It is not the question who is senior or junior.Question is that who is efficient among the 2. Judges.

It can be reminded that at present there is no any political party government in the country or it also can be reminded that at present there is no any manded or elected political party in Bangladesh to ask or to see lawfully whether present CTG under the country's only elected authorised person who is now the president of Bangladesh to appoint the CJ whether done wrong or right..\

So lawfully it can be said  that this CTG has done for appointing CJ correctly its duty which CTG thinks correct on the point of Neutral & Fair corner Not following Theory of Seniority vs Juniority..  This Care Taker Government is Not the Ordinary Government  It has the Caring Capacity for creating any thing which CTG thinks justified  for conducting fair & neutral MP election.

 

Politicians should go to the people for asking their vote to get the mandate to rule the country. Only this is the wise work for the politicians if they believe in democracy.

Chief Justice

Sir,
President Iajuddin Ahmed yesterday appointed M M Ruhul Amin as the next Chief Justice (CJ), superseding Justice Mohammad Fazlul Karim, the most senior member of the Appellate Division of the Supreme Court after the incumbent CJ. We thought this would not happen again, especially with a neutral caretaker government. The nation is always against the superseding of judges.

[chottala.com] The High Court's advice for seeking justice to the Almighty Allah

We are very disappointed to learn that The High Court's advice for seeking justice to the Almighty Allah as the Appellate Division barred the High Court from hearing any bail petitions under the Emergency Powers Rules and was yet to deliver the full verdicts detailing the grounds for such a stand of the highest court. Seeking bail in a graft case, the High Court bench of Justice Nozrul Islam Chowdhury and Justice Ataur Rahman Khan on Monday advised petitioner's counsel to seek justice to the almighty Allah saying that the hands of the judges were tied and they  cannot go by the oath they took under the constitution. It is well observed by the nation that the High Court bench uttered the words with deep shock and the lawyers at the highest judiciary had nothing to do but to lament, seeking bail to the Almighty Allah.
 
The Supreme Court's recent judgements that imposed a complete bar on seeking bail, even in the High Court, in the cases under the Emergency Powers Rules. Then how a Dhaka court Wednesday granted former army chief Gen (retd) Mustafizur Rahman bail till June 2 in MIG-29 warplane purchase graft case?If the Supreme Court fails to take the route of conciliation rather than confrontation, it will be leading the nation to nowhere as envisaged by the judges. If the apex court fails to do so, then the long expected independent judicial system to tied hands of judges could be transformed into a roadmap to wilderness.

On listen the BBC news & reading the news papers it seems that the time is advancing forward for this CTG to prove whether CTG is lawfully efficient to do its all lawful reformation works to conduct lawful Fair & Neutral Election or to sounder to the unlawful demands of the musclemen politicians.

The dialogue talking of CTG with the politicians has given the chances to know the character of the politicians. According to the demands of the politicians to the CTG as the dialogue talking agendas it seems that they are not interested to do lawful politics to follow the lawful system of democracy & to show respect on the procedures of judicial trials.

It means that they are self declared people representative politicians all people are under their choice & command. 

The politicians are not under the system of lawful democracy not under the system of lawful administration not under the procedures of lawful judicial verdicts & not under the control of constitutional law.

They are only under their supreme leader their leader either good or bad is not the question they can do any thing & can say any kind of word for their leader if needs they can break they can burn they can destroy any property of the people even if need they can destroy the country & can destroy its economy 

They are so Royal to their leader & leadership that the country may go into hell the people may throw into the economic disaster people may be jobless food less everything less that is not problem but their leader & leadership must keep uphold must hold above the problems of the people above all beyond the rules of law above the country's sovereignty.

Does have Idea this CTG to face this unlawful political disaster in the country????

The current interim government is implementing a lot of reforms, taking many decisions that was unimaginable for a long time and we are hoping these changes will pay divident for the nation in coming days. But there is a IF. Government is also aware of the IF. The IF concerns the stability of the system in the new state. Any social or political changes needs time to make the adjustment for a changed policy. However, the changes that are being implemented in the last two years, these are proving too much for our politicians and traditional elites of the society. So the concern of IF points to the concern that weather it will reverse.
 
Off course, if things reverses, it will have a degenerative effect on the social progress - as opposed to the regenerative effect that many of us are expecting. The concern becomes more serious when one thinks of the implication of that effect on our lives of corrupt politicians. Certainly, that would pave the way for many of jailed or absconding politicians a promise of good old days which is dangerous for the society. Before going into the detail of our topic today, lets take a look at the scorecard of current government.
 
Someone in another forum listed the scorecard of this government as follows:
 
Some of their successes:
#1. National ID
#2. Voter List
#3. Chittagong Port
#4. Separation of Judiciary
#5. Development of Dudok, EC, PSC
#6. Arresting Godfather & Godmothers
 
 
Some of their failures:
#1. Failure to control commodity price
#2. Failure to clean corruption from own organs like police
#3. Failure to give comfort to the honest businessman
#4. Failure to estabilish strong allegation against the Godfather and Godmother held behind the bar.
#5. No control over power sector and trasnport sector
#6. Failure to focus on reduce the widespread "vejal" in consumers goods (we add this)
#7. Failure to making the mess in private universities at a manageable level (we add this)
#8. Failure to introduce a merit and performance based promotion criteria in public service including the co-opting senior buerucrats from the private, semi-government sectors by introducing a separate selection body for policy making level (we add this)
#9. Failure to declare the elected posts competitive with other jobs with similar stress by declaring them as professional posts (we add this)
#10. Failure to act decisively to capture and punish the alleged war criminals by holding tribunals (we add this)
 
The #1 and #10 failure are a result of many factors including deficiencies in timely actions of the government and its perceived risk-averse nature, inexperience and lack of understanding of politics, among many others. However, all other failures can be traced to or generalised as one single failure. That is the government's explicit or implicit decision to leave the major part of the buerucracy out of scope. In other words, the top bosses at the secrertiats are holding on those reform proposal by using a number of tactics. Any lay person can imagine that the favourite tactic of these culprits will be delay things as long as possible - long enough to expire the tenure of the government. And their counterparts in the political parties are making sure that govermnet has a solid expiry date and they have done it very well from the very beginning. Why? A number of factors have led to this situation. The government of Dr. Fakhruddin Ahmed is also aware of this. But what they are doing about it? Or are they doing anything?
 
To our judgmement, this is one of most important policy decision that this government is facing. How to balance the need of doing enough vs. doing too much?
 
So far, it seems the government has made a policy decision about not touching the buerucracy (or touch minimally). They are hoping that this policy would help the system to maintain stability over the near term. 50 ministers needs 50 secretaries - isn't it? They are ready to catch all the 50 ministers, but not all the 50 secretaries. Why? Also, since they do not want to touch the 50 secretaries, they will not be able to convincingly prove any of the cases against the ministers. And that is the real problem as far as long term stability is concerned. CTG is actually hurting the stability - if they decided not to touch bureacracy for the sake of stability! A dillema - isn't it?
 
This policy - if it were taken conciously - has also weakened the overall stability. How - would you ask? Let us clarify.
 
The degeneration - if that happens - would start with the relatively weak cases being pursued against the political leaders. Some of these cases are so weak that it might give a perception that the cases are politically motivated - as opposed to the criminal cases as they are being projected now.
 
How did that happen?
 
Since government did not engage the corrupt members of the buerucracy to the full extant, there was not much option but file weak cases. A minister does a corruption with the help of a secretary OR the prime minister did a corruption with the help of a cabinet secretary. Now if those secretaries are still part of the government, how could a strong case be made against the politicians.
 
We are not sure the merit of this compromise in the context of national interest. Its true the burecracy is important for continuity of the policy changes, but that should not come at the cost of 'wrong perception' of politically motivated cases. If you give 13 years to a minister for corruption in a certain ministry, that should implicate the secretary of the same ministry for at least 7 years - general people would expect that.
 
This is a balancing act that government has to re-assess again. No policy decision should be static - all should be addressed dynamically. The only thing that should stay as static is the long term good governance of the country, national interest and goodwill of the general people of Bangladesh. Anything - that increases the possibility of long term good governance of the country, it should not left un-addressed.
 
So, is there anything specific that we are proposing for the government to do, as we usually do in our articles? Yes, we want to propose something. But unlike many of the articles, this particular proposal isn't for the government, per se. It is for the ACC. We hope when the ACC government returns from the much needed personal time-off for him, he would focus on to do some stretching - show some teeth. ACC should unearth some new cases or evidences that creates chasm for the government. Embarrass the government - lets see how it deals with that. We hope Mr. Chairman will do justice to his reputation. We all have two opposing side in our character. In this context, it can be safely said that Mr. Chairman wasn't selected to the Army Chief position during his service to the nation for the reputation of being straight-forward, to the point and honest. To the political government, it was his natural tendency to oblige seniors to the fullest extant which made you an attractive choice. Now is the time to prove this perception wrong. Show some evidence of your reputation that exists among general people and general soldiers. The position that you accepted as ACC chairman does not have any use of your qualities of following order. This position needs your other qualities which is being straight forward, being to the point and being honest. Now is the time - the nation will be watching!

After more than seven and a half months of imprisonment, Khaleda Zia has still not been produced in the court  on the scheduled date.
   In 2007, the judiciary was separated from the executive. But if the current and future governments continue to fail to produce accused persons before the judge, it would be difficult to apprehend how many years it would take for us to get a good judicial environment.

KATHMANDU (Reuters) - Not long ago he was revered as a Hindu god, waited upon by thousands of royal palace retainers. His face crowned banknotes and the national anthem hailed him.

Now Nepal's King Gyanendra is vilified, set to lose his crown and even pay his own tax and electricity bills.

A special assembly will convene on Wednesday with the abolition of Nepal's monarchy top of its agenda, bringing to an end the 239-year-old Shah dynasty and leaving Gyanendra to go down in history as the last king of Nepal.

The 60-year-old businessman-turned-monarch has only himself to blame, many Nepalis say, after an ill-judged power grab in 2005 when he dismissed the government, jailed politicians and declared a state of emergency.

Gyanendra was apparently fed up with Nepal's corrupt and squabbling politicians and decided only he could rescue the country from a deadly Maoist insurgency.

The attempt backfired, and he was forced to back down the following year after weeks of street protests that ultimately sealed his and the monarchy's fate.

"He believed that he had the best intention," said Kunda Dixit, editor of the Nepali Times weekly. "But it was his autocratic streak that did him in."

As a three-year-old boy Gyanendra was thrust on the throne in 1950 when his grandfather briefly fled to India, in the midst of a power struggle with the country's hereditary prime ministers, the Ranas.

When King Tribhuvan returned a few months later, Gyanendra retreated once more into the background, building a fortune in tea, tobacco and hotels and getting involved in environmental conservation.

Then, nearly seven years ago, his popular brother King Birendra and eight other members of the royal family were shot and killed by the crown prince, who then turned his gun on himself.

Gyanendra was back on the throne, and like many of his predecessors, he was brought up to believe he knew better than his subjects what was best for Nepal.

The massacre had broken the mystique of a monarchy once revered as incarnations of the Hindu god Vishnu, while Gyanendra's seizure of power unleashed the wrath of the people.

"I think he is getting what he deserved," said 48-year-old labourer Suntali Khatri, breast-feeding her two-year-old daughter next to a building site. "He could not ask for more."

Maoist rebels, whose main demand had been the abolition of the "feudal monarchy", have gone on to become Nepal's largest party after a 2006 peace deal and elections in April.

They say Gyanendra can stay in the country as a commoner and businessman, provided he respects the assembly's decision.

The king himself has been reported as saying he had no intention of leaving Nepal.

Instead he is likely to drive from the pink pagoda-roofed Narayanhity Palace to his own, luxurious and well-guarded private residence in Kathmandu.

OVER-AMBITIOUS?

Gyanendra went to school in Darjeeling, a hill station in eastern India, and graduated from Tribhuvan University in Kathmandu.

Mohan Prasad Lohani, who taught him English in university, said he was an irregular student -- more interested in politics than studies. "He had his own notion of how things should change. He was very ambitious," he said.

That ambition could have been his downfall, analysts say. And it has been a dramatic fall from grace.

In the last two years, the government has seized thousands of acres of royal lands, nationalised more than a dozen of his palaces and sacked his priest in a purge of palace employees.

Virtually confined to his palace, the king has had his annual allowance cut, been hit with tax demands and requests for unpaid electricity bills. He has seen his face replaced by an image of Mount Everest on the country's banknotes and praise of him purged from the national anthem.

Yet royalists who have met him say he has taken it all calmly.

They argue that a hasty abolition of the monarchy could backfire and leave the country without the anchor that it needs in times of change. But royalist parties won just four seats in the 601-member assembly.

While many Nepalis like the idea of a constitutional monarchy, few like the idea of being ruled by Gyanendra or his unpopular son Paras, who has a reputation as a playboy and a reckless driver.

"I think this is the end of the road for the monarchy," Dixit said. "Most Nepalis think it just not worth the trouble to keep any more."

[chottala.com] AABEA was little disappointed from the attitude of BAAI & BCCDI when I requested them to anounce abo

 
I was little disappointed on Bangladesh Center of Community Development (BCCDI) and Bangladesh Association of America (BAAI) for the facts I am explaining in the following paragraph.  Please do not assume that I am complaining against anybody personally.  I am just expressing my regret, grief, & distress on behalf of American Association of Bangladeshi Engineers & Architects (AABEA), Washington DC Chapter.
 
AABEA arranged Annual family & friends night on May 17, 2008.  Over expected crowd of guests were attended in this program.  Many guests representing BAAI and BCCDI (Bangla School) were also presented there and we were very happy to have them as our honorable guests.  They (BBAI & BCCDI officials) did not request us to announce their future programs on the stage.  We (AABEA) took our own initiative and announced the future programs of BAAI & BCCDI on the stage.  In fact, we included the announcements of their future programs in our program slots and we informed the MC (master of ceremonies) well ahead of time to announce their future programs.  In another words, we added the announcement times for BAAI & BCCDI in our program time length and we announced their programs clearly in detail on the stage on May 17 program.  We did these, because AABEA respects all other community organizations and AABEA also expects that the activities of other community organizations will become successful.  We announced the programs of BCCDI & BAAI during our past programs also, without any prior request from BCCDI & BAAI.
 
However, we (AABEA) tried to announce about our Science Fair & Picnic program at Upohaar program held by BCCDI (Bangla School) and at Nazrul Shommelon held by BAAI on May 25.  We were not able to do it.  I personally went on the back stage and requested the programs organizers (who were standing on the backstage and coordinating the program sequence) as well as MC (master of ceremonies) to announce our programs.  But, the attitude & behavior I received from the backstage were like I was an unwanted person and they would be very happy if I get out from the back stage area.  They tried to give me the impression that they did not have extra time available to announce our program on the stage and they were not previously notified & authorized to announce our program on the stage.  They showed the impression to me in such a way that they do not have a single second to listen to me or talk to me.  The MC (master of ceremonies) was a little rude & unmannered to me when I requested it.
 
We (AABEA) did not expect such dealings & attitude from BAAI & BCCDI.  I can guarantee that we behaved very smiling, courteous, & friendly way at our programs, when anybody asked me or us about anything on the backstage, lobby, auditorium hall, or at any other place.  I did not show anybody that I am very busy and I do not time to talk to you.  My question is that, if AABEA, by their own, announces the programs of other organizations, why can't other organizations return the same thing to AABEA?  If AABEA supports, helps, & cooperates other organizations, why can't other organizations think about the same approach?  An announcement of a program normally takes no more than 15 seconds.  Does that 15 seconds extra time make a big deal to them?  I think, each & every organizations here should help each other & should have feeling of each other, instead of thinking who cares of other organizations.
 
If an organization does not announce our programs on their stage, it is perfectly OK for us.  Announcing or not-announcing does not have any impact on the number of our audience.  We do not depend on the announcement on the stage anyway.  That's not the main point.  That's not the main point.  My main point is that, if AABEA shows full respect, honor, & love for other organizations, why can't other do the same at least a little bit.  Anyway, AABEA will not take ay revenge or action on these small things.  It does not matter how much respect, cooperation, & help AABEA receives from other organizations, AABEA will continue to help, cooperate, & respect other organizations and it will still continue announcing the future programs of other organizations very proudly.  Finally I like to say again that, AABEA has no complain against all personnel of the board of executive committee of BAAI & BCCDI.  In general, they are very good, well mannered, & hard working people.  Just few of their volunteers make simple things miserable.  My request to board of directors is that, please put the concept in the brains of your volunteers that they should be very courteous, friendly, smiling, & well mannered to those people who also show respect & honor to them.

AL decides to skip dialogue without Hasina

Dhaka, May 27 (bdnews24.com) – The Awami League on Tuesday decided not to join government dialogue without party chief Sheikh Hasina, a move likely to put a question mark on ongoing political talks.

The decision on boycott came from a meeting of the Awami League Central Working Committee at the party's Dhanmondi office.

The ALCWC meeting has been adjourned until Wednesday, acting AL president Zillur Rahman told reporters.

A major announcement about a movement for the release of the former prime minister, now behind bars on charges of corruption, is expected to come from Wednesday's meeting.

The ALCWC meeting also endorsed most recommendations made by district AL leaders at the party's crucial extended meeting on Monday.

"The meeting has approved the speeches of the district leaders, showing honour to them. The district leaders said there would be no dialogue and no election without Sheikh Hasina," Zillur said.

"We have also decided that we will not go to dialogue without Sheikh Hasina. If we go to dialogue we will do so under her leadership. And it is Sheikh Hasina who will name those who will participate in it," he said.

The ALCWC meeting will resume at 11am Wednesday.

Military Generals responsible for flouting election schedule, breach of constitution

In the recent twist of political development, the higher court ruled on the holding of parliament election and has received double thumbs-up by pro-democracy activists. The court has categorically blamed the interim government and the election commission for breach of certain clauses of state constitution.

This was indeed yet another major setback for the four-star military Generals who have purportedly installed an interim government, which tantamount to violation of the principles of non-interference in state polity. Well the verdict was an insult to injuries already inflicted by international communities. Will star-studded Generals give any heed to the verdict?

The over-zealous military general's in a conspiracy game aborted the scheduled elections to the ninth parliament in two weeks time when they grabbed power in mid-January last year. They kicked the caretaker government legitimately formed; banned freedom of assembly, fundamental rights by imposing emergency rules and of course throttled press freedom by blanket censorship, which still exists in another form.

The Generals, the de facto ruler of the state affairs did not hesitate to claim that they sponsor the interim government. The Chief of Army Lt. General Moeen Uddin Ahmed explained that the nation needed to be cleansed of evils of institutional corruption, criminalisation of politics, money laundering and organised crime, until then restoration of democracy would yield futile.

After more than a year effort to zero tolerance of all evils, the international watchdogs especially Belgium based International Crisis Group does not agree with the achievement the military Generals and the interim government claim.

In tragic episode of de facto military governance, those citizens who demanded restoration of democracy and to hold a credible election, the dreaded military security services harassed, intimidated and reprimanded scores and hounded hundreds, which includes among others are members of civil society, university teachers and journalists. Others do not dare to return home in fear of persecution.

Most pro-democracy activists and civil society in Bangladesh and expatriates do not believe that the military generals would be bothered about democratic institutions like the Supreme Court, which upholds the constitution has proven balance of scale of justice.

The High Court on May 22 says the Election Commission has violated the constitution by failing to hold elections in 90 days from the dissolution of parliament in October 2006. This ruling was in response to a public interest litigation filed by barrister Masud Reza Sobhan last January.

In an observation, the court however said the election planned for December in line with the EC roadmap was a "logical decision". It added that the court did not have an alternative to accepting the EC decision on holding polls in December, writes BDNews24.com.

Though chief adviser Dr. Fakhruddin Ahmed, blue-eyed boy of the military is not authorized to announce an election schedule, it blames the Election Commission, which did not comply with its constitutional obligations, thus "it violated the constitution."

According to the constitution, the HC said, national elections must be held within 90 days of the dissolution of parliament (in October 2006). In addition the EC does not have the authority to overrule the constitution, as the commission does not have the power to extend the 90-day time limit set by the constitution.

It is the constitutional obligation of the commission to hold polls, which would enable the caretaker government to transfer power to an elected government. But the commission found other excuse to delay the election on the plea of preparing a non-controversial voters list and voters photo ID for all eligible voters. A gargantuan task indeed!

However the court took into cognisance that as chief adviser addressed the nation early May and announced the national polls would be held in third week of December.

On this matter the court asked the Election Commission to provide specific date by April 30th of holding the parliamentary election.

Following the verdict, the litigant Sobhan has rightly called on the chief election commissioner and other commissioners to resign for their failure as described by the court. The court verdict brings in front a national shame of the performance of the Election Commission and their loyalty has been exposed.

The commission performance has proved that it was not truly independent. The EC was supposed to accountable to the eligible voters according to rule of law, but instead paid more attention to the military installed government.

It seems that the Election Commission in a comment to media is not dithered by the verdict and said that it would not affect the commission's roles and responsibilities to hold the election planned in coming December.

Once again it was proven that the pro-democracy activists were consistent and speaking wisdom. Equally the issues raised by international watchdogs were similar tunes of the civil society, media and the international donor community.

Meanwhile to buy time, the military installed government is holding dialogue with political parties leaders. Those leaders walking to the living room of the Chief Adviser's official residence to hold parleys are demanding similar request made to Election Commission to withdraw emergency rule as a condition to restoration of democracy.
