Dhaka, Nov 2 (bdnews24.com) – The Election Commission can bar religion-based political parties from getting registered even without a major policy decision by the government, the Workers Party said Friday.

If the commission follows the preamble of the constitution, Representation of the People Order and its own proposed rules for electoral reforms, the task could be done easily, the party suggested.

It said now was the time to take a decision.

At a news conference at Shahid Asad auditorium, the party urged the government to form a tribunal following The International Crimes (Tribunal) Act 1973.

It said according to article 20 of the 1974 Special Powers Act, the formation of religion-based party is not only banned but it is a punishable crime.

The preamble of the constitution highly speaks of the "brave martyrs" who sacrificed their lives in 1971. It has spelt out that the spirit of independence war should be one of the fundamental principles of the constitution.

The party, a component in the Awami League-led 14-party alliance, argued that failure to try anti-independence elements was a barrier to achieving democracy and peace.

It said the crimes the anti-liberation forces committed in 1971 were not against any individual but against humanity and the nation as a whole.

That the war criminals be tried and stopped from running the polls had become "a national demand", it observed.

The demand received a huge boost after the chief adviser, the army chief and the chief election commissioner spoke in clear terms against the war criminals.


In a written statement, the party took a dig at the Jamaat-e-Islami Bangladesh for its recent statement that war criminals had been pardoned through Simla Pact between Pakistan and India after Bangladesh gained independence.

Also, it came down heavily on the Jamaat for claiming that the government headed by independence leader Sheikh Mujibur Rahman granted amnesty to people who had collaborated with the Pakistani army in 1971.

The party termed the Jamaat's statements false, saying there was no amnesty for the people who were involved in crimes such as killing, rape, arson and looting.

The order on Jamaat's ex-supremo Golam Azam and other party leaders on Feb 14, 1972 to appear before their respective district courts proved that they had not been pardoned, it said.

It claimed that the then chief prosecutor Sirajul Haq and prosecutor Aminul Huq had started the process of trying the war criminals in 1973.

But the efforts stalled as president Ziaur Rahman had scrapped laws that could deal with the matter.

The party was not happy with statements by two interim advisers that trying the war criminals involves a major policy decision and a makeshift government cannot take such decision.

Party president Rashed Khan Menon questioned why it was not possible when the government was deciding on all other serious issues.

Asked if the remarks by the advisers meant that the advisers sided with the anti-independence quarters, Menon said he did not want to comment.

"However, the statements of the advisers have created confusion among the people," he added.

Senior leaders of the party attended the news briefing.

Sen. Edward M. Kennedy '54-'56 protested the arrests of 12 Bangladeshi academics in a letter to the nation's government last Friday, just days after the chief of Bangladesh's military spoke at Harvard and drew criticism for his regime's crackdown on academic freedom.

Gen. Moeen U Ahmed, who participated in a Kennedy School of Government executive education course in 2002, has sent troops to quell protests and arrest professors at Rajshahi University and at the country's flagship institution, the University of Dhaka. A military-backed provisional government has led Bangladesh since January 2007.

"I'm writing to express my deep concern about twelve prominent intellectuals from Dhaka and Rajshahi University who have been detained without charges," Kennedy wrote in the letter, which was addressed to Bangladesh's ambassador to the United States.

"I'm especially troubled by accusations that they have been tortured," Kennedy added. "Holding these twelve men without charge for political reasons is a major assault on the integrity and independence of the academic community of your nation and calls into question your government's commitment to human rights and the law."

Moeen spoke at the Kennedy School—an institution named after the senator's older brother—in a two-day session last week.

The events, hosted by the Ash Institute, were closed to the public in order to "allow for frank, free and meaningful discussion," according to a press release.

But the Ash Institute has come under fire for closing the events.

"It is incredibly ironic that at the very moment he speaks at Harvard University, he is presiding over an unprecedented crackdown on Bangladeshi academic institutions," Emran Qureshi, a fellow at Harvard Law School's Labor and Worklife Program, told The Crimson in a phone interview Monday.

The arrests at the Bangladeshi universities were a response to protests following an August incident in which soldiers attacked a student who was blocking their view of a soccer match.

"The demonstrations taking place in Bangladesh come after eight months of repressive emergency rule, which has restricted the rights to protest and fails to respect basic due process rights," the advocacy group Human Rights Watch said in a report.

Bangladesh declared a state of emergency in January 2007, with Moeen deploying the armed forces to end riots in the nation's major cities. The provisional government will leave office in December 2008, Moeen has said.

Tell us how did you try to save your beloved Islamic Republic of Pakistan
in 1971 by helping the Occupation Army?
Which camp did you belong in your self-described "Civil War ?"
 
Most Bangladeshi's inside helped the MuktiJoddhas in whatsoever way
they could. 
 
What did you do? Did you help the Rajaker, Albodor and Alshams and
Jamaati politicians in Chittogong with all your dedications ....?
 
What was your state of mind on the night of 16th December 1971 after
your Pak Army surrendered? Did you cry? Did you help the fleeing
collaborators to hide?
 
Did you or your Jamaati buddies ever performed a Tauba ceremony for
misdeeds in 1971 and collaboration with Occupation Army?
 
Don't try to hide your true color. You are just one of those motivated persons
in action with henious motives to help Jamaat and other religion-traders!

Assalamu Alaikum.I do not remember anything about what Mr. Hassan says.It is unfortunate that he is making these comments after  36 years when I being harassed by motivated quartres.This is not called moral behaviour or chivalry.
 
In any event, I was a young and junior officer at that time in Chittagong I do not know what I told my father in law or what he told his friend..

Dear All:

I want to tell you some things.My father and Mr.Hanna's father in law were classmate
and they worked in the same office. During our liberation war in 1971 we lived in the same area of Dhaka.
After March 25/1971 our family was very anxious about my elder sister and her family.That time she was in chittagong
and near about a month we didn't get any news. In April,1971 my father's classmate and colleague (Mr.Hassan's
father in law) went chittagong to visit his daughter and son in law ( Mr.Hannan).That time Mr.Hanna was working
in chittagong.

When my father's colleague returned from chittagong my father and mother both went to his home to
know about Chittagong's situation. He told my parents his son in law ( Mr.Hannan) told that Bengali peoples
did cruel things. They killed the local Biharies, hit them at their heads by 10'' break openly at the street.
"Now the situation is ok and what the Pak army is doing it's right."

Unfortunately this man was secretary of Bangladesh Govt. and invited by journalist at our TV talk show .
What could you expect from him?
