[chottala.com] Towards a Free and Fair War Crime Tribunal in Bangladesh

Although Bangladesh (formerly East Pakistan) got its independence from Pakistan in 1971 following a bloody war, the nation has yet to resolve one of its contentious issues, the issue of war criminals, that is still dividing the nation. Today, the country is ready to try the ‘war criminals’ not of Pakistani forces but of its own people who opposed the idea of an independent Bangladesh, fought for a united Pakistan, and committed war crimes.

As an election promise, the government of Bangladesh seems to be very serious in prosecuting the war criminals through a special tribunal despite doubts and skepticisms mounting from home and abroad regarding a free and fair trial. Recently, the American Muslim Taskforce on Civil Rights and Elections (AMT), a coalition of major national Islamic organizations, held a news conference on 22 March 2010 in the National Press Club in Washington, D.C., to call for ending, among other things, ‘suppression of political oppositions and wrongful accusation and persecution of Islamic leaders for so-called “war crime”.’

A petition signed by AMT Chair Dr. Agha Saeed was also sent to the Secretary of State, Hilary Clinton (AMT Newsletter, Vol. 10, No. 1). International Bar Association (IBA) also found about a dozen loopholes in The Crimes (Tribunal) Act, 1973, by which the accused would be tried (bdnews24.com, Dhaka, 14 March 2010). Most importantly, Evidence Act and Criminal Procedure code application has been excluded by section 23 of the Act, and this may make the tribunal a kangaroo court. Therefore, despite the government’s commitment to assuring a fair and free trial, the whole move remains largely contested.

The AMT, along with other keen observers, think that the government is deliberately targeting a particular political party, Bangladesh Jamaat-e-Islami (BJI), the largest mainstream liberal Islamic party of the country that formed coalition government with Bangladesh Nationalist Party (BNP) during 2001-2006. They claim that Bangladesh Awami League (BAL), the party in power, came up with a plan to try the “war criminals” of 1971 and accordingly have created a discourse in which they have selectively targeted only the leaders of the BJI.

It is evident in history, however, that war crimes, alongside grievous oppression of civilians were committed in the 1971 war by the Pakistani forces and some of their local allies. Following the independence of Bangladesh, 195 Pakistani army officers were identified as war criminals in the preliminary investigation by the then Bangladesh government.

Following the Simla Agreement signed on 2nd July 1972 between Indira Gandhi, Prime Minister of India and Zulfikar Ali Bhutto, President of Pakistan, a number of agreements were signed between India and Pakistan regarding repatriation of the POWs. On 9th April 1974, an Agreement was signed between Bangladesh, India, and Pakistan in New Delhi in which, among other issues, the question of trial of the 195 POWs was raised and finally it was decided that they would be repatriated to Pakistan along with the other prisoners without trial (The Daily Tribune, Wisconsin, 10 April 1974). For better understanding, paragraph 15 of the 1974 Agreement is quoted here: “In the light of the foregoing and, in particular, having regard to the appeal of the Prime Minister of Pakistan to the people of Bangladesh to forgive and forget the mistakes of the past, the Foreign Minister of Bangladesh stated that the Government of Bangladesh had decided not to proceed with the trials as an act of clemency. It was agreed that the 195 prisoners of war may be repatriated to Pakistan along with the other prisoners of war now in process of repatriation under the Delhi Agreement.”

On 24 January 1972, the government of Bangladesh enacted another law to try those who did not side with the liberation war, or politically opposed the call of liberation war, or willingly cooperated with the Pakistan Army or committed criminal acts. It was called the Collaborators Act, 1972. More than a hundred thousand persons were arrested under that Act. Of them, 37,471 persons were charged. Another 30,623 could not be prosecuted for lack of evidence.

A total of 2,848 were brought to trial. Of them, 752 were found guilty. BJI claims that, none of its leaders was ever convicted of war crimes. The remaining 2,096 accused persons were found not guilty and freed. Taking into account the overall situation (of discontent) obtaining in the country, in November 1973 the Government of Bangladesh under the leadership of Bangabandhu Sheikh Mujibur Rahman declared a general amnesty. By virtue of the general amnesty, those accused or convicted for minor crimes under the Act were all set free. But those accused of rape, murder, arson or plunder were not pardoned. In other words, the general amnesty kept the scope of prosecution and trial of those accused of such serious crimes under the Act. On December 31, 1975, the Collaborators Act was repealed by a Presidential Order. After the amnesty, the Act remained in force for a little over two years. In that period, no case was filed for the said four serious offences. Perhaps that was the logic behind repeal of the law in 1975.

The attempt of the Bangladesh government for trials of war crimes after 39 years is, however, according to many, a politically motivated act. It is claimed that the government is conducting a “hate campaign against some individuals before any charge has been brought against them, let alone be proved in the court of law.” Many apprehend that the tribunal will thus simply be a kangaroo court. A list of 36 war criminals has already been announced even before the trial has started and among them majority of them are from BJI. Few of them in the list were even between 4-8 years old during the war in 1971 (Daily Amar Desh, 28 March 2010). It is further claimed that “while the issue of war crimes was resolved internationally (through Simla Agreement) and nationally (through Collaboration Act), bringing it up again shows that it is highly politically motivated. Moreover, Bangladesh judiciary is now being subjugated by the current regime and therefore a fair judgment is absolutely unexpected from this politically motivated trial” (Daily Amar Desh, 16 February 2010).

The skepticism and doubts about a free and fair trial remain largely intact because of some fundamental reasons: First, the tribunal will not try the actual war criminals, the 195 Pakistani army officers, who were identified as war criminals but got released after a tri-party agreement between Bangladesh, India, and Pakistan. Second, it intends to try only some “collaborators” belonging to an opposition party who supported a united Pakistan but do not have any proven record of war crimes, such as killing, rape, arson etc. Third, the International Bar Association (IBA) thinks, the Act does not guarantee any free and fair justice and protection for the convicted ones. Fourth, it is not clear how much the judges of this court are either trained or neutral for this specialized kind of trials. According to various reports, most of the appointed judges and prosecutors are former party men of ruling coalition. Finally, many doubt that the legal apparatus is being manipulated and therefore expectation of a fair and free trial is a mere dream, while currently there have been rampant violations of human rights without any justice, such as 154 extra-judicial killings in 2009 (Odhikar 2009 Report).

More importantly, if the trial is not conducted freely and fairly for all criminals irrespective of any kind of political affiliation, the nation has to pay a severe price. In the first place, for example, if it targets only the members of Islamic parties, reconciliation with the Muslim world will be very difficult. While Bangladesh needs to build strong relations with the Muslim countries for financial support and for supplying manpower to those countries, this will have a negative impact. Second, having no alternative, the BJI which is openly involved in the democratic process of politics may go underground due to the unjust trial. If that happens, it will be dangerous for the nation. In Turkey, once Islamic party was banned for many years but it has come back to power now. BJI’s open activities can be banned temporarily but who knows it may come back if one takes the lesson from history. Third, the unfair trial will divide the whole nation as BJI has millions of supporters which are evident from last few elections. Finally, if the regime fails to conduct the trial, it will backfire the party-in power.

The whole move of the government so far seems to be interpreted by the international communities as nothing but an extreme political vendetta and is intended to subdue the opposition party/parties. This is called “victor’s justice”, which is a questionable justice. The regime has already started a nation-and-worldwide campaign for this trial and obstructed the free movement and overseas travel of the BJI leaders. If this highly disputed trial is conducted unfairly, Bangladesh will certainly enter into another dark chapter of political chaos, uncertainties, and most likely a civil war. Every patriotic Bangladeshis believe that very tragic and pathetic incidents/crimes happened during the liberation war in 1971. If the trial is held, the government must ensure a free and fair trial beyond any doubt. The best way is to form an international tribunal under the auspices of the United Nations. It will not only provide credibility to the current regime, but also remains a reference for trying other war crimes committed elsewhere.

Present BAL is born on the blessing of Mr Ziarur Rahman.
Major formed his party BNP & rebirth twin BAL under the leaderships of Abdul Malik Ukil & Mijanur Rahman.And
The present BAL is the inheritant of Abdul Malik Ukil's BAL.

   â€˜You cannot build a digital Bangladesh if the people experience load shedding 14 times a day. Before going for digitalising Bangladesh, you will have to meet the demand for gas and water.’
   In an implicit warning to the government, Kader Siddiqui, said, ‘People will not always remain friendly to you.’
   As the audience was chanting Joy Bangla, the liberation war hero said, ‘I say both Joy Bangla and Bangladesh Zindabad, as I am a Bengali by birth and at the same time I am a Bangladeshi as it is my country.’
   Jatiya Samajtantrik Dal general secretary Abdul Malek Ratan said though the countrymen had achieved the geographical map of Bangladesh in 1971, their true emancipation remained unattained.
   â€˜We never saw democracy functional in the last 39 years. The definition and character of democracy has been changed. Now democracy is about going to power by spending crores of taka in elections to plunder public wealth.’
   He said it was important that we change the political culture, governing system and the leadership. Echoing him, Shahed Obayed, the convener of Garbo Bangladesh, said 95 per cent of the country’s politicians did not do politics in the true sense of the term.
   â€˜They are simply busy making their chiefs happy in exchange for money. Political leadership is not something which can be inherited.’
   The discussion meeting, presided over by Shaheda Obayed, was also addressed by former state minister Syed Didar Bakth, Jatiya Party’s additional secretary general Sadek Siddiqi, former lawmaker Del-war Hossain and BKSAL chairman Sharif Md Amiruzzaman.

Blocking of DeshCalling indicates the true meaning of `Digital Bangladesh'

 

 

Dear All,

 

I recently received an email from a yahoo forum indicating an article linked to the DeshCalling blog operated by Barrister MBI Munshi.  When I opened the link I saw a caption stating that the blog was blocked to viewers in Bangladesh. Visitors to the site apparently see only a white screen or a backdated version of the blog without recent posts being displayed. Since I am in London I could view the blog and tried to discover the reason for the Bangladesh government's action. It seems that Barrister Munshi had published two articles (written anonymously) on the Pilkhana Massacre which revealed direct government complicity in the tragedy. The publication of these articles must have caused a great deal of consternation and annoyance in ruling circles hence the blocking procedure. I delved further into the archive of DeshCalling and read through several law related articles on the recently concluded Sheikh Mujibur Rahman murder case which presented in full the defense of one of the accused. There were also a number of articles written by Barrister Munshi that displayed a negative attitude to Indian foreign policy as applied to Bangladesh as well as other South Asian countries. One may argue that Barrister Munshi should have been more sensitive to the present government's agenda and avoided such controversial subjects and thereby avoided the blocking. But when one reads about death threats against Mahmudur Rahman (Amar Desh), Nurul Kabir (New Age) and Shahidul Alam (DRIK) one gets the impression that something else is going on here. A relative of mine, residing in Bangladesh, sent me a message a few days ago expressing surprise that the newspapers and TV channels were not showing the large and violent protests in Dhaka over pay, loadshedding and extortionate practices of the AL or BCL. It should now be clear to all what this Digital Bangladesh charade is really all about. Its purpose is to control opinion and censor information that could prove embarrassing to the government. Everyone should be aware of this pernicious trend and what it means for the future of Bangladesh. Digital Bangladesh is merely a cover for government oppression and the shutting down of oppositional viewpoints. DeshCalling could be the first of many blockings that will result in the narrowing down of opinion creating a climate of fear and distrust that is essential for the government's own survival.

The Evidence Act [1872 (I of 1872)] and the Criminal Procedure Code [1898 (V of 1898)] application have been excluded by section 23 of the International Crimes (Tribunal) Act, 1973. Therefore, newspaper reports and hearsay evidence will be accepted.
 
2.       International Bar Association (IBA) has found out at least 17 loopholes in International Crimes (Tribunal) Act, 1973. The act does not guarantee any free and fair justice and protection for the convicted ones.
 
3.      Most of the judges and prosecutors are former party men of ruling coalition and hardcore supporters of the current regime, according to various authentic reports.
 
4.      Te tribunal will try 'crime against humanity' rather than 'war crime'. Crimes against humanity described in section 3(2)(a) are very easy to prove through producing false witness-evidences in a domestic perspective and international community may be deceived.  On the other hand, section 3(2)(d) describes 'war crimes' which will be very difficult to prove, as all players including India, Pakistan, Mukti-bahini all will come under the purview of the established (and clear) international standard of law. 'War', 'insurgency', 'civil war' and other related terms will play a huge legal role in case of 'war crime'. It is easy to manipulate a witness for 'crime against humanity' than for 'war crime'.
 
5.      The Ghatok Dalal Nirmul Committee as well as Fact Findings Committee have, according to various sources, already produced 'concocted evidences' through inducement and threat. All these false but professionally prepared evidences will be accepted in this tribunal.
 
6.      Media trial of some people has been completed by constant propaganda. A list of 'war criminals' has already been prepared before any investigation begins. The list ironically includes some people who were even 4-8 years of old in 1971!
 
7.      The tribunal will not try the actual war criminals, the 195 Pakistani army officers who were identified as war criminals but got released after a tri-party agreement between Bangladesh, India, and Pakistan.
 
8.      It will not try the Awami League cadres or freedom fighters, who also committed war crimes, including brutally killing many innocent people particularly Bihari Muslims in 1971.
 
9.      It intends to try only some collaborators targeting an opposition political party who supported a united Pakistan; but belong to neither the cohort of 195 identified war criminals nor of 752 guilty ones identified under the Collaborators Act, 1972.
 
10.  Finally, the current regime itself has a long record of 'crime against humanity' (such as 154 extra-judicial killings in 2009) as well as the manipulation of the legal apparatus and therefore expectation of a fare and free trial is a mere dream from this regime.
 
The government is dictating the tribunal and it literally has power to determine which offence allegation it will take into consideration depending on investigation. The American Muslim Taskforce on Civil Rights and Elections (AMT), a coalition of major national Islamic organizations, hold a news conference today at the National Press Club in Washington, D.C., to call for an end to human rights violations in Bangladesh.
At the news conference, American Muslim leaders called for â€â€� among other things â€â€� an end to extra-judicial arrests and killings, ensuring multiparty democracy, stopping abuse of the police, judiciary and administration to subdue the opposition, restoration of the rule of law, and immediate release of all those who have been unlawfully detained.
AMT is an umbrella organization that includes American Muslim Alliance (AMA), American Muslims for Palestine (AMP), Council on American-Islamic Relations (CAIR), Islamic Circle of North America (ICNA), Muslim Alliance in North America (MANA), MAS-Freedom, Muslim Student Association- National (MSA-N), Muslim Ummah of North America (MUNA), and United Muslims of America (UMA). Its observer organizations include American Muslims for Civic Engagement (AMCE), Islamic Educational Council of Orange County (IECOC), the Islamic Society of North America (ISNA), and Muslim Public Affairs Council (MPAC).
Nihad Awad of  CAIR , Imam Mahdy Bray of  MAS-FF, Dr. Sulayman Nyang of MACC-PAC, Selim Akhtar of AMT, Dr. Abul Kashem of BAIS discussed wide spread human right violations, suppressing opposition and wrongful accusation and persecution of Islamic leaders in the name of so-called â€Å"war crime issues â€Å" was addressed. Deputy Ambassodor of BD in Washington DC was in the audiance, along with some local Awami League leaders.
 
From the news conference AMT forwarded a petition to U.S. Secretary of State, Hillary Rodham Clinton.

Experts Defining Mental Disorders Are Linked to Drug Firms

Every psychiatric expert involved in writing the standard diagnostic criteria for disorders such as depression and schizophrenia has had financial ties to drug companies that sell medications for those illnesses, a new analysis has found.

Of the 170 experts in all who contributed to the manual that defines disorders from personality problems to drug addiction, more than half had such ties, including 100 percent of the experts who served on work groups on mood disorders and psychotic disorders. The analysis did not reveal the extent of their relationships with industry or whether those ties preceded or followed their work on the manual.

"I don't think the public is aware of how egregious the financial ties are in the field of psychiatry," said Lisa Cosgrove, a clinical psychologist at the University of Massachusetts in Boston, who is publishing her analysis today in the peer-reviewed journal Psychotherapy and Psychosomatics.

The analysis comes at a time of growing debate over the rising use of medication as the primary or sole treatment for many psychiatric disorders, a trend driven in part by definitions of mental disorders in the psychiatric manual.

Cosgrove said she began her research after discovering that five of six panel members studying whether certain premenstrual problems are a psychiatric disorder had ties to Eli Lilly & Co., which was seeking to market its drug Prozac to treat those symptoms. The process of defining such disorders is far from scientific, Cosgrove added: "You would be dismayed at how political the process can be."

The American Psychiatric Association, which publishes the guidelines in its bible of disorders, the Diagnostic and Statistical Manual (DSM), said it is planning to require disclosure of the financial ties of experts who write the next edition of the manual -- due around 2011. The manual carries vast influence over the practice of psychiatry in the United States and around the world.

Darrel Regier, director of the association's division of research, said that concerns over disclosure are a relatively recent phenomenon, which may be why the last edition, published in 1994, did not note them. Regier and John Kane, an expert on schizophrenia who worked on the last edition, agreed with the need for transparency but said financial ties with industry should not undermine public confidence in the conclusions of its experts. Kane has been a consultant to drug companies including Abbott Laboratories, Eli Lilly, Janssen and Pfizer Inc.

"It shouldn't be assumed there is a true conflict of interest," said Kane, who said his panel's conclusions were driven only by science. "To me, a conflict of interest implies that someone's judgment is going to be influenced by this relationship, and that is not necessarily the case. . . ."

The DSM defines disorders in terms of constellations of symptoms. While neuroscience and genetics are revealing biological aspects to many disorders, there has been unease that psychiatry is ignoring social, psychological and cultural factors in its pursuit of biological explanations and treatments.

"As a profession, we have allowed the biopsychosocial model to become the bio-bio-bio model," Steven Sharfstein, president of the American Psychiatric Association, said in an essay last year to his colleagues. He later added, "If we are seen as mere pill pushers and employees of the pharmaceutical industry, our credibility as a profession is compromised."

He stressed that the association has strict guidelines to police the role of the pharmaceutical industry but said the profession as a whole needs to do a better job monitoring ethical conflicts.

Sharfstein added yesterday that the presence of experts with ties to companies on the manual's expert panels is understandable, given that many of the top experts in the field are involved in drug research.

"I am not surprised that the key people who participate have these kinds of relationships," he said. "They are the major researchers in the field, and are very much on the cutting edge, and will have some kind of relationship -- but there should be full disclosure."

At least one psychiatrist who worked on the current manual criticized the analysis. Nancy Andreasen of the University of Iowa, who headed the schizophrenia team, called the new analysis "very flawed" because it did not distinguish researchers who had ties to industry while serving on the panel from those who formed such ties afterward.

Two out of five researchers on her team had had substantial ties to industry, she said. Andreasen said she would have to check her tax statements to know whether she received money from companies at the time she worked on the panel, but said, "What I do know is that I do almost nothing with drug companies. . . . My area of research is neuroimaging, not psychopharmacology."

The analysis could not determine the extent or timing of the financial ties because it relied on disclosures in journal publications and other venues that do not mention many details, said Sheldon Krimsky, a science policy specialist at Tufts University who also was an author of the new study. Whether the researchers received money before, during or after their service on the panel did not remove the ethical concern, he said.

Krimsky, the author of the book "Science in the Private Interest," added that although more transparency is welcome, the psychiatric association should staff its panels with disinterested experts.

"When someone is establishing a clinical guideline for the bible of psychiatric diagnosis, I would argue they should have no affiliation with the drug companies in those areas where the companies could benefit from those decisions," he said.
