[chottala.com] Pro-liberation forces' unity can defeat war criminals


The issue of anti-liberation forces has again come to the limelight following Jamaat-e-Islami Secretary General Ali Ahsan Mohammad Mujahid's audacious statement that there is no war criminal in Bangladesh. A few days later, another Jamaat adherent, and former secretary to the government, Shah Abdul Hannan, made a more atrocious remark in a TV talk show, saying that the War of Liberation in 1971 was a mere civil war.

Such utterances by Jamaat leaders about our liberation war are not new. The top party leaders who had directly collaborated with the Pakistani occupation forces in 1971, and masterminded the killing of intellectuals, time and again dared to claim that they had not committed any wrong in 1971.

As in the past, this time also, their utterances triggered a huge turmoil in the minds of countrymen, especially among the war heroes who are still alive. Interestingly, when any movement against anti-liberation forces starts gaining momentum, the name of Awami League is entwined with the issue by a section of people, apparently to allow the issue to fade away.

Not only the people of the collaborators' camp but also those in the opposite camps point their fingers towards AL for not trying the war criminals, and for giving shelter to the anti-liberation forces. Experience tells us that whenever Awami League is put on the same balance with Jamaat, the issue soon disappears.

It's true that Awami League bears the biggest share of the failure to bring the war criminals to book. But, we should not also forget that only the Bangabandhu government had taken steps to try the collaborators. The post-liberation government headed by Bangabandhu Sheikh Mujibur Rahman had enacted Collaborators Act to try the Pakistani collaborators and war criminals.

The act covers those individuals and organisations that helped the Pakistani occupying army in carrying out mass killings, conducting crimes against humanity, torturing people, destroying property, and fighting against the people of Bangladesh.

On November 30, 1973, Bangabandhu declared general amnesty for the people who were arrested on charge of assisting the Pakistani forces. The Collaborators Act, which was published in a gazette notification on the same day, however, says none of the war criminals had been pardoned.

Out of 37,000 prisoners, some 26,000 were freed after the announcement of the general amnesty. Around 11,000 were still in jail when the government of President Justice Sayem and General Ziaur Rahman repealed the Collaborators Act on December 31, 1975. After the scrapping of the act, those behind bars for carrying out war atrocities appealed, and eventually got released.

The Bangabandhu government had also banned religion-based politics in the country through incorporating provisions in this regard in the Constitution. Article 38 of the 1972 Constitution read: "Every citizen shall have the right to form association or union subject to any reasonable restriction imposed by law in the interest of morality or public order: provided that no person shall have the right to form or be a member or otherwise take part in the activities of any communal or other association or union which in the name or on the basis of any religion has for its object, purposes, a political purpose."

During the post-independent Awami League government that lasted for only three and a half years, there was no religion-based political party in the country. It was General Zia who opened the floodgates of doing religion-based politics in the country by repealing Article 38 of the Constitution. He also brought back home some infamous collaborators like former Jamaat Ameer, Gholam Azam, from abroad.

So, the allegation that post-independence Awami League did not do anything to try the war criminals and prohibit sprouting of religion-based politics is not true. It promulgated laws, initiated trials, and sent numerous war criminals behind bars.

Despite the declaration of general amnesty, incarceration of 11,000 alleged war criminals itself is proof that the Bangabandhu government was sincere in trying the perpetrators of heinous crimes against humanity during the liberation war in 1971.

Everybody in the country expects that Awami League should take the onus to try the war criminals and collaborators. They should take the lead role in stamping out religious bigots from the country. But my humble question is: how much support had the countrymen extended to Awami League to implement the agenda?

Rather, Awami League was a lone crusader fighting against bigotry for long. It had to pay a heavy toll for acting against the reactionary forces. The anti-liberation forces, with the help of their cronies at home and abroad, killed Bangabandhu along with his family members and close kith and kin. Not only that; the front-ranking party leaders who steered the liberation war in 1971 and headed the provisional government in exile were also killed in jail.

There are allegations against Awami League that it had forged unity with Jamaat-e-Islami at least twice -- once in 1986 during military ruler Ershad's regime, and again in 95-96 during BNP's rule. The latest agreement of Awami League with some fundamentalist parties prior to the stalled 9th parliamentary elections early this year also drew widespread criticism and condemnation from various quarters.

Such opportunism and compromise of Awami League leaders undoubtedly broke the hearts of many sympathisers. But there might be a thin rationale (perhaps psychological) behind such behaviour.

As Awami League started to regain strength, overcoming the 1975 trauma, it had to face multi-pronged attacks since the late 70s. Thousands of activists of Awami League and its front organisations -- Chhatra League, Jubo League, Sramik League, Krishak League -- have been killed, tortured and maimed during the last three decades at the hands of cadres of Jamaat-Shibir and other ruling parties. No party, other than Awami League, had to sacrifice so much for the country and face so much vengeance for opposing Jamaat-Shibir politics in the country. But, what did it get in exchange? How did the countrymen reward it?

We rewarded Awami League by keeping it out of state power for 27 years out of the 32 years after 1975. Whenever there came a slim chance of Awami League assuming state power, either reactionary forces usurped power or all forces got united to block its triumph.

Under these circumstances, if Awami League acquires some opportunistic characteristics, the blame can't be shifted onto it entirely. In its time of need, we failed to help it. When it sought help, we not only shut our doors but also sometimes stood against its interest.

It's heartening that our war heroes, pro-liberation political parties, and conscious sections of the society have awakened once again and raised their voices against the war criminals and religion-based politics. Our failure to punish the criminals during the last 36 years made them feel that they had become immune. They have become so ferocious that they have now dared to deny the liberation war.

Infiltrating into the core of the society, they have already destroyed its thousand-year-old traditional characteristics. If they are not halted here, our beloved Bangladesh, earned through the blood of millions of men and women, will turn into a country of religious bigots.

So, mudslinging and blame game against each other among the pro-liberation forces will not bring any good for the country. Without the help of Awami League, it's not possible, at least at the present context, to defeat the anti-liberation forces.

Despite some past ideological slips, Awami League is still the main force that can do something against the anti-liberation forces if it gets adequate support from others. Let us work towards that end; unite all the pro-liberation forces under a single umbrella and launch a vigorous campaign against the enemy.

We should not forget that it will not be an easy task to defeat the enemy. During the last three decades, they have gained substantial strength in terms of money and manpower to confront any sort of offensive.

Where is Moeen?

We've been asking this question for a while and have a missing person report on the sidebar to express our concern. But at the same time, we hear his brother, Mr. Minhazuddin Ahmed, is actively working to set up "Jago Bangladesh", another king's party in USA and UK. (we know Mr. Minhazuddin was actively involved in asking his friends in Boston to set up the Boston meeting ).

We know Moeen was not present at the airport when President Iajuddin left for the USA, although other service chiefs were there. We also know that when Iajuddin returned, Moeen was again missing from the airport while the other service chiefs were there. If you are not convinced, here is another meeting he missed. Military Institute of Science and Technology is an engineering university run by the military. It just held it's 9th council meeting that discussed its budget for the upcoming year and set other policy directions. All in all, a pretty important meeting. But we read:

The ninth meeting of the council of Military Institute of Science and Technology (MIST) was held at Mirpur Cantonment in the city Thursday, report agencies.

Education Adviser Ayub Quadri chaired the meeting while Chief of Naval Staff Vice Admiral Sarwar Jahan Nizam, Chief of Air Staff Air Marshal SM Ziaur Rahman and Lt Gen Jahangir Alam Chowdhury representing the Army Chief were present, among others, in the meeting.
Lt. Gen. Masud was in Hawaii, where a local paper misidentified him as "Bangladesh's chief of defense." Multiple stories, including an official website of the US military, makes the same mistake. We know his official title is "Principal Staff Officer." A typo? A Freudian slip? The bottom line is, he has not returned yet. But the conference ended on Nov 2--is he taking R&R at Macau as well?

We are asking because of another oblique reference in our favorite inside informer, Amader Shomoy. In prose designed to fool no one, Mr. Nasir Uddin informs us under the heading "Possible turning point after November 27":

Lt. Gen. Masud is abroad. Is this article referring to him? Since Moeen is missing, it is entirely possible he is also abroad, and is the "non-civilian" mentioned in the article.

We don't think the latter is the case.

We were informed the night of the BNP coup that Gen. Moeen Ahmed was in CMH, and his movements were restricted. But without any corroboration, at that time we posed it as a question. His brother's active politicking also can not be reconciled with his allegedly restricted status.

But this article makes us ask the question again: where exactly is Gen. Moeen Uddin Ahmed? And while we think it was an honest mistake, why is the US military identifying Gen. Masud Uddin Chowdhury as the chief of defense?

Nov 21st is the Armed Forces Day, right? I'm thinking he'll have to appear then, if he is able. If he's not there that day too, we'll definitely know something is up.

AWL doers so called Mujib supporters should not wear Mujib coats causes they feel shy to identify themselves as BAKSAL supporters.
BAKSAL was the latest Mujib's formula for executing his Ideology.
It should be remembered that Mr Mujib was the people's elected leader so his BAKSAL idea was democratically legal & his Ideology is also democratically mandated.

really happened back then, when he completely denied the occurrence of
such event, saying that he does not believe any pakistani is capable

KARACHI, NOV 11: A group of concerned citizens from the Peoples'
Resistance (umbrella group formed to resist emgency) have been
meeting the non-PCO judges over the last few days to extend
solidarity and appreciate their stand. 
 
Civil society coalition, People's Resistance, is appalled at the attempt by
General Musharraf to destroy the independence of judiciary of Pakistan.

Civil society condemns the following steps undertaken by General Musharraf to
undermine the judiciary and to demoralise the honourable judges who have refused
to take oath under the PCO:

1. The newly appointed Chief Justice of Sindh High Court had submitted his
resignation before Nov 2, 2007. His health has rendered him unable to function
mentally, as his cognitive abilities were compromised after his illness two
years ago. By appointing him as the Chief Justice of Sindh High Court, the
judiciary of Pakistan in general and of Sindh in particular have been
compromised.

2. Rangers and Police violated the sanctity of Sindh High Court by raiding it.
The raiding party included uniformed and plainclothes policemen. According to
eye witnesses some members of an ethnic group, in civilian clothes, were also
among the police.

3. The honourable judges who abided by the Supreme Court directive to not take
oath under the PCO 2007, were humiliated:
a) They were summarily ordered to vacate their offices and given no time to do
this.
b) Some judges had to empty their shelves and drawers onto bedsheets to carry
them home. Their personal items were thrown away.
c) The security guards to which judges of High Court are entitled even after
their retirement, have been withdrawn from their homes
d) Judges in Punjab are under house arrest. Civil society groups are being
prevented from meeting them
e) Telephone of some judges has been disconnected.
f) High Court judges are being prevented from visiting the courts.

4. The honourable judges who said 'no' to PCO are being threatened:
a) Right to pension will be withdrawn
b) They will not be allowed to practice law.
c) Sons of some of the judges were arrested without any charges
d) Senior military officers phone and pressurise them to take oath under the PCO

5. Three judges from Sindh who have taken oath under the PCO are known to visit
the Governor's house every day. This violates the resolution passed in 2006 by
all Sindh High Court Judges that no judge would visit the governor or the chief
minister in their offices.

6. The amendment of the Army Act, giving the armed forces the power to arrest
citizens and try them in military court, further undermines the judiciary. In
the current set up, it would now be a farce to challenge this appropriation of
power.

Despite the appropriation of all power by General Musharraf, through the
declarations made by him on Nov 3, 2007, civil society stands firm on the
following points:

1. The PCO is illegal, according to the Supreme Court judgement of Nov 3rd 2007

2. Judges who have taken oath under the PCO have violated the Constitution of
Pakistan, and the Supreme Court judgement of Nov 3rd.

3. Suspension of the Constitution of Pakistan is illegal

4. Arrest of hundreds of lawyers and the decision to charge them under the
Terrorist Act is a despicable act. It reflects complete disregard of people's
right to protect the independence of judiciary and to be treated with respect.

5. The blockage of independent TV news channels is immoral and illegal as it is
a denial of freedom of expression.

6. A joint movement of lawyers, media and civil society will continue against
the martial law and its accompanying attempt to subvert the independence of the
judiciary and the media.

Civil society makes the following demands:

1. Immediate restoration of the Chief Justice of Pakistan and the judges of the
Supreme Court and High Courts that have not taken oath under the PCO.

2. The judges who have taken oath under the PCO must resign immediately.

3. The judges who have started visiting the Governor must desist this practice
immediately, as it subverts the judiciary to the executive and thereby insults
the judiciary which is the most central pillar of a State.

4. Changes in PEMRA ordinance must be withdrawn and restrictions on the media
must be removed without any conditions.

5. All lawyers that have been arrested must be released immediately, and all
cases withdrawn.

PEOPLE'S RESISTANCE, a civil society alliance of Karachi, calls upon all
professional groups, NGOs, trade unions, student unions , and individuals to
join the platform of resistance in its peaceful campaigns for the restoration of
independence of judiciary, clearning of the judicary of the unprinciples judges
that have taken oath under the PCO, restoration of the independence of the
media, and the security of all the people of Pakistan by the restoration of the
Constitution of Pakistan.

We the citizens of Pakistan salute the judges who have not taken oath under the
PCO, and have thereby asserted the inalienable right of the judiciary to remain
independent.
We the citizens of Pakistan salute the media in its determination to protect the
independent role of their profession.

JERUSALEM - Police raided more than 20 government buildings and private offices Sunday, searching for evidence in a series of criminal investigations of Prime Minister Ehud Olmert.

The probes — all related to actions that took place before Olmert became prime minister — have threatened to weaken the Israeli leader at a time of growing momentum in peace efforts with the Palestinians.

Among the places raided were the Industry and Trade Ministry, the Postal Authority and Jerusalem's City Hall, said police spokesman Mickey Rosenfeld.

"Police investigators are searching a number of government and private offices in connection with three ongoing investigations" into Olmert, Rosenfeld said.

He said authorities were expected to confiscate documents and other materials, but gave no further details.

Officials in Olmert's office declined comment. In the past, the prime minister has repeatedly denied any wrongdoing and has dismissed the investigations as a political witch hunt.

In one case, Olmert is suspected of buying a luxurious Jerusalem home at a substantial discount from a developer in exchange for arranging construction permits for the builder. Olmert is a former mayor of Jerusalem.

In a second case, police are looking into suspicions that Olmert acted improperly when he was trade minister earlier this decade. Authorities suspect Olmert steered a government grant to a friend and arranged improper political appointments.

Olmert also is suspected of trying — unsuccessfully — to rig the sale of Israel's second-largest bank in favor of two associates while he was finance minister in 2005.

Olmert has been dogged by corruption allegations throughout his three-decade career in politics, but has never been convicted of any wrongdoing.

Olmert is preparing for a U.S.-hosted Mideast peace conference later this month in Annapolis, Md. He hopes the gathering will provide a launching pad for formal peace talks with the Palestinians after a seven-year lull.

A criminal indictment in any of the three investigations facing Olmert would deal a heavy blow to the peace efforts. Although Olmert would not be forced to step down, he would be seriously weakened and likely face heavy public pressure to step aside.

Do you know what is the most important thing in the world for you? Is it money? Is it welth? Is it fame? Is it power? No………this is positive thinking you need the most. Yes positive thinking can bring to you all those things that you want from the core of your heart. All the psychiatrist and sicial scientist and self development writer told the same thing. Positive thinking has such a power which can change your self and bring your dream come true.

I am not a psychiatrist but I have been trying to think always positively for the last 10 years. Ok lets see how much positive you are. If you see a glass half filled of water, what do you think? Do you think half empty or half full? Actually a positive person will see half filled.

Positive thinking is a matter of practice. It is not inborn. The more you practice the more you will achieve it.

Breathing theory:

How can you become a positive thinker? Actually therer are lots of ways and theories. But the most simple one probably the breathing theory. When you become excited or angry, just breathe in very deeply and slowly, very slowly. When you breathe in, count 1 to 10. then hold the air for 3 seconds and then breathe out and count 1 to 15. Do this for 5 times, I mean simply breathe in and out 5 times very deeply and you will feel much relaxed and calm, anxiety or angriness can't work over you. It will also rejuvenate you.

You can do this practice whenever you want. No money, no extra space, no extra tools, no extra time needed to do this practice but you will feel the change within your self. Just do it and see whether I am true or not.

Dhaka, Nov 11 (bdnews24.com)—Law and information
adviser Mainul Hosein has said the main responsibility
of the caretaker government is to hold "proper"
elections.

"The government has been carrying out a lot of
additional activities, besides efforts to hold a free
and fair election," Mainul told reporters at the Press
Information Department Sunday.

Asked if his government will open trial of war
criminals, the adviser said: "Why are you asking us?
Why don't you put this question to those who avoided
the issue for the last 36 years? You've waited so
long, why don't you wait for another two years?"

Launching the 38-volume "Bangladesh Code", Mainul
expressed hope that expected changes in politics would
take place by February.

"I am not very optimistic—though—about the changes the
political parties are trying to make. But it is true
that the Mafia rule is over. Honest citizens should
come forward now," he said.

Replying to a query on the release of some businessmen
detained earlier on different charges, Mainul said:
"If the politicians take to stealing and robbing, what
will the thieves and thugs do? It is difficult to
distinguish between politicians and businessmen."

"After the Truth Commission bill is approved,
businessmen won't have any problem getting bail, if
they confess," Mainul said.

He said the government moved to set up the Truth
Commission to revitalise the economy.

"We should not assume that everything will be all
right as soon as the elections are held by 2008," the
adviser said.

Mainul brushed aside any possibility of imposing
martial law in the country and said: "The caretaker
government advisers will not gain anything if the
elections are delayed. The polls will be held on
schedule."
