In response to your following e-mail, I would like to inform you that intents and actions of Jamaat-e-Islami and the likes of them during the 9 months of liberation are well documented. There is no doubt who participated in those killings. Jamaat strongly opposed for an independent Bangladesh. At liberation war of Bangladesh Jamaat not only aided Paksitan army by providing information or pro-independent Bangladeshis but also itself created many militia organization such as Razakar, Al badr, as shams in order to capture and eventually kill freedom fighters.

Jamaat, as an international "Islamist mafia," remains an active proponent of Wahabi terror campaigns around the world financed by Saudi money through Rabita-e-Alam al-Islam [World Muslim League] and networked with groups like WAMY or RSO. Jamaat's war against Bangladesh did not end, literally/practically speaking, in 1971. To date they continue: run jihadist training camps for ICS, RSO and WAMY all over the country, sponsor and engineer sectarian or communal riots/campaigns. Accounts of the occupation force members too bear out how Jamaat-e-Islami Bangladesh and its paramilitary wings styled Razakar, Al Badr, and Al Shams Bahini worked fervently against the country's war of independence.

For reconciliation, Jamat should stop propagating "LIES" about our liberation war. Different political parties may have different opinions on many issues, but there cannot be different versions of our liberation war. First we came to know that Jamat did "nothing" during our liberation war, then question was raised whether it was a genocide or a civil war, and then a direct assault to all martyrs and freedom fighters.

Jamat teaches the young generation that it was an indian invasion and some "miscreants" were helping the indian army and bengalis were actually killed by Indian army. Jamat Leaders propagate lies about the liberation war, do not respect our freedom fighters and martyrs how can they be allowed to do politics? where will they lead our nation to? If we do not cry out now, its not far away that we wil hear its not Mujib or Zia, its Golam Azam who declared our independence.

In 1971, Bengalees were doing procession in the street demanding to give power to Bangabandhu who won the election with overwhelming majority in 1970's election. Biharis always used to think themselves as a separate entity from Bengalees in favor of Pakistan. These Biharis with the instigation of Pakistanis used to throw hand grenade and cocktail in the Bengali procession killing Bengalees. In reparcation Bengalees also started killing Biharis. Again in reparcation Biharis stopped a Nazirhat (Chittagong) bound train near Bihari colony in Nasirabad wireless colony area and the passengers (Bengali) from the train they made them completely out of the train and slaughter them as a whole. Still that area of Wireless colony is cordoned where one can find the skull and bone of those innocent Bengalee victims slaughtered by the Biharis at that time. 

Being a Muslim, how can you resort to lies to prove your point? But this is very normal for the Jamaatis -the followers of Maulana Moududi and Gholam Azam et el. We know that the true Muslim is the one from whose hand and tongue others are safe. According to the dictionary, war crime is a crime, which is vividly a violation of international law and human rights. In a simple definition, war crimes generally stand for killing, genocide, mass rape, firing etc. Whenever we are talking, about the relevance of Jammat-e-Islami with the war crime, then as the evidence of this allegation, we bring the statement of Jammat leaders, which were generally published in 1971 in their party's newspaper, "The Daily Sangram". 

On 10 April 1971, Mujibnagar Government was established and People's Republic of Bangladesh was formally proclaimed. After that day Pakistan 's Army became an Occupation Army in all legal, moral and practical points of view. Throughout 1971, the Jamaat-e-Islami was a collaborator to Pakistan 's Army, a foreign occupation army (according to the Mujibnagar Government). As you know that Razakar, Al-Badar and Al-Shams were paramilitary forces formed at occupation Army's  initiative to assist it and to resist the freedom fighters during the Liberation War in 1971.

Razakar and Al-Shams who were recruited from the Jamaat-e-Islami and Muslim League, that with the Pakistan Army were responsible for conducting a mass killing campaign against innocent Bengali nationalists, civilians, religious and ethnic minorities in the Bangladesh Liberation War. The killing operation was also conducted by Al- Badar, another paramilitary wing of Jamaat-i-Islami and was headed by the then All Pakistan Islami Chhatra Shangha  president Motiur Rahman Nizami. During 1971 rank-and-file Jamaat-i-Islami collaborated with the occupation. It was the leading collaborator of the occupation. Jamaat collaborated with the occupation forces, the perpetrators of murderous genocide of Bangali people and collective rape of innocent Bengali women.

Before declaration of Independence it was no doubt may be called civil war or civil fighting but after the declaration of Independence it was not civil war it was fighting for Independence of Bangladesh. It was real war between two countries Pakistan & Bangladesh. All should remember that India came forward to help Bangladesh freedom fighting force after admitting Bangladesh as a separate country not as part of Pakistan & to the war fighting between two countries Pakistan & Bangladesh.

In addition, during the days of Liberation War, the slogan of the Jamatees was, Islam can not be saved unless Pakistan can be protected in this part of the sub-continent. India will occupy Bangladesh. Signs of Islam and Muslims will not be there in this country. But Jamat could not prevent the independence of Bangladesh in spite of their all whole-hearted effort. Bangladesh has become independent. India has not occupied this country. They are as they had been before. This proves how much dishonest and politically motivated and hypocritical are the slogans of Jamat in the name of Holy Islam.

Jamaat-e-Islami has done terrible disservice to Islam and the Muslim world. Jamat, in the mask of holy Islam, is a real reflection of fascist thoughts and ideas. Its ultimate objective and aim is to ascend to the throne of power through appendage of reactionary power. They should be exposed and brought to justice for their crimes against humanity. Their extremism, intolerance and many activities are direct violation of Islam.

War criminal Jamatis in Bangladesh must be punished. The Jamatees will not hesitate to shed the blood of Bangalis again in the name of Holy Islam as they did in 1971. Those who use religion for the dishonest purposes of attaining the selfish and mean individual, collective and party interests, are actually the enemies of Islam. By the way, criminals are always criminals whether in civil war or non civil war. For establishing humanity & human right all (criminals either in civil war or real war) should come under proper judicial trial.

For instance, Siddiq Salik, who was serving the Pakistan army as a major in Bangladesh in 1971, in his book 'Witness to Surrender' recounts the anti-liberation role of Jamaat, Muslim League and Nizam-i-Islam. Pak army killed us in the name of Islam, Bangla Bhai tortured people in the name of Islam, 17th August bombing was done to establish "Islamic Law" in the country. these are enough to ban religion based politics. "Those fools don't realize that there is no magic pill to eradicate Muslim from Bangladesh". No one is trying to eradicate Islam or Muslim from Bangladesh, "secularist" were in power for some time. Did anyone face any difficulty to practice Islam at that time? Is there any footage or newspaper cutting that show secualrist are asking muslims not to say prayers or not to believe in Allah? JAMAT and ISLAM DO NOT HOLD THE SAME MEANING. INFACT JAMAT SHOULD STOP TALKING ABOUT ISLAM BECAUSE WHEN LIARS AND WAR CRIMINALS TALK ABOUT ISLAM, IT SENDS WRONG MESSAGES TO THE NON-MUSLIMS ABOUT ISLAM. "If one could work to educated people, they will have it their way. Learn it from Islamist " If secularist adopts the "islamist" way to confront the opponent, it will be bitter for "islamist".

To adopt the Islamist way, secularist should hire some people, they will go to the jamati/BNP leaders' house and kill all including women and children. Some BNP/JAMATI leaders then should be put on jail and one night during Fazr prayer, someone should kill them in jail. secularist then can pass a law to protect the killers and if supporters of "islamist" leaders observe mourning day, a popular secularist leader will celebrate his/her birthday on that day. I think its better for "Islamist" that secularists are not as "smart" and "logical" as islamists.

21st century should be the time to open every one's mind and extant horizon. Political Islam is not a Pakistani phenomenon. It is a global renascence of Islam. If one continues to judge everything in terms of '71 may not have the time to look toward future. If one is concerned with Pakistanization of Islam should try to educate people in true Islam. Islam never supports any injustice. Continued talk about Pakistani Islam and relating that to '71 brutality is a very shrewd way of discrediting Islam. People are much smarter for not to understanding that.

If someone kills your father or rapes your sister, time does not heal the pain. And when you see that the accomplices of those killers and rapists are not only free, they have become ministers, someone has put our red and green flag on their cars, pain does not go away, it becomes more intense, just grows bigger and bigger. In Bangladesh, its not difficult to find someone who has lost a relative during 1971 war. Ask him/her whether the pain has been healed?

Bangladesh Information ministry published "Bangladesher shadhinota juddher dolilpotra",edited by Hasan Hafizur Rahman. It has 15 parts. It contains experiences of the victims and witnesses. Golam Azam''s autobiography is a direct evidence of their role in 1971. There is no footage showing that Bangla Bhai or Jainal hajari is beating or killing people. Yes, there are pictures of dead bodies, hanging upside down, we know that Bangla Bhai did that from witnesses, from newspaper reports. The pictures of dead bodies of Intellectuals in Rayerbazar, who killed them? It was Pakistan army and their "accomplices" who could not flee from East Paksitan. There are evidences and witnesses, not only the footages of Nizami and Go-Azam. There are people who WITNESSED THE ATTROCITIES of JAMAT LEADERS (please read in the website: http://www.nybangla.com).

Many thanks for your exposition but the reality is Jamat e Islami did not take part in any war since its inception in 1942, how the following write-up targeting Jamat e Islami ? is that politically motivated allegation?
 
However, we bengali also did genocide crime by killing thousands of Bhiharies just after independence and at the beginning if independence war where I also a member.

The mass killings in Bangladesh in 1971 is the most concentrated act of genocide in the twentieth century. In an attempt to crush forces seeking independence for Bangladesh, the Pakistani military regime unleashed a systematic campaign of mass murder which aimed at killing millions of Bengalis, and likely succeeded in doing so.

Three million people were killed, 200,000 women raped during nine month period of time. Some Bengalis, who called themselves the Razakars, Al Badars & Al Shams, joined hands with the occupying Pakistan Armed Forces in the killing game. Many of them are now leaders in Bangladesh Jamaat-e-islami Party. Recently some of them even denied their involvement in this mass murder.

Our past governments, whom we had elected, ruled for the past 37 years, seem to be unable or unwilling to bring this war criminals to account for their grave misdemeanor. We believe that under Bangladesh 's Criminal Code Act 1973, there is a prima facie case for the prosecution of all war criminal (Ghatok Dalal) for mass murder of civilian populations of Bangladesh , between March, 1971 and December, 1971. ACT NO XIX OF 1973 to provide for the detention, prosecution and punishment of persons for genocide, crimes against humanity, war crimes and other crimes under Bangladesh criminal code.

The International Crimes (Tribunals) Act 1973 (ICA), promulgated on July 20, 1973 empowers the government to try individuals on specific charges of crimes against humanity and peace, genocide, war crimes, violation of the Geneva Convention and international laws, for assistance or conspiracy to commit such crimes, and for failure to prevent commissioning of such crimes.

The present government only needs to set up a tribunal under the act which is still applicable, as the general amnesty granted to war criminals by Bangabandhu Sheikh Mujibur Rahman in 1973 does not apply to individuals against whom there had been specific charges of war crimes. Hopefully we can also have an international tribunal where the Pakistani army officers who were responsible for such carnage will be tried also.

The gazette notification promulgating the ICA on July 20, 1973 says the tribunal set up under the act 'shall have the power to try and punish any person irrespective of his nationality, who, being a member of any armed, defence or auxiliary forces commits or has committed in the territory of Bangladesh, whether before or after the commencement of this act, any of the following crimes."

The act goes on listing the crimes against humanity including rape, torture, abduction, confinement of civilian population, or persecution on political, racial, ethnic or religious grounds, while crimes against peace are defined as planning, preparing, initiating or waging a war in violation of international treaties. The ICA deals with genocide in the most detail, defining it as acts that are committed with intent to 'destroy in whole or in part, a national, ethnic, racial, religious, or political group'.

The crimes that are considered acts of genocide include killing of members of any of the groups, causing serious bodily or mental harm to members of the groups, deliberately inflicting 'conditions of life calculated to bring about a group's physical destruction in whole or in part', imposing measures to prevent procreation within a group, and forcibly transferring children of one group to another.

War crimes are defined by the ICA as violations of internationally recognised war customs, including but not limited to murder and ill-treatment of civilians or prisoners of war, plunder of private property, wanton destruction of cities, towns or villages, and devastation not justified by military necessity.

According to one of the writers of the draft, former ambassador Waliur Rahman, the ICA was initiated by Bangabandhu immediately after his return from internment in Pakistan in January 1972, and was drafted under the direct auspices of two prosecutors from the Nuremberg Trials. Meanwhile, the country is agog with the demands for trial of war criminals, which, during 1971 war of liberation, collaborated with the Pakistan Army. Initially Bangladesh wanted 193 Pakistani Soldiers as War Criminals. But because of Indian pressure, Sheikh Mujib could not do it. Also J. A. Bhutto promised that he would try those was criminals in his country.

Sheikh Mujib promulgated the Special Tribunal Order on January 24, 1972 (PO No 8 of 1972) after 14 days of his return from Pakistani jail to trial those Pakistani collaborators, Razakars, Al-Badrs and other stooges of the Pakistani army. Nearly 800 cases were completed and given jail sentences. Another 11,000 were in jail including Nizami and Abbas Ali Khan of the Jamat-e-Islam Party (JI) ("abuser of holy Islam for political gains"), and their prosecution was at various stages of completion. In addition, those that were involved in 'crime against humanity' and against Bangladesh , were denied Bangladesh nationality and passports. On November 4, 1972 all religion-based politics were abolished as per sections 12 and 38 of the Bangladesh Constitution of 1972.

Unfortunately, when General Ziaur Rahman, a freedom fighter emerged as a 'strong man' in 1975, he abrogated the Collaborators Act and released all the prisoners including those that were sentenced, and those under prosecution. For political and personal reasons he allowed religion-based parties to operate and started reinstating and rehabilitating them. No wonder, those who were guilty of 'crime against humanity' and collaboration with the enemy state ( Pakistan ) started returning from abroad, especially Pakistan and Saudi Arabia , and they were given Bangladesh citizenship and passport. A prime beneficiary of this development is Golam Azam of the Jamaat. However, once General Zia took over, all of them were issued Bangladesh passport or 'travel documents' to return to Bangladesh .

This is a country (Bangladesh) where lies traffic as truth, where the past is rewritten to whitewash the sins of those who opposed our independence, where our very history has been distorted beyond recognition, all without a thought as to the corrupting effect such blatant disregard for truth has on the national character.

If we wonder why things have got to where they are, why corruption, cheating, and petty criminality are so endemic, why in so many areas there seems to be an absence of basic morality, it might be worthwhile to look back at our nation's original sin and locate the problem, or at least its genesis, there.

Can a nation which tolerates lies about its past ever be great?

Can a nation in which war criminals and collaborators can hold their heads up high ever amount to anything? And is it a surprise if such a nation, over the course of time, sinks into a morass of corruption and criminality?

I don't know. But I am unfamiliar with any other instance where those who opposed the birth of a country or those who collaborated with its enemies have been rehabilitated to the point that they are brought into the government. Our case certainly seems shamefully unique.

This is where the corruption of the nation's soul was born. If we focus on corruption and do nothing about the war criminals and collaborators, we are treating only the symptom and not the disease.

Make no mistake about it: this is our original sin, and if we do not cleanse the poison from our bloodstream, once and for all, nothing else we do to clean up the country will have lasting effect, and in the long run our failure will come back to haunt us.
