My Comment: Bangladesh's judiciery under Hasina rule playing a "double standatrd" game. If any incident goes aghainst the interest of ruling regime or ruling party's cadre are involved in any incedent ,
their(Judges) hands arte tied but if government wants to punish the opposition they become most obedient servants of the government. In this'burning case case', Justice Naima Haider and Justice Mohammad Khurshid Alom Shaorker showed
enough courage to deny the government's wintention of sending the bus buring case to a rapid jusstice tribunal(Druto Bichar Adalat)
In another incedent ruling party's stident cadres burned the historic stident hall at Sylhet and no action has been taken not a single hostel burner chatro league
cadre was arrested not charged. My understanding is that , the Prime Minister Sheikh Hasina doesnot approve any action against her 'Golden Boys" who burned the Sylhets historic MC
College Hostel with impunity.
We Bangladeshis became used to to watch such double standard for the last three and half years of Awmi misrule. Inshallah good days are coming when Awami Jaheliot will end
in Bangladesh aghain.


গাড়ি পোড়ানো মামলায় দ্রুত বিচার ট্রাইব্যুনালে আবেদন প্রত্যাহার

ঢাকা, ১৪ আগস্ট (রিয়েল-টাইম নিউজ ডটকম)-- হরতালে গাড়ি পোড়ানোর মামলা বিরোধী দলীয় নেতারা যে আদালতে বিচারাধীন, সেই দ্রুত বিচার ট্রাইব্যুনাল-৫ এর কার্যক্রমে স্থগিতাদেশ প্রত্যাহারের আবেদন কার্য তালিকা থেকে বাদ দিয়েছে হাইকোর্ট।

রাষ্ট্রপক্ষের এক আবেদনে মঙ্গলবার বিচারপতি নাঈমা হায়দার ও মুহাম্মদ খুরশীদ আলম সরকারের বেঞ্চ এই আদেশ দেয়।

রাষ্ট্রপক্ষে শুনানিতে অংশ নেন অ্যাটর্নি জেনারেল মাহবুবে আলম। তাদেরকে সহায়তা করেন, ডেপুটি অ্যাটর্নি জেনারেল মোখলেসুর রহমান, সহকারি অ্যাটর্নি জেনারেল ড. মো. বশির উল্লাহ।

রিট আবেদনকারী বিএনপি নেতা মাহবুব উদ্দিন খোকনের পক্ষে আদালতে ছিলেন ব্যারিস্টার রফিক-উল হক, ব্যারিস্টার মওদুদ আহমদ।

পরে খোকনের আইনজীবী ব্যারিস্টার রফিক-উল হক সাংবাদিকদের বলেন, অ্যাটর্নি জেনারেলের কথা অনুসারে আদালত আবেদনটি কার্য তালিকা থেকে বাদ দিয়েছে। এখন হাই কোর্টের স্থগিতাদেশ বহাল রইলো। আর তাদের আবেদনটির ভাগ্যে কি ঘটেছে, তা আদালত খোলার পর বুঝা যাবে।

অন্যদিকে অ্যাটর্নি জেনারেল মাহবুবে আলম সাংবাদিকদের বলেন, আদালত গঠন নিয়ে আমরা কয়েকটি গেজেট খুঁজে পেয়েছি। আরো কোন গেজেট আছে কি-না, তা খুঁজে বের করতেই আমরা আবেদনটি কার্য তালিকা থেকে বাদ দেওয়ার আবেদন করেছি।

এক প্রশ্নের জবাবে তিনি বলেন, আমরা প্রত্যাহারের আবেদনটি না চালনোর সিদ্ধান্ত নেইনি। বরং আরো কি করা যায়-তা ভেবে দেখছি।

আদালতের কার্যক্রমের উপর স্থগিতাদেশ প্রত্যাহারের আবেদনটি কার্য তালিকা থেকে বাদ যাওয়ায় ওই স্থগিতাদেশ অব্যাহত থাকবে। আগামী ছুটিতে বা ছুটির পরে আমরা আবেদনটি (স্থগিতাদেশ প্রত্যাহারের আবেদন) নিয়ে আবার অগ্রসর হবো।

আগামী ১৫ অগাস্ট থেকে সুপ্রিম কোর্টে টানা ছুটি শুরু হচ্ছে। জাতীয় শোক দিবস, ঈদ-উল ফিতর, বাত্সরিক ছুটি মিলিয়ে আগামী ৩০ সেপ্টেম্বর আদালত খুলবে। এ সময় হাই কোর্টের নিয়মিত আদালতগুলো বসবে না। তবে ২২ আগস্ট থেকে অবকাশকালীন বেঞ্চ বসবে।

বিএনপি নেতা ব্যারিস্টার মাহবুব উদ্দিন খোকন হাইকোর্টে একটি রিট আবেদন করলে গত ৬ আগস্ট বিচারপতি নাঈমা হায়দার ও মুহাম্মদ খুরশীদ আলম সরকারের বেঞ্চ ট্রাইব্যুনাল-৫ এর কার্যক্রমে আট সপ্তাহের স্থগিতাদেশ দেয়।

সেই সঙ্গে ওইদিন একটি রুলও জারি করে হাইকোর্ট। গেজেট জারি না করে মুখ্য মহানগর হাকিমের দেওয়া আদেশের মাধ্যমে ৫ নম্বর দ্রুত বিচার আদালত গঠন ও বিচারকের এখতিয়ার নির্ধারণ কেন অবৈধ এবং আইন-শৃঙ্খলা বিঘ্নকারী অপরাধ (দ্রুত বিচার) আইন-২০০২ এর ৮ ধারার সঙ্গে সাংঘর্ষিক ঘোষণা করা হবে না, তা জানতে চাওয়া হয় ওই রুলে।

গত ২৯ এপ্রিলের হরতালে গাড়ি পোড়ানোর ওই মামলায় বিএনপির ভারপ্রাপ্ত মহাসচিব মির্জা ফখরুল ইসলাম আলমগীরসহ বিরোধী দলীয় জোটের ৪৬ শীর্ষ নেতার বিরুদ্ধে অভিযোগ গঠন করে আদালত। ফখরুলসহ মামলার ৩৬ আসামি বর্তমানে জামিনে রয়েছেন।
