The Constitution requires the Election to be held under Emergency

One may disputes the interpretaion that uses the word 'require'. However, the constitution does not require for the emergency to be lifted for an election to hold. The constitution leaves the it upto the discretion of the President.

Dr. Kamal and other authors of the constitution may have forgotten what is in the constitution of Bangladesh. So, we start with a quote from the english version of the constitution that is available in the internet. We would request you to specifically read the portion right after the article 141A (2) (c) where it says "Provided that if any such Proclamation is issued at a time when Parliament stands dissolved ......".

The provisions are very clear. If there was no Parliament at the time of declaring Emergency, the Emergency proclamation will stay valid until after 30 days of a new Parliament is re-constituted. Last time we checked, there is only one way to re-constitute the Parliament which is to hold general election. So, in our interpretation, this said general election will have to be held while the Emergency is still in effect. The Emergency will still be in effect even after the election until 30 days passes after the new parliament meets for the first time.

(1) If the President is satisfied that a grave emergency exists in which the security or economic life of Bangladesh, or any part thereof, is threatened by war or external aggression or internal disturbance, he may issue a Proclamation of Emergency:

88[Provided that such Proclamation shall require for its validity the prior counter signature of the Prime Minister.]

(2) A Proclamation of Emergency-

(a) may be revoked by a subsequent Proclamation;

(b) shall be laid before Parliament;

(c) shall cease to operate at the expiration of one hundred and twenty days, unless before the expiration of that period it has been approved by a resolution of Parliament:

Provided that if any such Proclamation is issued at a time when Parliament stands dissolved or the dissolution of Parliament takes place during the period of one hundred and twenty days referred to in sub-clause (c), the Proclamation shall cease to operate at the expiration of thirty days from the date on which Parliament first meets after its re-constitution, unless before that expiration of the meets after its re-constitution, unless before that expiration of the said period of thirty days a resolution approving the Proclamation has been passed by Parliament.

 

It is safe to say that with any country's constitutional provisions, this particular provisions will have many interpretation, based on whom you ask. Whatever the interpretation, in every interpretation, one thing will stand. That is the constitution do not require the Emergency to be lifted. In other words, there is no constitutional bar for the general election to be held under emergency as far as Bangladesh Constitution is concerned. So, if the government chooses to use its discretion to lift the Emergency without constituting a Parliament first, it would be liable for its decision. They will have to make sure that Emergency do have to come back - if there is such a chance, it would be rather well-advised to stay within the Emergency Proclamation until it can have a legimate authority (an elected parliament) to whom power can be handed over. The Law Adviser or the CEC or any body else should be much more careful while talking about lifting Emergency Proclamation, since it seems to be the President's prerogative to decide on the matter, nobody else.

The creative active honest learned teachers must be inspired for doing education researches to create update education resources & they should be awarded.
New honest active learned teachers must be appointed & provided them inspired them to be learned wise foresighted teachers.
Nation wide quality education system must be introduced for providing to nation wide all people quality education for creating quality people & for making them skilled creative in their respective working fields.
The teachers should try to know & should try to understand what faults they have done.  
They need to try to understand that in past last 37 years in Bangladesh education section they could not be able to provide correct update teaching lessons to the students in time to make them good leaders good politician good law maker & good administrators to lead the country.
 Now the University Teachers are in the Jail & facing trial as like as criminal persons. Being University Teachers they are doing movement works without showing respect to the lawful court verdict as like as labor leaders for releasing their colloquies from the jails. They have no wise knowledge have no lawful good idea to face the court lawfully for releasing the convicted University Teachers.  It is a very shameful matter to the whole nation.
They do not understand what crime they have done by not taking regular classes by not providing to the students update correct education lessons by not taking examinations in time & by not giving result in due time & they have created season jots, they have given them trouble by killing the money misusing the energy & valuable time of the poor parent hopes & of the poor students who have admitted in the university for getting education.
For establishing Justice of law & for establishing Lawful Administration for establishing Humanity & Human Right it is the most essential duty of the Judicial Department to take legal action according to the complain submitted by any citizen of the country to the court for seeking lawful verdict against any person whatever he/she may be (whether big leader or university teacher).
They are the student's life time killer money killer of the poor students & their parents.
They do not try to understand what' their faults & they do not try to rectify their faults as wise teachers. 
The teachers are the paid service holders for doing the teaching works to make the students as competent citizens by providing them update correct education. They are getting salary for the teaching works.
So it is very essential duty for the nation to look whether the teachers are doing their duty teaching WORKS correctly & honestly by taking the classes in time by giving the students correct update knowledge lessons & by taking the examination in time & by giving the result in due time 
OR  
they are doing party politics not taking classes not taking examination not giving result in due time  & only  they are doing free thought exercises thinking themselves free thought valued persons like as Royal Bengal Tigers.

For establishing fair & neutral Govt Administrations, for establishing fair & neutral Judicial Department it needs to appoint the people who are not doing party politics in their student life & not doing politics before joining in the service to Govt Administrations or Judicial Department. 
So the rules & laws should be made for the students that the students who want to do party politics in their student life they may do party politics but they will not get job in any Govt Administration or Judicial Department after finishing their study.

Emergency meeting reportedly underway at ministry of culture. Uproar
at Zia International Airport. Remaining consignment not being shipped
as it is incomplete. More than one crate may be missing.

Earlier reports state that the Air France cargo flight arrived late.
The crates were waiting for the craft. However while loading one of
the thirteen crates was found to be missing. Later the empty crate was
found outside the North Western perimeter of the airport grounds in a
residential area.

Intelligence sources wishing to be unnamed have confirmed that at
least one crate has gone missing.

Update 11:25 am. Unconfirmed

There were 13 crates containing 145 pieces. several crates were
totally empty (five are said to be empty, but this does not tally with
subsequent figures), and one crate is still missing.

When the French embassy was contacted at 1:30 in the morning, they
said the remaining 11 crates should be sent. 9 crates had already been
uploaded to the plane, the joint forces seized these remaining crates,
all Ansars (a lightly armed auxiliary force that assists the police in
maintaining law and order) were arrested. Mr. Jahangir Alam of the
National Museum and Mr. Zakaria of Varendra Research Museum and all
supervisors have also been arrested.

It was a bad day for cows.


But the Bangladesh government had a supreme sacrifice in mind. When
the most prized of your possessions needed to be sacrificed, and when
the gods have changed to western powers, the four-legged creatures
simply wouldn't do. The nation's most prized archaeological
possessions were therefore bundled away in Homebound chariots to
distant museums. The door to heaven's gate might not have opened, but
a Schengen visa and perhaps a few trips to Paris for some, had surely
been assured.

It was well timed. The Eid holidays meant there would be no newspapers
for two days. Most reporters would be away. The streets of Dhaka would
be empty. Holidays meant there was no rush. No pesky public to worry
about at opening hours. Still one needed to be sure. Bus no Dhaka Jo
11 1767, was on standby with riot police. The police jeep Dhaka Jo 11
4364 followed behind. Then the media that got in the way. With so many
Eid events to cover, why had they gathered round the national museum?
The sanctity of sacrifice should surely have been respected.
Reinforcements in the form of another busload of riot police came in
via bus number Dhaka Jo 14 1799.

Aisha had come with her parents to visit the museum. Like many others
they were turned away. The museum was closed, at least to the public.
The Eid holidays of museum officials had however been cancelled. The
shippers were working overtime.

Police and plainclothes intelligence officials were present in
abundance, their riot gear jarring with the bright new clothes of
Dhakaites. Then it took another turn. Spitting and booing had failed
to stop the Homebound trucks earlier. This time the protesters changed
tack. Chains were put on the gate of the national museum. Visions of
the Chipko Resistance sprang to mind. In place of burglars breaking
in, the comic view of government officials breaking their way out of
the national museum to escape with museum valuables would have brought
laughter in a trirotno drama (popular Bangladeshi sitcom). In the
theatre of Bangladeshi governance, it was yet another tragedy.

"The benefits, for both countries, are cultural: it is a win-win
situation where France gains a better knowledge of Bangladeshi
heritage and Bangladesh gains a better image on the international
cultural scene," the French embassy handout had clarified.

The partially demolished Rangs building continues to be a grave for
the buried Bangladeshi workers far down the priority chain.
Presumably, that is a 'Bangladeshi heritage' the Parisians will not
get to see.

The last time round, they had been playing one of my favourite Bhupen
Hajarika songs. This time there was no music, and no one was smiling.
Even the Bangladeshi flag failed to flutter on this Eid day.

You are wrong, i think also, Ms. Dina Khan & Mr. Shahid is absolutely
right.

Off course we should respect our teachers, but not like them who
misguide their student. Victim Teachers are RU & DU doing all for their
own publicity.

In that crisis teachers can make proposal to resolve crisis, but what we
saw ????

Teachers are not like an angel, they also Human being, my question is
who gave the license to the teacher to break rule.
