now fighting its liberation war. He was not for any negotiation with the Pakistani army anymore. It was a fight to the last for independence.While Mujib was in Pakistn, Hasina and her family was feed by the Pakistani army. It is unfortunate that Hasina, the razakar had to remove Zia's name from every place in Bangladesh.
I don't understand why some people are still shading their crocodile's tears, when Mujib intentionally didn't declare independence, after the independence initiated measures ( Farakka dam, printig money from India, free access of West Bengali and Marwari Dadas to Bangladesh etc) to make Bangladesh into an Indian colony that Hasina is completing the Indian mission.
 Lastly, Mujib was a dictator who after his return to Bangladesh killed the infant democracy by installing a one party system and with his nephew and two boys like in Iraq's Sadam and Libya's Gadaffi but Mujib only in three years turned Bangladesh into a failed state. If you not mujibbadi but is a forward looking person, why cry for a dictator who even killed 30,000 of people in three years that opposed his autocratic rule. Why not we rest him in peace and appreciate his genuine contributions such as his 6 point demands and his legendary 7th March speech?.

Mr. Anwar,

Again we are heading towards a controversy. We never deny the fact that
Zia had declared the Independence but he himself can not pronounce such
a historical announcement. He did not have such an ability, position
at that time.
He was not a political leader or a popular person familiar to the
people of Bangladesh.

In place of Ziaur Rahman if anybody else at that time would do the
same announcement our comment would have been the same. At that
particular period
Only the fittest person in all respect & acceptable to the people of
Bangladesh was Sk. Mujibur Rahmn , one & only the national leader of
that time .Again I would say, no one can declare the independence of a
nation.We must consider the time & moment. One can only read out a
script on behalf of a National leader if one is asked to do so.

So, I do not see any reason for an unnecessary controvery and all these.....

Dear Mannan Sir:
Assalamaualikum. In our eyes, we don't see much difference between Mr. Golam Azam and some of you.  Mr. Azam sold his soul to Pakistan and You, Muntasir sir and few others sold your soul to India. That's why Mr. Azam didn't see anything wrong in Pakistan's actions towards Bangladesh and you guys are doing to same when it comes to India. I'm sorry to say that, you all are rajakar's but in different times.
Sir, our generation wants a fair and free war crime trial so that we can start re-building Bangladesh from truth nothing but truth. As i said earlier, war crime trail must go on with proper process so that at the end, Bangladesh can move forward beyond our war criminal and non-war criminal saga.
Sir, our generation also will refuse to accept a divided Bangladesh with so called pro-liberation and anti-liberation forces. Though, 1971's anti-liberation forces are behaving more pro-liberation in 2012 and vice versa.
We want a free and fair trial because our nation was built on confusion and lies. It started on the very day of 16th December 1971. We still do not understand why Pakistani army had to surrender to Indian Army in OUR independence war. Why our military leadership wasn't able to attend the surrender ceremony? Why we established a complete distorted martyred figure of our war? Who is the real declarer of independence? Was it Moulana Bhasani, Bongobondhu and Shahid Zia! I can go on and on.
People like you and Golam Azam are the root cause of today's disarray of Bangladesh. As you people never allowed us to be ONE nation. You guys always divided us and took advantage of our ignorance.
But thank GOD you guys are not able to fool all the new generation of independent minds who can think and see what is going on in today's Bangladesh. We figured out who is the REAL beneficiary of a DIVIDED nation. When the whole world including India and Pakistan going fwd with science and technology we are going back ward on science and technology and is becoming a big garments factory.

Subject: Trial of Ghulam Azam

It seems that some people are shell shocked, disappointed and frustrated because of the arrest of Ghulam Azam. Why should someone who is 89 face such a humiliation they ask? Some questions the validity of ICT. Some wants his fair trial. Jamat has budgeted $25 million dollars initially, (this is documented)  to discredit this trial and wage a propaganda war within the country and internationally. There will be many beneficiaries of this big budget. Just for those interested below are two links of writings of former bureaucrat Mr. Waliur Rahman and Dr. Muntasir Mamoon, appearing in today's Daily Janakantha. Those interested may read it. I do not want any feedback nor any comments on it.

I am sure you did not read the article yourself. Mr. Rahman tried to decieve the readers in general but not readers of the Janakontha , because Janakantha readers are mostly one sided. Mr. Rahman testifying only for the International Tribunal Act of 1973 that was approved during Sheikh Mujib's time. He did not testify on the new version of  the International Tribunal Act of 1973 which has been ratified in such a way that it remained no more International in character except the word 'International" in it.

Let me remind you that when the  the International Tribunal Act of 1973 had passed at the Parliament of Bangladesh nobody at home or abroad said a word against it because that was compatable with international laws.
Just one example will suffies my statement and argument. The convicts ( I said convicts, because the people in the tribuna,l that is the judges, had already convicted them at Ghatok Dalala Nirmul Committee) will not be able to appeal to nobody per new amendment. Also articles by reporters (biased or not biased and the paper cuttings or clips will be acceptable as evidence without any doubt wich was not part of the act then. These types of things were not there in the original law of the tribunal act. In one word I can say that the act has been made upside down by force just to get easy conviction. That's not called rules of law.
Per that enactment of 1973, there were 160 thousands complain and cases filed against razakars and atrociy makers of 1971 but you know out of those 160 thousand cases there were none against the people who are in custody and are being tried by the party cadres now. Does it make a question mark in your open mind?

Subject: [Diagnose] Trial of Ghulam Azam

 
It seems that some people are shell shocked, disappointed and frustrated because of the arrest of Ghulam Azam. Why should someone who is 89 face such a humiliation they ask? Some questions the validity of ICT. Some wants his fair trial. Jamat has budgeted $25 million dollars initially, (this is documented)  to discredit this trial and wage a propaganda war within the country and internationally. There will be many beneficiaries of this big budget. Just for those interested below are two links of writings of former bureaucrat Mr. Waliur Rahman and Dr. Muntasir Mamoon, appearing in today's Daily Janakantha. Those interested may read it. I do not want any feedback nor any comments on it.

১৯৭১ সাল আমাদের কাছে যেমন গৌরবের, তেমনি কষ্টের। ১৯৭১ সালে ২৫ মার্চ মধ্যরাতে বাংলাদেশের মহান মুক্তিযুদ্ধের সূচনা হয়। পাকিস্তানী হানাদার বাহিনী ও তাদের এদেশীয় দোসরদের বিরুদ্ধে ভারতীয় মিত্রবাহিনীর সহায়তায় এ দেশের আপামর লাখ লাখ মানুষের মূল্যবান প্রাণের বিনিময়ে স্বাধীনতার বিজয় সূচিত হয়। স্বাধীনতার ৪০ বছর পূর্তি হয়েছে। দেশের তৎকালীন কিছু জঘন্য চরিত্রের স্বার্থান্বেষী মানুষ আমাদের স্বাধীনতার বিরোধিতা করেছিল। এরা পাকহানাদার বাহিনীর পক্ষ নিয়ে আমাদের মুক্তিযুদ্ধের অসহযোগিতা করে এবং মুক্তিবাহিনী ও সাধারণ মানুষের ওপর নারকীয় হত্যাযজ্ঞ, ধর্ষণ ও লুণ্ঠন চালায়। ফলে লাখ লাখ নিরীহ মানুষ পাকহানাদার বাহিনীর হাতে মারা যায়। এসব ঘৃণ্য স্বার্থান্বেষী মানুষ সে সময় যদি মুক্তিযুদ্ধে অসহযোগিতা না করত তাহলে হয়ত আমাদের স্বাধীনতার বিজয় অর্জনে এত বেশি মূল্যবান প্রাণ বিসর্জন দিতে হতো না। জাতিসংঘের প্রণীত রিপোর্টে বলা হয়, বিশ্ব ইতিহাসে স্বল্পতম সময়ে সর্বাধিক মানুষ নিহত হয় ১৯৭১ সালের গণহত্যায়। তাই স্বাধীনতাবিরোধী সে সব ব্যক্তিকে বিচারের কাঠগড়ায় দাঁড় করানো এ দেশের মানুষের দীর্ঘদিনের দাবি। যুদ্ধের সময় নিরস্ত্র মানুষকে হত্যা করা অনৈতিক। সে হত্যা যখন গণহত্যায় পর্যবসিত হয়, তখন তা অপরাধ আনত্মর্জাতিক আইন অনুযায়ী শাসত্মিযোগ্য। বাংলাদেশের স্বাধীনতার পর এবং সংবিধান গণপরিষদে গৃহীত হওয়ার পর থেকে বর্তমান সময় পর্যনত্ম এ দেশের আপামর জনগোষ্ঠীর একটি দাবি সেটা হলো যুদ্ধাপরাধীদের বিচার এবং এ ব্যাপারে যথাযথ এবং পূর্ণ এখতিয়ার সম্পন্ন বিশেষ ট্রাইব্যুনাল গঠন এবং স্বচ্ছ ও জবাবদিহিতামূলক বিচার এবং এটা বর্তমান সরকারেরও নির্বাচনী অঙ্গীকার। ইতোমধ্যে যুদ্ধাপরাধের বিচারে আদালত গঠন করা হয়েছে এবং বিচারের প্রক্রিয়াও চলছে। কিন্তু যুদ্ধাপরাধের সঙ্গে জড়িত ব্যক্তিদের বিরুদ্ধে তদন্ত প্রতিবেদন নিয়ে তোলা হচ্ছে নানা রকম প্রশ্ন।
সিমলা চুক্তি হওয়ার পরই বঙ্গবন্ধু অনুধাবন করেছিলেন যে, যুদ্ধাপরাধীরা হয়ত আইনের ফাঁক দিয়ে বের হয়ে যেতে পারে। সে কারণে তিনি তদানীনত্মন পররাষ্ট্র এবং আইনমন্ত্রীকে আইনের খসড়া তৈরি করতে পরামর্শ দিয়েছিলেন, যা একটি (আনত্মর্জাতিক) অপরাধ ট্রাইবু্যনাল গঠনে সহায়তা করবে এবং যা হবে যুগোপযোগী আনত্মর্জাতিক মানসম্পন্ন। তিনি বুঝতে পেরেছিলেন, নুরেমবার্গ ট্রায়ালের পর এটাই হবে প্রথম ট্রাইবু্যনাল। যুদ্ধাপরাধের তদনত্মের কাজে তৎকালীন পুলিশের ডিআইজি মরহুম নূরম্নল ইসলামকে ছিলেন চীফ ইনভেস্টিগেটর হিসেবে নিয়োগ করা হয়েছিল ১৯৭২ সালে। এ আইন প্রণয়নের সময় ঢাকায় আমাদের আমন্ত্রণে কলকাতার দু'জন প্রখ্যাত ব্যারিস্টার প্রবীণ সুব্রত রায় চৌধুরী এবং দীপঙ্কর ঘোষ ছিলেন। এঁদের মধ্যে ব্যারিস্টার প্রবীণ সুব্রত রায় চৌধুরী আনত্মর্জাতিক মানবাধিকার আইনের একজন স্বীকৃত বিশেষজ্ঞ ছিলেন। ঢাকা থেকে প্রত্যেকটি খসড়া পাওয়ার পর আমি আয়ারল্যান্ডের তৎকালীন পররাষ্ট্রমন্ত্রী এবং পরে জেনেভায় আনত্মর্জাতিক বিচার কমিশনের চেয়ারম্যান নিয়াল ম্যাকডোমের্টের সঙ্গে সাৰাত করেছিলাম। আইসিজে মানবাধিকার লঙ্ঘনের বিষয়টি নিয়ে কাজ করেন এবং আইনের শাসন প্রতিষ্ঠা বিরাজমান আদর্শকে পুনর্গঠিত করেন। প্রতিটি সেশনে আমি নিয়াল ম্যাকডোমের্টের সঙ্গে পরামর্শ করেছিলাম। যুদ্ধাপরাধী আইনের প্রথম খসড়াটি প্রস্তুত করার পর এটিকে ঢাকায় বিশেষ বাহকের মাধ্যমে তৎকালীন আইন মন্ত্রণালয়ের পাঠানো হয়েছিল। পরীৰা-নিরীৰা করার পর এটিকে পুনরায় জেনেভা পাঠানো হয়েছিল। যদিও ওই সময় আনত্মর্জাতিক চাপসহ অন্যান্য পারিপাশ্বর্িক অবস্থার প্রেৰিতে যুদ্ধাপরাধীদের বিচার সংক্রানত্ম বিষয়ে বাংলাদেশ সরকার আর বেশিদূর অগ্রসর হতে পারেনি। ১৯৭৩ সালের ১৯ জুলাই সংসদে এটিকে একটি আইন আকারে সংবিধানে অনত্মভর্ুক্ত করার সিদ্ধানত্ম হয়। আমেরিকার প্রধান প্রধান আইনজ্ঞর মতে, বাংলাদেশের যুদ্ধাপরাধী আইন ট্রাইবু্যনাল গঠনের জন্য পরীৰিত ও নিরীৰিত। এ আইনটি ম্যাঙ্পস্নাঙ্ক ইনস্টিটিউট অব ইন্টারন্যাশনাল ক্রিমিন্যাল ল-এর দু'জন আইনজীবী প্রফেসর ইয়েসেক ও প্রফেসর অটো ভ্রন ট্রিফটারার যিনি নুরেমবার্গ ট্রায়ালের প্রধান প্রসিকিউটর বিচারপতি জ্যাকসনকে সাহায্য করেছিল, তাদের দ্বারা পর্যবেৰিত এবং বিশেস্নষিত। প্রফেসর অটো ভ্রন ছিলেন আনত্মর্জাতিক যুদ্ধাপরাধী আইনে বিশেষভাবে সুদৰ। প্রফেসর ইয়েসেক এবং প্রফেসর অটো ভ্রণ ট্রিফটারার উভয়ই গভীরভাবে বিশ্বাস করেন যে, এই আইনটি সময়োচিত ও পরীৰিত, কারণ ওই সময় নুরেমবার্গেও এ ধরনের আইনি বিচার হয়নি। তাঁদের মতে, বাংলাদেশে মানবতার বিরম্নদ্ধে যুদ্ধ এবং মানবতার বিরম্নদ্ধে অপরাধ আইনটি প্রথম গ্রন্থভুক্ত করা হয়েছিল। আনত্মর্জাতিক চাপসহ অন্যান্য পারিপাশ্বর্িক অবস্থার কারণে বিচার প্রক্রিয়া পিছিয়ে যায়। দীর্ঘ ৪০ বছর পর সময় এসেছে সিদ্ধানত্ম নেয়ায় যে, যারা মানবতার বিরম্নদ্ধে অপরাধ, ধর্ষণ, নারী নির্যাতন, গণহত্যার মতো জঘন্য অপরাধ করেছিল তাদের বিচার করতে হবে যাতে ভবিষ্যতে এ ধরনের অপরাধের পুনরাবৃত্তি না ঘটে।
১৯৭৩ সালের ইন্টারন্যাশনাল ওয়ার ক্রাইম ট্রাইবু্যনাল এ্যাক্ট আনত্মর্জাতিক মানের। ট্রাইবু্যনালের নিবন্ধক (রেজিস্ট্রার) স্বয়ং বলেছেন, ট্রাইবু্যনাল বিশ্বজনীনভাবে স্বীকৃত মানের সঙ্গে মানানসই। সঙ্গত কারণেই যে কোন অপরাধের বিচারের ৰেত্রে যথাযথ প্রক্রিয়া অনুসরণ ও স্বচ্ছতা নিশ্চিত করা প্রয়োজন_ কেবল আনত্মর্জাতিক অপরাধ ট্রাইবু্যনালে অভিযুক্ত ব্যক্তিদের জন্যই নয়, বরং ট্রাইবু্যনালের অভিযুক্ত বৈশিষ্ট্য যেখানে সহজেই সবার দৃষ্টি থাকবে। যথাযথ মান অর্জন মানে উপযুক্ত পদ্ধতিতে সাৰ্যপ্রমাণগুলোর ভিত্তিতে কোন ব্যক্তির ৪০ বছর আগে করা অপরাধের বিষয়টি নিশ্চিত করতে পারা। এখানে আনত্মর্জাতিক আইনের মানদ- অনুসৃত হচ্ছে কারণ ১২টি দেশে যে বিচার কাজ চলছে সেই ধারাবাহিকতায় আমরা অগ্রসর হচ্ছি, এমনকি আইসিসির চেয়ে ভাল করছি। সরকার ১৯৭৩ সালের ট্রাইবু্যনালে কিছু পরিবর্তন করেছে। বিচার চলাকালীন তারা তাদের জন্য উকিল নিয়োগ করতে পারে, অভিযুক্ত ব্যক্তি নিজেকে রৰার জন্য ট্রায়ালে যে কোন সাৰ্যপ্রমাণ উপস্থাপনের অধিকার আছে এবং তাদের বিরম্নদ্ধে দ- ও শাসত্মির বিরম্নদ্ধে সুপ্রীমকোর্টের এ্যাপিলেট বিভাগে আপীল করতে পারবে। যুদ্ধাপরাধের জন্য যতগুলো আনত্মর্জাতিক আইন আছে সেগুলোতে এ রকম বিধান নেই, এমনকি কম্বোডিয়ায় চলমান বিচার প্রক্রিয়াতেও। পৃথিবীর কোন ট্রাইবু্যনালে নেই, এমনকি আইসিসিতেও নেই যে, কোন অভিযুক্ত ব্যক্তি তার বিরম্নদ্ধে আনীত অভিযোগের জন্য একজন আইনজ্ঞ নিয়োগ করতে পারেন। দ-িত ব্যক্তির উকিল নিয়োগ, সাৰ্যপ্রমাণ উপস্থাপন এবং আপীলের অধিকার দেয়া হয়েছে যে আইনে সেখানে বিচার পৰপাতমূলক হওয়ায় কোন সুযোগ নেই। সরকারের বিরম্নদ্ধাচরণকারী, যারা বলছে যে, এই ট্রাইবু্যনাল ব্যবহার করে রাজনৈতিক উদ্দেশ্য হাসিল করছে, তাদের বক্তব্য ভুল প্রমাণিত হবে। আত্মপৰ সমর্থনের স্পষ্ট সুরৰাসহ সঠিক পদ্ধতিতে কাঠামো অনুসরণ করা হলে তা দেশজুড়ে জনগণের মধ্যে এবং বিদেশেও আস্থা প্রতিষ্ঠা করবে যে, এই মামলা এবং মামলার বিচারটি নিরপেৰ। এই বিচার সুষ্ঠুভাবে হওয়া মানে তা আইনি দৃষ্টানত্ম হিসেবে যেমন, তেমনি যুদ্ধাপরাধের বিচারের অভিজ্ঞতায় ইতিবাচক প্রভাব ফেলবে। তাতে জাতিসংঘ সমর্থিত অতি ব্যয়বহুল প্রক্রিয়ার বদলে জাতীয় ট্রাইবু্যনাল প্রতিষ্ঠায় নতুন ধারা সূচিত হবে। ইউএস এ্যামবেসাডর ঝঃবঢ়যবহ ঔ জধঢ়ঢ় ট্রাইবু্যনাল সম্পর্কে মনত্মব্য করতে গিয়ে বলেন, প্রসিকিউটর এবং বিচার প্রক্রিয়ার সঙ্গে সম্পৃক্ত সব কার্যক্রম সঠিক গতিতে অগ্রসর হচ্ছে এবং বিচার প্রক্রিয়াকে স্বচ্ছ করার জন্য আনত্মর্জাতিক কমিউনিটি হতে সুপারিশমালা গ্রহণ করা হচ্ছে। যুদ্ধাপরাধীদের দায়মুক্তির অবসান ঘটিয়ে জবাবদিহিতা প্রতিষ্ঠার পথে অপরাধীদের বিচার এবং বেঁচে যাওয়া মানুষের বঞ্চনার প্রতিকারের জন্য যাঁরা আন্দোলন চালিয়ে যাচ্ছেন, এসব কারণেই উচিত ট্রাইবু্যনালের উচ্চ মান দাবি করা। বিচার এবং মান নিশ্চিতের এই দুই অবস্থানের মধ্যে তাই কোন স্ববিরোধিতা নেই।
এক সাগর রক্ত আর অসংখ্য মা-বোনের সম্ভ্রমের বিনিময়ে অর্জিত আমাদের স্বাধীনতা আজ কুলষিত। অত্যনত্ম লজ্জার বিষয় যে, যারা মুক্তিযুদ্ধের বিরোধিতা করেছে, যারা নির্বিচারে বাঙালীদের হত্যা করতে সাহায্য করেছে, সেসব নরপিশাচ রাজাকার আলবদর আলশামসদের সঙ্গে একটি মহল অাঁতাত করেছে। আর তাদের জন্যই পাকিসত্মানের দালাল পুরনো সেই শকুনেরা আজ আবারও মাথাচাড়া দিয়ে উঠেছে। যারা স্বজন হারিয়েছে, স্বজন হারানোর বেদনায় যাদের হৃদয় এখনও ব্যথিত, আসুন আমরা ঐক্যবদ্ধ হয়ে ট্রাইবু্যনাল যাতে সঠিক সময়ে ও স্বচ্ছভাবে কার্যকর হয় সেজন্য সর্বাত্মক চেষ্টা করি এবং আমি আশা করি আর কোন দ্বিধাদ্বন্দ্বে না থাকে শত শহীদের আত্মার প্রতি শ্রদ্ধা জানিয়ে, শত লাঞ্ছিত মা-বোনের ইজ্জতের প্রতি সম্মান জানিয়ে মুক্তিযুদ্ধের চেতনা ও লৰ্যকে প্রতিষ্ঠিত রেখে গোলাম আযম ও মতিউর রহমান নিজামীর মতো যুদ্ধাপরাধীদের বিচারে কেউ দ্বিমত পোষণ করবেন না।

Dear Mr. Shah Abdul Hannan:
 
Assalamualaikum. Sir, I admire you as you were an honest and excellent ex-secretary of Bangladesh govt. I heard that even our Prime Minister Sheikh Hasina didn't let you go from your NBR post (knowing your political affiliation) in her first tenure.
 
But I don't understand why you are continuing defending Mr. Golam Azam! Mr. Azam vigorously opposed our independence and he shouldn't have come back to Bangladesh in the first place. I understand he has his reasons for his actions (as we all do), however, the bottom line is he didn't want to see an independent Bangladesh. Period.
 
Sir, I know you are a political activist of Islam. But if you want to achieve anything in Bangladesh's Islamic politics, you must distant yourself from Jamaat first. As Jamaat is a complete failure in the subcontinent politics with countless missteps. And in Bangladesh, Jamaat did the biggest blunder by opposing our independent and not asking for total forgiveness for their 1970/71's role. Not to mention that Jamaat and Mr. Azam is hated by more than half of our population.
I know AL/BNP is no better, but if you are doing Islamic politics you have no room to be better but best.
 
So pls, stop defending Mr. Golam Azam and rest of the Jamaat leadership and let them go through the unfair trial as they deserves it.

FYI, some of us are similarly vocal against the unjust procedures of war crime tribunal as everyone deserves fair justice regardless of their crime. However, war crime trail must go on with proper process so that at the end, Bangladesh can move forward beyond our 1971 saga.

 Abdul Mannan sahib  is wrong.Azam sahib's all actions in 1971 were  reviewed  by the Supreme court as his citizenship was cancelled in 1972 by Awami League government on his alleged offences in 71.So there is nothing to be seen now by a lower status tribunal.

Please do not confuse people. Ghualm Azam was tried for restoration of his nationality and not for the crimes. Two are absolutely different issue. He never face trial for crimes he committed in 1971.

Golam Azam was tried before once. The verdict was given by famous and former Chief Justices, Habibur Rahman, Latifur Rahman, ATM Afzal, Mustafa Kamal. Again he was arrested for the almost same reasons, same allegations in nature.
 
Do you think the way current ICT is moving (Sayedi's trial is a best example), he or any Jamat leaders will get justice?

জামাতের রাজনীতির সাথে আমি জীবনেও জড়িত ছিলাম না। কিন্তু একটা জিনিস আমি কিছুতেই মেলাতে পারছি না, যে কোন মানুষের বিচার একবার হয়ে গেল তার আবার কিভাবে বিচার হয় সেই একই অপরাধে?


১৯৯৪ সালের ২২ জুন দেয়া ৫৪ পৃষ্ঠার রায়ে গোলাম আযম সম্পর্কে ১৯৭১ সালের অভিযোগ নাকচ করে দিয়ে বিচারপতিদের করা মন্তব্য ছিল রকম : There is nothing to directly implicate the petitioner (Golam Azam) in any of the atrocities alleged to have been perpetrated by the Pakistani Army or their associates the Rajakars, AL Badrs or the AL Shams. Except that the petitioner was hobnobbing with the Military Junta during the war of liberation, we do not find anything that the petitioner was in any way directly involved in perpetuating the alleged atrocities during the war of independence.

'১৯৭১ সালে মুক্তিযুদ্ধ চলাকালে যেসব বর্বরতার অভিযোগ রয়েছে, তা সংঘটনের সাথে অধ্যাপক গোলাম আযম কোনোভাবে সরাসরি জড়িত ছিলেন, এমন কোনো কিছু আমরা পাইনি।'
১৯৯৪ সালে জামায়াতে ইসলামীর সাবেক আমির অধ্যাপক গোলাম আযমের নাগরিকত্ব ফিরিয়ে দেয়ার বিষয়ে দেশের সুপ্রিম কোর্টের আপিল বিভাগের রায়ে কথা উল্লেখ রয়েছে।
রায়ে আরো উল্লেখ করা হয়, 'পাকিস্তানি আর্মি তাদের সহযোগী বাহিনী রাজাকার, আলবদর কিংবা আলশামসের বিরুদ্ধে ১৯৭১ সালে যেসব বর্বরতার অভিযোগ রয়েছে, তার একটির সাথেও অধ্যাপক গোলাম আযমের সরাসরি কোনো সম্পর্ক নেই।'
আপিল বিভাগের ৎকালীন বিচারপতি হাবিবুর রহমান, বিচারপতি টি এম আফজাল, বিচারপতি মুস্তাফা কামাল বিচারপতি লতিফুর রহমান ঐতিহাসিক রায় দেন। এই চার খ্যাতিমান বিচারপতির সবাই পরে বাংলাদেশের প্রধান বিচারপতির আসন অলঙ্কৃত করেন এবং তাদের মধ্যে বিচারপতি হাবিবুর রহমান বিচারপতি লতিফুর রহমান তত্ত্বাবধায়ক সরকারের প্রধান উপদেষ্টা নির্বাচিত হয়েছিলেন।

অথচ কারাগারে গোলাম আযমকে পাঠানো হল ওই একই অভিযোগে!


যেখানে বাঘা বাঘা বিচারপতিরা পর্যন্ত উনার সাথে মানবতাবিরোধী অপরাধের যোগসূত্র খুঁজে পাননি, সেখানে এই চুনোপুঁটিরা কি করবে? সেখানে কি কোন ন্যায়বিচার হবে? আসামীর ন্যায়বিচার রক্ষা করতে না পারলে তো সেদেশে আইন বলে কিছু থাকতে পারে না। আর আইন না থাকা মানে দেশ ধ্বংস হওয়া। আসামী মানেই তো অপরাধী না যতক্ষণ পর্যন্ত না তা প্রমাণিত হয়।
হয়তো কারনেই ৮৯ বছরের এই প্রবীন রাজনীতিক বারে বারে বলেছেন, শহীদী মৃত্যু সব মুমিনের বড় পাওয়া। হয়তো উনি জেনে গেছেন এই সরকার যেনতেনভাবে জামাত নেতাদের ফাঁসিতে চড়াবে। জীবনে উনি রাজনীতির অনেক টালমাটাল দেখেছেন, কিন্তু এত বেয়াদবের সরকার হয়তো জীবনে দেখেন নি। আর সেজন্যই বলছেন, বিছানায় শুয়ে শুয়ে মরার চেয়ে শহীদী মৃত্যু অনেক উত্তম। বাবারে গা শিউরে উঠে সাহস দেখে! অন্ততঃ গোলাম আযমের শত্রু আওয়ামী লীগের উচিত হবে না তার আকাংখিত শহীদী মৃত্যু আলিংগনের সুযোগ দেয়া!

সাঈদী সাহেবেরটাও তো ওদিকেই যাবে। চোর-বাটপারদের সাক্ষী-সাবুদ করা হলেও দেখা যাবে ফাঁসির রায় কেউই ঠেকাতে পারছে না। ট্রাইব্যুনালের বিচারপতিরা ঠিকই সরকারের আইজিপির মত (সরকার যে উদ্দেশ্য নিয়ে ক্ষমতায় এসেছে তা বাস্তবায়ন করবো: আইজিপি বিস্তারিত পড়ুন এখানে ) সরকারের উদ্দেশ্য বাস্তবায়ন করেই ছাড়বে। কারণ সেজন্যই এসব অযোগ্যদের ধরে ধরে বিচারপতি নিয়োগ দেয়া হয়েছে আর প্রসিকিউটরও বানানো হয়েছে বাছুড়দেরকে যেটা কাদের সিদ্দিকী বলেছিলেন। জামাতের তূখোড় আইনজীবিদের কাছে এরা কিছুই না। শাহরিয়ার কবিরও সেটা স্বীকার করেছেন।

তারপরও দেখা যাবে সবাই ফাসিতে ঝুলছে। কিন্তু কারো রায়ের কপি আসামী পক্ষের আইনজীবিরা সারা দুনিয়া চিল্লাচিল্লি করেও পাচ্ছেন না। এমনটাই কিন্তু মাহমুদুর রহমানের কেসে হয়েছিল। বেচারা বছরখানেক জেল খাটলেন কিন্তু জানলেন না কোন ধারায় কিইবা কারণে তিনি এতদিন জেল খাটলেন। তত্ত্বাবধায়ক সরকার বিল বাতিল, সংবিধানে ধর্মনিরপেক্ষ যোগ, বিসমিল্লাহ বিয়োগ ইত্যাদি নিয়ে সংবিধান কাটা হেছড়ার রায়ের কপি কিন্তু আজো নাই। আমি গ্যারান্টি দিয়ে বলে দিতে পারি, এটা হাসিনার আমলে বেরুবে না। কারণ এসব অবৈধ রায়। কোন ভিত্তি নাই।
ঠিক এভাবেই জামাত নেতাদেরকে এভাবে ফাঁসি দেয়া হবে।
