Dhaka's Bay claim: Delhi submits memo to Hague court



India on Tuesday submitted a 'counter-memorial' to the Permanent Court on Arbitration in The Hague on its maritime boundary dispute with Bangladesh.'India has submitted the counter-memorial. The court is expected to make it available to us by early next week,' a Bangladeshi diplomat told New Age on Wednesday.

Bangladesh lodged its statement of claim at the scheduled time (by May) in 2011.India was scheduled to respond to Bangladesh's claim by May 2012, but pleaded to the court to be given two months' grace for going through the judgment of the International Tribunal for the Law of the Sea that settled the maritime dispute between Bangladesh and Myanmar. The ITLOS delivered the verdict on March 14.

Bangladesh and India approached the Permanent Court on Arbitration in 2009 to resolve the longstanding dispute over the maritime boundary in the oil- and gas-rich Bay.However, Bangladesh and India have kept open the option for settling the maritime boundary dispute through bilateral negotiation.

Paragraph 21 of the joint communiqué, issued after Prime Minister Sheikh Hasina's visit to New Delhi in 2010, says: 'Both prime ministers agreed on the need to amicably demarcate the maritime boundary between India and Bangladesh.'They noted the initiation of proceedings under Annex VII of the United NationsConvention on the Law of the Sea (UNCLOS) and, in this context, welcomed the visit of a delegation from Bangladesh to India.'

On March 17 this year, Indian high commissioner to Dhaka Pankaj Saran told reporters that India wants to resolve the maritime boundary dispute with Bangladesh bilaterally.
After a meeting with foreign minister Dipu Moni, Pankaj was asked by journalists if India would favour a bilateral settlement of the issue, he said, 'I am sure we will.'His comment came three days after Bangladesh got a verdict from the ITLOS settling the maritime dispute with Myanmar after 38 years.

India and Myanmar were in close contact while dealing with their maritime dispute with another Bangladesh, said the diplomat.On March 19, Dipu Moni ruled out any possibility of withdrawing Bangladesh's maritime boundary case against India, but said that bilateral negotiations could continue alongside arbitration on the basis of the principles set by the ITLOS.

'There is no scope to withdraw the case because we went for arbitration since we did not get any solution through discussions with India,' she had said at a press conference in the foreign ministry.'The door for discussions is open if they (India) want that, but the discussions are to be based on the ITLOS principles, ensuring Bangladesh's legitimate rights,' Dipu Moni stated.

The five-member arbitral court is expected to deliver its verdict in 2014. The judgment will be final and without appeal.

14 killed in political violence in July; 6 fell victim to extra-judicial killing: Odhikar

At least 14 people were killed and 1,123 injured in political violence across Bangladesh from July 1 to July 31 this year while seven people were killed and 762 others injured in political violence in the country during June.

The revelation came in a report about death in political violence in Bangladesh in June and July, 2012, made by Odhikar, a human rights group.

Odhikar in its report released on Wednesday said seven persons were killed and 430 others injured in 46 incidence of infighting in ruling Awami League while one person was killed and 104 others were injured in 11 factional clashes of main opposition party BNP.

According to information gathered by Odhikar, six persons were killed extra-judicially by members of law enforcement agencies last month.

Among the victims, three were killed in gun fights with members of Rapid Action Battalion (Rab) and three others were shot dead by members of Bangladesh Ansar.

Due to the weak criminal justice system, the tendency of taking the law into one's own hand is rising, as people are losing their confidence and faith in police and the judiciary, Odhikar commented in its report.

A total of 14 people were killed in mob beating across the country last month, the Odhikar report mentioned.

According to statistics, data document shown in the report one journalist was killed, another was tortured by Detective Branch (DB) of police, 34 were injured, two came under attack, five were assaulted and three journalists received threat on July 1-31.

Incidents of human rights violations along India-Bangladesh border also occurred in July.

Five Bangladeshi citizens were killed allegedly by India`s Border Security Force (BSF); among them three were shot dead and two were tortured to death in the month of July, the Odhikar report said.

BSF beat and injured 11 Bangladeshis; among them six were shot and five tortured. During this period, two Bangladeshis were abducted by BSF.

Violence against women continued in July. A significant number of women were the victims of rape, dowry related violence, acid violence and sexual harassment during this period, the Odhikar report said.

Violence against women persists in high numbers due to weak criminal justice system and the numbers of criminals accused of committing violence against women marked a rise in the society in July due to the failure to bring them under justice and effective apply law against them.

During this period, 43 women and one 16-year-old girl, who is also a victim of early marriage, were subjected to dowry related violence. Of these women, it has been alleged that 25 women were killed because of dowry and 18 were ill-treated in various other ways for dowry demands.

Besides, a total of 47 girls and women were victims of sexual harassment. Among them, one was killed by stalkers, one was injured, 15 were victims of attempted rape and 30 were sexually harassed in various ways.

Furthermore, three men were injured and 14 other men and one woman were assaulted by stalkers for protesting such crimes.

A total of 55 females were reportedly raped in July. Among them, 29 were

Women and 25 were children below the age of 16.

Of the women, one was killed after being raped, 13 were victims of gang rape. Out of the 25 child victims, two children were killed after being raped and four were victims of gang rape.

Six persons became victims of acid violence. Among them, four were women, one was a man and the other was a girl

From my research on Arakanese Rakhines and the Rohingyas for the past 32 years, I have no doubt in my mind that the report by MS Anwar (see below) coming directly from Arakan is true. Rakhines are masters of cruel deception. This time to the visiting UN Special Rapporteur, Mr. Tomas Ojea Quintana deceiving the actual situation of Arakan.(http://www.rohingyablogger.com/2012/07/current-situation-of-arakan-30th-july.html) The cover up of the crime scenes is clear even from Burmese President's previous statement asking for Rohingya's mass deportation.

Today, these Rakhine ultra nationalists are powerful in the Burmese army, security force and in the police. Most dangerous of all is that these Rakhine extremists are also the followers of a Rakhasa Buddhism. Like their cousins in Cambodian and Sri Lanka, they are capable of committing genocide.

Here in Arakan, Rakhine religion of Rakhassa have been used as a religious ideology;meaning Arakan is for Rakhine race only, killing the Rohingyas man, women and children randomly by the use of machetes,with the excuse of Rohingyas as being "foreigners." This is even when the victim Rohingya ancestors were there for centuries, even from the time of the Indian Chandras. For the Rakhine Mogh's historic barbarity in the region, no wonder why Arakan was named by Bengalis as the Moghur Mulluk "Land of the lawless people".

When there is a planned ethnic cleansing (genocide) going on, I wonder why Suu Kyi lost her voice, and Dalai Lama is in his deep meditation, and where is America's fight against terrorism this time when for the sake of its business interest in Burma, how can it define Rakhine terrorism against the Rohingya?

Burma's Rakhine problem is not over yet, Rakhine extremists are dangerous elements and in collaboration with the Generals are good at playing the cat and mouse game, of course until they are caught red handed. I am sure, Mr. Tomas Ojea Quintana and his expert team (different from the previous Indian naive visitor) and the international body already know and couldn't be fooled many times. I am sure, they are almost there because the massacre is an open wound from a full-blown genocide!

This report describes how the Burmese authorities failed to take adequate measures to stem rising tensions and the outbreak of sectarian violence in Arakan State. Though the army eventually contained the mob violence in the state capital, Sittwe, both Arakan and Rohingya witnesses told Human Rights Watch that government forces stood by while members from each community attacked the other, razing villages and committing an unknown number of killings.The report is based on 57 interviews conducted in June and July 2012 with affected Arakan, Rohingya, and others in Burma and in Bangladesh, where Rohingya have sought refuge from the violence and abuses.
