[chottala.com] Tribunal for war criminal.

Dear Moderator,
 
What Far West told  me to see and follow some website links sent by him to have a better knowledge and information, for his information I like to say, I already knew that since 1971 as we were the real eye witness of those incidents at that time. We were full fledged doctor and we used to be busy in treating our freedom fighters secretly at that time. We knew very well the activities of Golam Azam and his Jamaatis during 1971 liberation war. So no question of those website links for us at all. We the people of that period are the best website links at present.
 
Many are raising question about our Bangabandhu's decision giving amnesty and pardon partly or fully. There was nothing like that in his speech at that amnesty speech. Amnesty and pardon was given fully and it was to all who want to stay in Bangladesh at that time.
 
I like to say I also want the war criminal should be under trial. But our CTG should not be disturbed at this moment in their heavy task of preparation for neutral and fair election. Let us wait for the democratic govt to come to accomplish that duty.

What dina khan is telling I think she is right. CTG is trying their level best only to give us a fair and free election within this fully corrupted  Bangladesh, created by the previous democratic regime.
 
CTG have got two options at present in their hand. Number (1) is to wipe out the corruption and number (2) is to present us a corruption and Karchupi free election. 
 
Within this short time by their sincere efforts they caught many corrupted political leaders of the previous regime. Again many people wanted, these  leaders to be released, and the power should be handed over to the same corrupted leaders through election in the name of so called democratic process. Many have started criticising our present sincere and honest CTG by raising hue and cry to give an early election. 
 
Now again they are asking CTG to form special tribunal for those war criminals after 36 years. Our great leader and father of the nation Bangabandhu Sheikh Mujibur Rahman already gave them amnesty without taking any consents from the public who suffered a lot in the hands of those Rajakar, Al-Badar, Al-Shams and Jamaat during 1971 liberation war. As people used to love Bangabandhu too much at that time they accepted his decision whole heartedly without any objection.
 
What we see now, these opportunistic political parties using this Jamaat as trum card, one time Awami League took them in their side to win the election as in 1996, and in another time in 2001 B.N.P. took them in their side. " Baap dakteyo deri nai, shala dakteyo deri nai". In this way election game is going on by making the publics in the middle as a great fool. What they think about the common people? Are they play doll in the hands of those two political parties?    
 
CTG is only responsible to do and conduct free and fair election. It is not their duty to start tribunal for those war criminals. It is the duty of the next democratically elected govt. Uptill now the so called democratic leaders could not do anything for those war criminals even by making GHADANIK and what not, and now again some are demanding CTG should do everything and make a war tribunal within these short period which our previous so called democratic leaders could not do uptill now. What sorts of  absurd proposal is this? Why not they did this during their tenure? Why to break the KATHAL upon the heads of CTG?

you know the time frame of the CTG have ? Will they be
able to do all these clean up ( Mess ) during this
limited time ? Do they have enough manpower to do so ?
Why not Dina Khan goes to Dhaka and actively involve
with CTG and advice accordingly. Do you expect CTG to
do the job not done for the past 36 years within their
limited time and limited resources ? Please be
considerate. It is very easy to say anything but very
difficult to do. Please compare with your personal
experience.

Be constructive and advice constructively. I am sure
you are like Mr. Mahtir of bd and supporter of a
political party and would like the fall of this CTG
who are parised for their better job World wide. But
if you want them to continue for the years to come to
continue with their " Clean Up " . Development,
Election preperation and ultimate election. It will
take at least 10 more years at least. Do you agree
with them to continue? In that case there will be no
election for the next 10 years. But all political
parties, Foreign Governments to whom we are dependent
for our developments want a creditable election
quickest. Will you please be kind to think and come up
with a constructive suggestiuon.

Chief Election Commissioner (CEC) ATM Shamsul Huda yesterday agreed in principle to a proposal placed by Jatiya Samajtantrik Dal for imposing a ban on political parties based on religion.

"A consensus has been reached over this issue. We'll see later how we can implement it," CEC Huda said during talks on electoral reforms with a JSD (Inu) delegation following arguments about the crucial issue.

Quoting article 38 of the constitution and section 20 of the Special Powers Act, the JSD leaders argued that it is illegal and a punishable offence to form or run a political party based on religion.

The EC will be accused of violating the constitutional oath taken to preserve and protect the constitution if it gives registration to any such political party, the leaders argued.

"We'll examine the issue again in the light of the constitution and hope you [JSD] will also study it further. We may hold more discussions on it," Election Commissioner Muhammed Sohul Hussain said during the talks.

The EC response came following growing demands from different quarters to keep religion-based political parties and war criminals out of polls.

On demands that war criminals be declared ineligible for the polls in the proposed electoral laws, the CEC, however, said such a proposal can be included only to express hatred and malice towards them and anti-liberation forces.

"But it is difficult for us to implement it to keep them out of the polls unless they are specifically charged and convicted," he said.

The CEC said the issue of war criminals and anti-liberation forces is largely political though the EC is involved in it. Trial of the war criminals could not be done in last 36 years, he observed.

"If the government wants to do something, it must be done soon since many documents and information are already missing and many witnesses died in course of time," the CEC added.

"The government will have to do it since it has more responsibilities than the Commission has," the chief poll official asserted, adding that the EC will however do what it can under its jurisdiction.

Taking part in the talks held at EC Secretariat conference room, JSD President Hasanul Haque Inu placed a set of recommendations to bring changes to the electoral laws.

In defence of the proposal to disqualify war criminals the JSD leader asked the EC to accept the proposal in principle.

"If the EC agrees in principle to the proposal, a legal framework can be identified later through discussions," the JSD president said.

In response, Election Commissioner Sohul said it requires amendment to the constitution to introduce such a law.

"We can include the proposal for academic purpose. But it will have no legal effect. For how do the returning officers disqualify a contender branding him a war criminal in absence a clear conviction?" the CEC observed.

At this stage, JSD Executive President Mainuddin Khan Badal quoted article 38 of the constitution and section 20 of the Special Powers Act. He said no political party can be formed on the basis of religion as the laws clearly oppose forming such political parties.

"So, the Election Commission in no way can register any political party based on religion. If the commission does it, it will violate the constitutional oath," he argued.

The JSD, an ally of Awami League-led 14-party alliance, also supported most of the proposals for electoral reforms and suggested some minor changes to a number of those.

The leaders lauded the EC's proposals for checking the use of religion for political purpose during election campaigns.

The party suggested changes in the electoral laws to hold the presidential election by preparing a voter list comprising lawmakers, chairmen and members of Union Parishads, chairmen and ward commissioners of municipalities, mayors and ward commissioners of city corporations and chairmen and members to district and upazila parishads.

The existing laws allow only the lawmakers to vote for presidential election.

The JSD leaders said they believe the EC's electoral roadmap will be implemented on time.

In his concluding remarks, the CEC said the commission will again sit with the political parties seeking their opinions on the final draft proposals for electoral reforms.

War Criminals of 1971: Time to Take Action

[This article, setting the record straight about the so-called amnesty against war criminals has been posted to various mailing lists. We felt it was important to publish the whole article. The author, Dr. Abdul Momen, is a former senior civil servant for various governments of Bangladesh and currently a professor of Economics in Metro Boston. As I was uploading this, I could not help but wonder who spread the disinformation about the amnesty, and why the media kept silent.]

It is highly misleading that Bangabandhu Sheikh Mujibur Rahman government pardoned all the war criminals and he did nothing during his 'war ravaged reconstruction period'. The facts show otherwise. In fact, Bangabandhu Sheikh Mujibur Rahman government started prosecuting the perpetrators of 'crime against humanity' or 'war criminals' immediately after independence and he also passed the Collaborators Act (1972) and the International Crime Act of 1973 that barred re-entry of any collaborators to Bangladesh.

Sheikh Mujib promulgated the Special Tribunal Order on January 24, 1972 (PO No 8 of 1972) after 14 days of his return from Pakistani jail to try those Pakistani collaborators, Razakars, Al-Badrs and other stooges of the Pakistani army. Under this order he arrested 37,000 collaborators amidst of strong opposition by left-leaning journalists like Enayetullah Khan [see his write-up titled '75 million Collaborators', the Holiday, 1972]. Out of them, 26,000 had no grievious criminal charges filed against them; therefore they were pardoned and released in a general amnesty. However, nearly 800 cases were completed and given jail sentences. Another 11,000 were in jail including Nizami and Abbas Ali Khan of the Jamat-e-Islam Party (JI), and their prosecution was at various stages of completion. In addition, those that were involved in 'crime against humanity' and against Bangladesh, were denied Bangladesh nationality and passports.

On November 4, 1972 all religion-based politics were abolished as per sections 12 and 38 of the Bangladesh Constitution of 1972.

Unfortunately, when General Ziaur Rahman, a valiant muktijodha emerged as a 'strong man' in 1975, he abrogated the Collaborators Act and released all the prisoners including those that were sentenced, and those under prosecution. For political and personal reasons he allowed religion-based parties to operate and started reinstating and rehabilitating them. No wonder, those who were guilty of 'crime against humanity' and collaboration with enemy (Pakistan) state started returning from abroad especially Pakistan and Saudi Arabia and they were given Bangladesh citizenship and passport. The worst example if this was Golam Azam of the JI Party.

On those days I was working for the Bangladesh government and many individuals and their relatives that had no Bangladesh passport approached us for consideration. However, once General Zia took over, all of them were issued Bangladesh passport or 'travel documents' to return to Bangladesh.

It is sad that few vested quarters including Abdul Mannan Bhuiya, the ousted BNP Secretary General and current Law Advisor Barrister Mainul Hosein are misleading the public and the nation by stating that Sheikh Mujib pardoned them or shifting the responsibility by asking why they were not prosecuted before.

The fact is, Sheikh Mujib started the prosecution and he pardoned only those that did not have criminal cases against them. He did not pardon those (Razakers, Al-badr or Al-Shams) that had 'criminal cases' and those that committed 'crime against humanity or war criminals' such as rape, murder, and the like. Thousands of these criminals were in prison during his time awaiting trail, and many were absconding abroad including Golam Azam, the leader of the JI party where they were involved in anti-state activities abroad. He did not get time to complete the prosecution because he was murdered with most of his family.

After the massacre of Sheikh Mujib and his family plus his close associates; Prime Minister Tajuddin Ahmed, Acting President Syed Nazrul Islam, Secretary General AHM Qamruzzaman and Home Minister Monsur Ali, the founders of independent and sovereign Bangladesh in 1975, one after another civil-military-technocratic or cantonment-based governments ruled the country. In 1996, when pro-people and pro-liberation government of Sheikh Hasina came to power after 21 years with marginal votes; it neither could reinstate the Collaborators Act nor could revive the original constitution of 1972. Secondly, it followed 'judicial process and rule of law' and therefore, it did not set up any 'kangaroo court or special tribunal' to prosecute the criminals. One can debate that as a weakness of the Hasina government or not.

Therefore, it failed to punish the war criminals and the culprits. But that does not justify that the criminals of 'crime against humanity' or war criminals should not face justice. It would be unfair if they are allowed to go free or untouched. Fortunately, now is an opportune moment to revive the clause that 'no religion-based political party can register or contest in Bangladesh election' and those found guilty of 'crime against humanity' to be fully prosecuted. Unless the criminals and murderers are fully prosecuted, you can neither establish 'rule of law' nor can stop political killing in Bangladesh.

Secondly, Islami activist S. A. Hannan, a retired bureaucrat following the JI party line of argument tried to mislead the public by stating that there was 'no genocide' in East Pakistan in 1971.

Genocide is the deliberate and systematic destruction of an ethnic, religious or national group. While precise definition varies among genocide scholars, the legal definition of it is found in the 1948 United Nations Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG). Article 2 of the CPPCG defines genocide as:

Any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: killing members of the group; causing serious bodily or mental harm to members of the group; deliberately inflicting on the group conditions of life, calculated to bring about its physical destruction in whole or in part; imposing measures intended to prevent births within the group; [and] forcibly transferring children of the group to another group.
In 1971 the Pakistan occupation army plus their collaborators like the Jamat-e-Islam, the Islami Chatra Sangho (currently renamed Islami Chatra Shibir) and their militant killing squads--the Al-Badr and the Al-Shams tried their utmost to apprehend and kill those that demand an 'independent Bangladesh'. Since majority of Bengali speaking East Pakistanis (Sheikh Mujib got 167 out of 169 seats in East Pakistan) or ethnic group favored an independent Bangladesh, they waged a war with intent to destroy that ethnic group. The Pak army systematically opened fire on unarmed masses of Bengali ethnic group on the midnight of March 25th, 1971 indiscriminately resulting which, as per various reports 19,000 to 25,000 Bengali ethnic people died on that dark night alone and over a period of 10 months, 3 million reportedly killed, 30 million were dislodged from their homes and 10 million had to take refuge in neighboring India due to cleansing operation, fear and repression. In global rankings, the 1971 Bangladesh genocide is second only to that of Nazi genocide of Jews.

In order to cripple the whole 'bangali nationalism and nationhood' the Pak army in collaboration with the Jamat-e-Islam and few other such parties and their affiliates systematically and calculatedly murder the Bengali intellectuals, writers, doctors, journalists, educators and their political leadership. In addition, in order to cleanse the society of Hindu population, the Pak army and its collaborators calculatedly killed and/or uprooted them. No wonder, over 10 million East Pakistanis (out of 75 million) mostly Hindu minority took shelter in the neighboring India. When army captured me on April 20, 1971, they tested me whether I could recite 'kolema' (the 1st pillar of Muslim faith) and then they checked whether I had my circumcision, a symbol of being Muslim in the subcontinent.

Anyone not able to recite the Kolema, or males without circumcisn were killed because they could not show proof of their religious identity. Such is a testimony of cleansing of a religious group, a clear evidence of genocide.

But Zia's gutting of the relevant laws missed one. The International Crime Act of 1973 of Bangladesh is still active and Article 47, Section 3 of the Act allows trial of war criminals. Therefore, the military-backed government of Fakhruddin Ahmed that has started many essential reforms can try the war criminals and punish them provided it has the mindset and commitment. It is unfortunate that its Law Advisor is trying to guillotine this golden opportunity.

It is time to take action.

The Family

We reported earlier on a story about an adviser in the interim government, Geetiara Safia Chowdhury and her husband beating up and seriously injuring a university professor whose property they might be trying to usurp.

A group of concerned NRBs wrote to the CA and the interim government, and it is reported that whole three advisers (Maj. Gen. Matin, Anwarul Iqbal and Dr. AB Mirza Azizul Islam) are in favor of taking action, three other advisers, Dr. Iftekhar Ahmed Chowdhury, Mr. Ayud Quadri and Mainul Hosein are against taking any action at all. Our ocassional commenteter Dr. Momen also reports:

Dr. Fakhruddin Ahmed himself believes that 'time will heal it and they can consume the time'. Therefore, the CA is not showing interest to take any action at this time. Iftiker, Fakhruddin, Dr. Rahman and Geetiara--all are very close relatives in this cabinet. However, if the pressure from abroad continues on the government, the decision may change.

Looks like Dr. Fakhruddin Ahmed is developing the habit of protecting his family members, just like the politicians he helped to send to jails. This is his chance to set an example, at the very least by asking Geetiara Chowdhury to resign and letting the law take its own course.

We are not holding our breath.

Hafiz defends standing committee's decision

BNP chief Khaleda Zia-appointed secretary general of the party, Khandaker Delwar Hossain, yesterday alleged that his and his family members' lives were threatened by a 'certain quarter'.

He claimed that the threat was for forcing him to resign from his current party post and to exclude the detained party chairperson from the leadership.

Meanwhile, Maj (retd) Hafiz Uddin Ahmed, who had been appointed as the new secretary general of the party by a national standing committee (NSC) meeting on Monday night, categorically said at a news briefing in former finance minister Saifur Rahman's house yesterday that those who do not accept the decision made by the highest policy making forum of the organisation also do not have the right to claim themselves as the bearers of BNP politics.

With the rivaling speeches, BNP is now formally divided in two factions, although both the factions seem to believe that the cloud of chaos will be cleared soon as they hope Khaleda Zia will send her message regarding the matter through her lawyer, who is scheduled to meet her today.

"They came into my house on Sunday night and told me that I would have to agree to resign from my post, accept the new chairperson and secretary general of their choice, and would have to join Monday's standing committee meeting, or else the lives of my family members and my own would be in danger," Delwar Hossain told journalists from a hospital bed in Birdem about the threateners, while terming the NSC meeting held in Saifur's house as illegal and unethical by the standard of the party constitution.

Claiming himself as the legitimate secretary general of the party he said the party is united under the leadership of Chairperson Khaleda Zia, and urged party leaders and workers not to be confused by some leaders' 'anti-party activities'.

Meanwhile, in reply to a question from reporters on whether there is any post of an acting chairperson in the party constitution, Saifur Rahman and Hafiz Uddin Ahmed said a party constitution does not always contain solutions to every situation and it needs to be changed from time to time.

Some party leaders who are not necessarily actively involved in the unfolding drama in BNP said the new line up of leadership picked by the NSC will end up dividing the party as Khaleda loyalists rejected the decision saying that the NSC meeting held in Saifur Rahman's residence itself is illegal, since according to the party constitution only the chairperson has the authority to convene such a meeting.

Some NSC members led by Saifur Rahman on Monday night held a meeting which declined to ratify the expulsion of Abdul Mannan Bhuiyan and Ashraf Hossain by the now detained chairperson of the party, right before her arrest.

The meeting also appointed Saifur as the acting chairperson of the party although there is no mention of such a post in the party constitution, and removed Khaleda appointed secretary general, Khandaker Delwar Hossain, from the post, replacing him with Major (retd) Hafiz Uddin Ahmed as the acting secretary general.

Saifur Rahman, who himself has been sick for a long time, said the NSC decided to remove Delwar from his post on grounds of the latter's physical ailments.

Meanwhile, Delwar firmly said, "I have nothing to lose. BNP is a peoples' party which nobody will be able to divide through conspiracies."

Delwar, who is also an NSC member, said only the chairperson of the party may call an NSC meeting and there is no post of an acting chairperson in the party constitution.

"It has been a blessing from the almighty Allah that I was exempted from the compulsory presence at the meeting as I was sick," he said adding that he would be forced to sign on to the meeting's decisions if he was present there.

Hinting at Bhuiyan loyalists who attended the meeting in Saifur's residence, Delwar said, "They will be identified by the people as renegades."

"Khaleda Zia appointed me as the secretary general and I will try to uphold her faith in me even with my life," said Delwar from the hospital bed.

About the threat to his life, Delwar said he was aghast to see that a group of people were dictating him to resign from the post of the party secretary general.

"Never before did I face such a heinous and nakedly thuggish threat," he said adding that every professional service has a boundary which nobody should cross.

He also drew the attention of the president, chief adviser, army chief, inspector general of police, the chief justice, and other justices to the threat on the lives of his family members and his own.

When asked who threatened him and his family, the former chief whip of the parliament said, "I don't want to disclose their names yet but I have identified them, and I will tell everything if the government forms a high power judicial inquiry committee to investigate the matter."

Referring to the NSC meeting held in Saifur's house, Delwar said leaders who were present at the meeting planned to destroy the party and Khaleda's leadership.

Meanwhile, at the news briefing in his own house, Saifur Rahman, the NSC appointed new acting chairperson of the party, called for unity of the entire party for winning the upcoming election, and said a political party cannot be crippled merely for a person.

"We cannot sit idle as the election is getting near," he said during the briefing, adding that they will consider the greater interest of the country and the party, and not of any individual.

He said it is not important who leads the party today as pushing the party forward is the main agenda now, while Hafiz said the NSC is the highest policy making forum of the party and it took a unanimous decision to bring changes in the leadership.

Later, Saifur and Hafiz visited the grave of the founder of the party, late president Ziaur Rahman, at Sher-e-Bangla Nagar and placed floral wreaths there, followed by their loyalists.

Meanwhile, Birg Gen (retd) Hannan Shah, adviser to party chief Khaleda Zia, said the way the posts of leadership were hijacked in BNP is unprecedented in the world history.

"Party leaders and workers don't support and will never accept such unconstitutional activities," he said while talking to reporters in his Mohakhali residence in the capital.

He also put out a call to Saifur Rahman for bringing both the factions of the party to a negotiation table for the sake of maintaining a single BNP.

Mr. Delwar's son just got arrested. Why now? What about Dhoa Tulshi Pata Saifur Rahman and his son? They  should have been to jail long before, including Manan bhuyian. It seem to me that EC is clearing out the path to send the letter to Saifur and his gong.....
