High court made verdict: Burqa can't be forced.

Judges of higher courts are much more Awami leaguers than dedicated followers of Awami League.
 
Read the fifth and seventh amendments, you can easily understand.

Dhaka, Aug 22 (bdnews24.com)—The High Court has ruled that no women can be forced to wear burqa at work and educational institutions. In it's ruling The High Court on Sunday in a suo moto order directed the government to ensure that no women were forced to wear veil or religious dress in the educational institutions and offices.

The court also ordered the government to ensure that the cultural activities and sports in the educational institutions are not restricted.The orders came in the wake of a public interest petition filed by Supreme Court lawyers Mahbub Shafi and A K M Hafizul Alam on Sunday. The bench of justices A H M Shamsuddin Chowdhury and Sheikh Mohammad Zakir Hossain also ruled that they cannot be barred from taking to culture and sports

The court also ordered relevant officials to explain why forcing girls to wear burqa (veil) and keeping them out of sports and cultural activities were illegal.

The A Bengali daily news item said that principal of the college in Natore ( Northern Bangladesh ) has stopped any cultural activities and sports at the college and forced female students to wear Borka or veil in the college.The HC also directed principal of the college Mozammel Haque to appear before the HC bench on August 26 to explain the matter.

It also issued a rule upon the government to explain why imposition of restriction on cultural activities and sports in the educational institutions and offices and forcing the female students to wear veil should not be declared illegal.

Secretaries to the ministries of home, education, social welfare and women affair and principal Mozammel Haque has been made respondent to the rule and orderThe education, home, social welfare, and women and children affairs secretaries and principal of Rani Bhabani Mohila College Mozammel Huq were asked to reply to ruling. Following a brief hearing, the court also asked the principal to appear before it on Aug 26.

The lawyers in their petition on Sunday cited a report carried by a Bengali newspaper the same day headlined, 'Burqa mandatory at Rani Bhabani Mohila College'. The lawyers stated such enforcement was discriminatory.

Quality knowledge educated in education, specifically understand knowledge in any subject matter perfect & efficient in thinking & working members for parliament are needed to understand  people are not for constitution but constitution is for people, to learn for analyzeing &   realizeing  Bangladesh situation & for understanding the opinions of Bangladesh people as people's representative of Bangladesh & to learn for making required rules of guide, required policy of works, required service codes & service rules to include as law in constitution  

a)      for government to rule country according to the rules of guides & policy of constitution

b)      for service holders to  serve  according to  service codes  & service rules  of constitution

c)       for the judicial courts to do trials according to the service rules, service codes  & to follow the rules of constitution  and

Dhaka, Aug 26 (bdnews24.com)—Even though autocrat H M Ershad had committed crime by suspending the constitution, military strongman Ziaur Rahman's crime was far greater in magnitude, the High Court has observed.

The court in its verdict issued on Thursday said Zia had not only suspended the constitution but he also brought basic changes to its cardinal principles.

The High Court made the observation while comparing the two military regimes in the verdict, declaring the Seventh Amendment illegal on Thursday.

The bench of justices A H M Shamsuddin Chowdhury and Sheikh Mohammad Zakir Hossain in the ruling declared Ershad's military regime illegal.

The Seventh Amendment to the constitution was passed in the parliament formed in 1986 which legitamised the takeover of power by Ershad along with the martial law orders made between 1982 and 1986.

Earlier on Aug 29, 2005, the High Court issued a verdict that had declared the Fifth Amendment illegal. It also had declared illegal the regimes of Khondker Moshtaq Ahmed, Abu Sa'adat Mohammad Sayem and Zia between Aug 15, 1975 and 1979.

Regarding Zia, the verdict stated he had appointed a pro-Pakistan person (Shah Azizur Rahman) prime minister and rehabilitated a number of persons of the same belief and the killers of Sheikh Mujibur Rahman and made grounds for religion-based politics.

The court stated Ershad also illegally ruled the country just like Khondker Moshtaq Ahmed, Abu Sa'adat Mohammad Sayem and Ziaur Rahman and so, none of them can be pardoned. Ershad cannot get away from the consequences for what he had done.

The verdict also said, Ershad took over the power from justice Abdus Sattar, the successor to Zia, and suspended the constitution. Mostaq and Zia, however, went on to change the constitution.

The court also said some renegade army officers killed Sheikh Mujib on Aug 15, 1975 with support from foreign powers. Moshtaq came to power even though he was not speaker or vice president and Zia took over from him.

Zia had blocked the way to try the killers of Mujib by issuing the Indemnity Act. He removed the basic principles of the constitution which were included in light of the liberation war perspective, said the verdict.

It also said, Zia, using martial law, had illegally penalised a number of freedom fighters including Col Abu Taher in military courts and tribunals.

On Apr 5, the High Court asked the government to explain why the Seventh Amendment which legalised the takeover of power by Ershad along with the martial law instructions made between 1982 and 1986 was not illegal.

The ruling came in response to a petition filed by Siddique Ahmed, a resident of Chittagong, who was convicted of murder during Ershad's martial law period.

It, however, spared those decisions that were taken in public interest but declared the Fifth Amendment illegal.

Additionally, the court had commented in that verdict, all the changes in the administration from Aug 15, 1975 till the parliament elections on 1991 were not made according to the constitution.

The BNP-led coalition government had appealed for a stay order on the verdict. However, the ruling Awami League-led government withdrew the appeal.

On Feb 2, the Appellate Division dismissed an appeal challenging the High Court verdict.

Dhaka, Aug 27 (bdnews24.com)—The Jatiya Samajtantrik Dal (JSD) has declared a country-wide programme on Aug 31, demanding resolution of the mystery surrounding the killing of Col Abu Taher.

A press release issued by JSD on Thursday stated the policymakers of the party had decided to observe the day as 'Demand Day' throughout the country.

JSD general secretary Sharif Nurul Ambia, in the statement, urged all leader and activists to make the programme successful.

On Aug 23, the High Court ordered submission of all documents relating to the 1976 military trial of Col Abu Taher, a freedom fighter and sector commander during the 1971 Liberation War.

The bench of justices A H M Shamsuddin Chowdhury and Sheikh Mohammad Zakir Hossain gave the orders in response to a petition by Taher's brother and former general secretary of Dhaka University teachers' association, M Anwar Hossain, Taher's wife Lutfa Taher, and Fatema Yusuf, wife of flight sergeant Abu Yusuf Khan, who was sentenced to life imprisonment by a military court.

At the same time, the court had asked the government to show reasons for not dubbing 'unconstitutional' the military law directive issued to allow the secretive military trial, the trial itself, and execution of the death sentence.

Seventeen military personnel, including Col Taher, were sentenced in a secret military trial on July 17, 1976. After the sentencing, he was hanged on the dawn of July 21.

Taher commanded Sector 11 in the nation's war of independence from Pakistan, was wounded in the battle and lost a leg. He later founded JSD.

Dhaka, Aug 26 (bdnews24.com) — The High Court has extended by 40 days the parole of Arafat Rahman Coco, the younger son of opposition BNP chief Khaleda Zia.

The court also warned that his parole would be cancelled if he did not report to the Bangladesh High Commission in Thailand every three days.

The bench of justices Md Abdul Wahhab Miah and Kazi Reza-ul-Huq also ordered the government to explain why the order that repealed the parole was not illegal.

Coco has been in Bangkok by having his parole periodically extended since he left home on July 19, 2008, just two days after he secured his first parole for eight weeks for medical treatment abroad.

The latest extension expired on last Aug 14, and another appeal for extension of his parole was filed with the home ministry on Aug 21.

On Aug 19, the home ministry, however, decided not to allow any more extension of his parole and asked him to come back home by Aug 31 against which BNP and its different wings had been in protests.

On Aug 22, the BNP announced protests on Aug 24 and 26 against the government decision for cancellation of Coco's parole.

Violation of conditions and the opposition's threat to forge movement to bring BNP Chairperson Khaleda Zia's sons Arafat Rahman Koko and Tarique Rahman back to the country apparently led to Koko's parole cancellation.

As per the parole conditions, Koko was supposed to inform his whereabouts to the Bangladesh Embassy in Bangkok every three days but he did not do so, said a top home ministry official yesterday asking not to be identified.

Moreover, he applied for further extension of parole a couple of weeks ago and attached a medical certificate to substantiate the cause. But the medical certificate was issued on November 17, 2009, which is very old and unacceptable to the government, the official added.

These are the main reasons why the government cancelled the parole on August 14 and asked Koko to surrender before a court by August 31.

The home ministry official said the Bangladesh Embassy in Bangkok officially informed them that they have no information regarding Koko's whereabouts since late 2009.

"The government cancelled the parole as per rules and no violation of law has been occurred in this regard," the official added.

Meanwhile, Koko's lawyer in a letter yesterday requested the home ministry to extend the parole considering his client's health and assured that he will inform his whereabouts to the embassy in Bangkok every three days.

Home Secretary Abdus Sobhan Sikder said he did not receive the letter as Saturday was a holiday. "The government upon receiving the application will decide about the parole," he said.

Koko, released on two months' parole on July 17, 2008 on medical grounds, was undergoing treatment at a Bangkok hospital.

Sources in the ruling Awami League say the parole was cancelled "to give BNP a lesson" as the main opposition was preparing grounds to bring back Koko and Tarique through movements which would make them "heroes".

"Now they say they will bring him [Koko] home to face the corruption charges against him," a senior AL leader told The Daily Star last night.

"The leader of the opposition will have to choose whether she wants treatment of her sons or movements to bring them back," he added.

Another leader said the parole was cancelled as BNP Chairperson Khaleda Zia has been "showing heavy sympathy" to the alleged war criminals and is "trying to save" Jamaat leaders held in this connection.

So the decision has been taken to put pressure on Khaleda, added the leader preferring not to be named.

Mahbubul Alam Hanif, special assistant to Prime Minister Sheikh Hasina, told The Daily Star the government cannot allow Koko to lead a luxurious life abroad on "smuggled" money after the violation of parole conditions.

"Koko is accused in a corruption case and must be brought back to country to face trial," said Hanif, also a joint general secretary of ruling Awami League. Actions would be taken against Koko as per the law, he added.

Koko's counsel Mahbubuddin Khokon submitted the letter to the home ministry urging the government to re-extend the parole.

Meanwhile, BNP Senior Joint Secretary General Mirza Fakhrul Islam Alamgir yesterday demanded unconditional release of Koko.

Party insiders say a writ petition might be filed with the High Court if the government does not extend the parole. But the decision will be finalised in consultation with Khaleda Zia, they add.

Sources say BNP chairperson's personal aide Shamsur Rahman Shimul Biswas went to the home ministry yesterday and submitted an application signed by Koko's counsel Khokon to the private secretary of the home secretary.

The private secretary accepted the application but did not agree to give a copy signed received, said BNP leaders.

Khokon, also a joint secretary general of BNP, told The Daily Star a copy of the application was also sent to the home secretary through fax.

He added a medical report on Koko has recently been submitted to the authorities concerned which was signed on August 7 and 8.

"Koko is seriously sick. He even could not walk without others' support. He has to have 47 injections a day. Considering this situation we requested the ministry to extend his parole," he said.

Addressing a discussion organised by Shikkhok Karmachari Oikya Jote at Jatiya Press Club, Mirza Fakhrul Islam Alamgir termed the parole cancellation a politically motivated decision.

Koko, the youngest son of the BNP chairperson, faces a number of corruption charges and was arrested during the previous caretaker rule.

He was later released on parole and left for Bangkok on July 19, 2008 for better treatment as he was suffering from respiratory problems.

His elder brother Tarique, who was also arrested on charge of corruption during the caretaker rule and later released on bail, is now receiving treatment in London.

Jatiyatabadi Chhatra Dal, BNP's associated student body, will stage a countrywide demonstration today protesting against the government decision to cancel the parole.

    Zia did more harm than Ershad: HC
     
    Dhaka, Aug 26 (bdnews24.com)—Even though autocrat H M Ershad had committed crime by suspending the constitution, military strongman Ziaur Rahman's crime was far greater in magnitude, the High Court has observed.

    The court in its verdict issued on Thursday said Zia had not only suspended the constitution but he also brought basic changes to its cardinal principles.

    The High Court made the observation while comparing the two military regimes in the verdict, declaring the Seventh Amendment illegal on Thursday.

    The bench of justices A H M Shamsuddin Chowdhury and Sheikh Mohammad Zakir Hossain in the ruling declared Ershad's military regime illegal.

    The Seventh Amendment to the constitution was passed in the parliament formed in 1986 which legitamised the takeover of power by Ershad along with the martial law orders made between 1982 and 1986.

    Earlier on Aug 29, 2005, the High Court issued a verdict that had declared the Fifth Amendment illegal. It also had declared illegal the regimes of Khondker Moshtaq Ahmed, Abu Sa'adat Mohammad Sayem and Zia between Aug 15, 1975 and 1979.

    Regarding Zia, the verdict stated he had appointed a pro-Pakistan person (Shah Azizur Rahman) prime minister and rehabilitated a number of persons of the same belief and the killers of Sheikh Mujibur Rahman and made grounds for religion-based politics.

    The court stated Ershad also illegally ruled the country just like Khondker Moshtaq Ahmed, Abu Sa'adat Mohammad Sayem and Ziaur Rahman and so, none of them can be pardoned. Ershad cannot get away from the consequences for what he had done.

    The verdict also said, Ershad took over the power from justice Abdus Sattar, the successor to Zia, and suspended the constitution. Mostaq and Zia, however, went on to change the constitution.

    The court also said some renegade army officers killed Sheikh Mujib on Aug 15, 1975 with support from foreign powers. Moshtaq came to power even though he was not speaker or vice president and Zia took over from him.

    Zia had blocked the way to try the killers of Mujib by issuing the Indemnity Act. He removed the basic principles of the constitution which were included in light of the liberation war perspective, said the verdict.

    It also said, Zia, using martial law, had illegally penalised a number of freedom fighters including Col Abu Taher in military courts and tribunals.

    On Apr 5, the High Court asked the government to explain why the Seventh Amendment which legalised the takeover of power by Ershad along with the martial law instructions made between 1982 and 1986 was not illegal.

    The ruling came in response to a petition filed by Siddique Ahmed, a resident of Chittagong, who was convicted of murder during Ershad's martial law period.

    It, however, spared those decisions that were taken in public interest but declared the Fifth Amendment illegal.

    Additionally, the court had commented in that verdict, all the changes in the administration from Aug 15, 1975 till the parliament elections on 1991 were not made according to the constitution.

    The BNP-led coalition government had appealed for a stay order on the verdict. However, the ruling Awami League-led government withdrew the appeal.

    On Feb 2, the Appellate Division dismissed an appeal challenging the High Court verdict.
