Subject: An Appeal

November 20, 2009

Right Honourable Stephen Harper

Prime Minister, Government of Canada

Attn: Honourable Jason Kenney, Minister, Citizenship and Immigration

Attn.: Honourable A. M. Yakub Ali, High Commissioner, High Commission for Bangladesh, Canada.

Subject: Deport the convicted self-confessed killer

Right Honourable,

We have come to know from several media reports that one of the fugitives (once self-confessed) person by the name of Lt Col (relieved) Shariful Haque Dalim, a citizen of Bangladesh presently hiding in Canada. In 1975 Mr. Hoque, in cold blood, participated in the brutal killings of Bangabandhu (means 'friend of his people') Sheikh Mujubur Rahman, the then President and founding father of the Republic of Bangladesh including most of his family members, the children and the unborn. Bangabandhu Sheikh Mujibur Rahman was not only a great statesman, a few years ago he was adjudged the greatest Bengali (in both Bangladesh and India) ever born by a survey by BBC Bengali Radio Service.

Trial of this heinous crime started in 1997 and it took two years in open court with full legal help on the part of the convicts and Mr. Hoque was awarded death sentence, along with a dozen of his co-accomplices, in absentia since Mr.Hoque was absconding. The case automatically went to the High court for review and the lower court verdict was upheld. The appellate division of the Supreme Court has heard the appeal and upheld the verdict. If Mr. Hoque is sent to Bangladesh, he will still have the opportunity to appeal to the apex court, The Honourable President's clemency and as such he is not going to gallows automatically. All along, the higher judiciary in Bangladesh has absolutely been independent.  The fact that it has taken 13 years for the trial to be completed testifies to this. It is much more than a matter of law and of a legal process being completed. It must be understood by all that the matter has great moral, ethical and emotional significance for the people of Bangladesh since it is related to the killing of the man who led us in affirming our identity as Bengalees and giving us a renewed sense of dignity and self-esteem.

Canada is country where rule of law reins over the rule of tyranny; it is believed to be a safe haven for those struggling for upholding human rights and the right to life. It must not be transformed into a den for any convicted killer who has taken away the right of his fellow human souls' right to lives, in cold blood.

We feel that there should not be any legal obstacle for Canada, where the fugitive is now living, to deport him to Bangladesh once the Bangladesh apex court has given it's verdict on the case. We are confident that Canada don't subscribe to the rule of law or conforms to the values of civilised society, or to the tenets of universal human rights would allow anyone associated with one of the most gruesome killings of our time, to use it's land as a safe haven by the self-confessed killers of Bangabandhu and his family.

As a proud Canadian citizen, I fervently appeal to the Government of Canada to deport Mr. Hoque outright, re-emphasising again in clear term that the Canadian Society has no room for convicted killer and the cold blooded murderer.

Sincerely,

Gopal Sengupta, Montreal, Canada, gopalsengupta@aol.com
