Nazi Hunters to Take On Other War Crimes Cases
Office Developing Program for New Mandate

or the past quarter-century, a rarely noticed unit inside the Justice Department has investigated and prosecuted alleged Nazis from World War II, resulting in the removal of nearly 100 former concentration camp guards and other suspected war criminals from the United States.

But now, with many of its targets dead or dying, the Office of Special Investigations is being remade to take on an even bigger task: tracking down war criminals within the United States who have connections to other genocidal conflicts around the globe.

The new mission, included as part of the broad intelligence restructuring package recently passed by Congress and signed by President Bush, has Justice officials scrambling to assemble an operating plan and proposed budget for the tiny office. Currently, OSI has 28 employees and $5 million in annual expenses.

Eli M. Rosenbaum, who has headed OSI for a decade, said the expansion of the office is a reflection of growing worldwide concern over the fate of suspected war criminals from the Balkans, Cambodia and elsewhere, many of whom have escaped prosecution by blending in with immigrant populations in the United States.

"For the first time since Nuremberg, the world is really getting serious about these kinds of cases," he said, referring to the war-crimes trials held after World War II. "This is emblematic of that."

Justice officials say they do not yet have details on how OSI will operate. But human rights advocacy groups are hopeful the new mandate will allow the department to locate and prosecute more suspected war criminals who have found refuge in the United States.

"I support the notion of the expansion of their role," said Rabbi Marvin Heir, founder and dean of the Simon Wiesenthal Center in Los Angeles. "The United States should not be a safe haven for mass murderers and torturers from every corner of the world just because they've been clever enough to put on a change of clothes."

OSI was created in 1979 to identify and deport former Nazis and their allies suspected of war crimes, as well as to keep suspected war criminals from that era from entering the United States in the first place. Expectations were low, with most officials predicting the removal of a handful of Nazis before the office would shut down within a few years.

Instead, the office -- which includes a contingent of 10 historians -- has successfully deported 95 people over the past 25 years and has prevented 170 others from entering the country, according to the Justice Department. The Wiesenthal Center has ranked OSI as the most successful Nazi-hunting program in the world, finding that no other office has taken "the necessary steps to ensure the prosecution of a maximum number of criminals."

Over the years, OSI also played a leading role in the international effort to trace gold, artwork and other valuables stolen from Holocaust victims. Unlike other parts of the criminal division at Justice, OSI handles nearly all facets of its investigations from start to finish, although it does seek help from the FBI and other agencies for forensics and other technical work.

The OSI's work has been sharply criticized by some defense lawyers, who argue that the office usually targets low-level concentration camp guards who played no part in supervising or carrying out crimes against humanity.

The unit also has been shadowed by its role in the tangled case of John Demjanjuk, a Cleveland autoworker wrongly identified as "Ivan the Terrible" who ran the gas chamber at Treblinka. After being stripped of his U.S. citizenship in 1981, Demjanjuk was convicted of war crimes and sentenced to death in Israel. Based on new evidence, the Israeli Supreme Court overturned his conviction, and a U.S. appeals court accused the OSI of "reckless disregard for the truth" in pursuing the case.

But Demjanjuk, now 84, has lost his U.S. citizenship again, this time based on evidence that he was a guard at three other Nazi death camps. The Justice Department in December asked an immigration judge for a final ruling to deport him.

Contrary to expectations, OSI's workload has surged in recent years, due in large part to newly opened archives in the former Soviet Union and Eastern Bloc countries. But soon, OSI's work tracking Nazis will come to what Heir calls its "biological conclusion," as both perpetrators and victims die.

"We have to race the clock like no other prosecutors in the country," Rosenbaum said. "The time pressures of this work are extraordinary."

Under the new legislation, OSI will no longer be limited to tracking Nazis and their allies, but will also identify suspected war criminals in conflicts including the Balkans, Cambodia and Rwanda. The law would allow OSI to seek to keep out or remove immigrants who "committed, ordered, incited, assisted or otherwise participated in conduct outside the United States" that would be considered genocide, acts of torture or extrajudicial killings.

The Justice and Homeland Security departments are required to submit reports to Congress within six months outlining how the program will work. In addition, the legislation calls for the authorization of enough money to ensure that OSI "fulfills its continuing obligations regarding Nazi war criminals."

Wendy Patten, U.S. advocacy director for Human Rights Watch, praised the overall goals of the OSI legislation, which was sponsored by Rep. Mark Foley (R-Fla.) and has been under consideration in one form or another for five years.

But Patten said the office should work aggressively to ensure that suspected war criminals are not just deported, but are prosecuted for their crimes by other governments or, when appropriate, by international tribunals.

The statute calls on OSI to consider "appropriate legal action," including prosecutions here or overseas, although the U.S. government cannot directly prosecute someone for crimes committed outside its borders or jurisdiction.

"It's certainly important to ensure that people guilty of major human rights violations not enjoy a comfortable retirement in the U.S.," Patten said. "But it's equally important that they not enjoy a comfortable retirement elsewhere. . . . That's going to be the big question going forward: Will this new office be able to put an emphasis on prosecutions and not just deportations?"

Man arrested at Atlanta airport in stabbings spree

ATLANTA – A suspect in a string of 20 stabbings that terrorized people across three states and left five dead was arrested at an airport as he tried to board a plane for Israel, officials said Thursday.

A judge in Flint, Mich., where the attacks began in late May, signed a warrant Thursday charging Elias Abuelazam with assault with intent to murder in connection with a July 27 stabbing.

It was not clear if Abuelazam was the man arrested late Wednesday at Hartsfield-Jackson Atlanta International Airport.

That man, whom authorities have not named, was stopped while trying to board a Delta Air Lines flight to Tel Aviv, Israel, said Rafael Lemaitre, a spokesman at U.S. Customs and Border Protection.

Passengers on the flight said as they arrived Thursday in Tel Aviv that the suspect was arrested at the boarding gate shortly before takeoff. They said his name was called over a loudspeaker, and then six police officers led him away without incident.

The suspect has ties to Flint and to Leesburg, Va., the site of three similar attacks last week, Leesburg Police Officer Chris Jones said.

"While this is a key step in the investigation, there are still many issues that need to be addressed before we identify this individual as the person responsible for this horrific crime spree," Jones said.

The suspect is an Israeli citizen who is in the U.S. legally, according to a law enforcement official who spoke on the condition of anonymity due to the ongoing investigation.

Police had focused their hunt on Flint — where 16 stabbings took place — until Leesburg police reported three attacks. Authorities in Toledo, Ohio, say a stabbing in that city Saturday appears to be linked to the violent spree.

Atlanta authorities got involved when the suspect was arrested at the airport, said Atlanta Police spokesman Carlos Campos.

"It's not our investigation," he said. "We simply were involved in the apprehension."

The Israeli consulate in Atlanta was in touch with the U.S. government to get information about the case, spokeswoman Amanda Flaks said.

As of Wednesday afternoon, a task force led by the Michigan State Police and including the FBI had received 469 tips.

The attacks began surfacing in late spring, and picked up the pace as the stabber traversed the country.

Police have said they usually follow a pattern: The suspect approaches black men late at night on lonely urban roads and asks for directions or help with a broken-down car. Then, without warning, he pulls out a knife and strikes. Then, he speeds away in his vehicle, leaving them for dead.

The brazen nature and the frequency of the attacks — the assailant has struck an average of about once every four days since the first stabbing in May — has terrified some of those in cities he's already targeted.

The victims have been mostly black, and police suspect the attacks may have been racially motivated. The youngest victim was 17; the oldest was 60. They ranged in size from 5-foot-4 inches and 120 pounds to 6-foot-1 and 190 pounds.

1. Jamaate Islami was the only political party in 1971 whose central committe [Majlis-i-Shura] under the leadership of Gholam Azam, decided to organize a
Killing squads viz. Al-Bodor Bahini.  [Jamaat's Golam Azam, Nizami, Mujahid
gang was at the helm of violent Death Squad & collaborators that was in
"Active Duly" in the killing fields of 1971 Bangladesh ....].  Crimes against our
nation and crimes agaist humanity were committed by Jamaat in the name of
religion.
 
The Muslim League, Nezame Islami and  few other splinter groups  supported
the integrity of Pakistan but didn't organize any armed Death Squad with a
central party decision [although some of their members joined the razaker forces].
 
In 1971 Jamaate Islami was the only political group that had an killer wing
Al-bodor and was engagged in killing of innocent civillians and various other crimes against humanity and war crimes in 1971. 
 
Thus, by default, Jamaate Islami became the only political group that was
engaged in criminal violence and accessory to the genocides of 1971.
Jamaate Islami is the Party of the Traitors (Gadders).... and there
is no such thing as a Reformed Traitor .....Once a Gaddar, always
a Gaddar ......
 
2. The current govermnent  was duly elected through a democratic
process and has the legitimate right to set up it's priorities and
course of actions : That is the law of the land.....
 
The current government is a  government of the majority 
and the majority must be granted ..... that is way our system works ....
[obviously, the War Criminals will oppose the trial in their attempts
to evade Justice by fair means or faul ....... ]
 
3. Putting signature in favor of the constitution or abstaining from
putting the signature on the constitution is a (and was a)  part of the
due process and a constitutional right of the parliament/constitutional
assembly member.  If Suronjit had denied putting his signature on the
original 1972 constitution, how does that make him a criminal and
under what law, Mr. Mokhter Ahmed?
 
You really sound silly when you say Suronjit "is great criminal and his
crime against the constitution is ever greater than anyone. He should be
tried for that."...
 
Your innuendo  "Why Suronjet Sen was made the co-chair of the
constitution review committee?" is pure Nonsense & Grossly Fallacious
and quite unbecoming for an academician
 
Please don't think that we Bangladeshis are fools and you can create
murky waters by throwing these kinds of falacious logic ......
 
BTW, do you personally approve the spirit of 1972 Bangladesh
Constitution?
 
And since when you have become such an over-zealous-fan
[a zealot] of Bongobondhu that  you made you think,
any difference of opinion with Sheikh Mujib is a criminal

Do you really believe that? Or that is another facet of Jamaati

4. I am little skeptic about the idea of banning any political party just
based on it's ideology per se. However, all political parties must respect
the constitution and operate within the bounds of the constitution.
The traitors and  collaborators should not get any leeway in the name of
democracy. 
 
No one should be allowed to misuse religion and "religion-trading"
i.e use religion to mislead ordinary masses should not be permitted.....
 
Any political party that has historical record of collaborating with the
Yahia-Tikka regime and was actively engaged in aiding and abetting the
occupation regime as party and has organized armed Death Squads
like Al-Bodor Bahini should not be allowed to function.
 
In Europe, Nazi Party is completely abolished and declared to
be illegal. This ban has remains in place in Germany and many
other European countries to the present day. 
 
The Jamaate Islami's Anti-Bangladesh role and the
killing missions by it's armed Gestapo wing Al-Bodor Death
Squads makes this particular party nazi-equivalent in the
context of Bangladesh and our history .....
 
The operation of Jamaate Islami should be banned not
because it has a religious lebash, but for Jamaat's  role in war
crimes, crimes against Bangladesh, crimes against humanity
including aiding and abetting genocides and greatest mass
rapes in human history.....
 
 
5. Why only "famous and seasoned politicians earlier" has to be
ministers ..." ?
 
As a matter of fact the ruling parties should always include
new faces in the cabinet which, in essence,  may help to develop
that party's  future leaderships..... 
 
Of course, the a minister must be competent to do his/her job,
else the party in power will suffer in the long run...
 
In a parliamentary democracy the selection of cabinet members
is a complex balancing act ....[region, gender, expertise,
popularity within the party, loyality etc. ...]
 
Posing a question like "Does not it imply that they were picked up
by a third party for their interests?" is utterly motivated and
perhaps with insidious intents .....

We should think of the following issue before making any post in this popular blog:

1.      Is war crime a sole responsibility of a particular political party? Are not there any war criminals in Awami League? I know many are there and in other political parties. Why then the sole target is a particular political party?

2.      There is no consensus in Bangladesh about this trial. That particular party does have near about one crore vote bank, according to the estimate of EC. We voted 14 mohajot, which does not mean that we gave it a blank cheque to do anything. Before taking such a large-scale job, the govt. should seek referendum. A few papers and TV channels are not the sole standard to gauge people's feeling and perception in this case.

3.      Why Suronjet Sen was made the co-chair of the constitution review committee? He was the man who denied putting his signature on the original 1972 constitution despite being repeatedly asked by Bangobondhu and Bangobondhu's signature there. He is great criminal and his crime against the constitution is ever greater than anyone. He should be tried for that.

4.      Why should we allow the banning of any political party? Is politics a prerogative of any class? Is it banned in our model (?) countries like India and the West? In India many religion-based political parties are working like Shib Sena, BJP and hundred others. Even Christian Democratic Party (a religion-based party) is in power in Germany.

5.   Who are the ministers ruling Bangladesh now? Were they any famous and seasoned politicians earlier? Are they capable to defend the dignity of our motherland? Why this peculiar pick-up, the boneless people who even do not know the political decorum? Who were behind this choice? Sheikh Hasina, the Prime Minister? I think, none will believe it that she would dare to deny other seasoned politicians any space in her cabinet. Does not it imply that they were picked up by a third party for their interests?

 

I think many other issues we do have in our front now. We should concentrate on those rather than being exploited by the interests of the political parties.
