[chottala.com] Trial of Ghulam Azam

It seems that some people are shell shocked, disappointed and frustrated because of the arrest of Ghulam Azam. Why should someone who is 89 face such a humiliation they ask? Some questions the validity of ICT. Some wants his fair trial. Jamat has budgeted $25 million dollars initially, (this is documented)  to discredit this trial and wage a propaganda war within the country and internationally. There will be many beneficiaries of this big budget. Just for those interested below are two links of writings of former bureaucrat Mr. Waliur Rahman and Dr. Muntasir Mamoon, appearing in today's Daily Janakantha. Those interested may read it. I do not want any feedback nor any comments on it.

We  should give credit to Gen Zia for declaring our Independence no matter under who's order he did it.

Reality is that he was the one entrusted to declare our independence. History gave him this opportunity

Critics of Zia  like it or not,  he was not an ordinary Radio announcer as  few Awami believers  think.

His declaration definitely encourged our freedom fighters as well as freedom loving Bangladeshis, can you deny this fact ?

Final question ,were you born at that time ?

Again we are heading towards a controversy. We never deny the fact that
Zia had declared the Independence but he himself can not pronounce such
a historical announcement. He did not have such an ability, position
at that time.
He was not a political leader or a popular person familiar to the
people of Bangladesh.

In place of Ziaur Rahman if anybody else at that time would do the
same announcement our comment would have been the same. At that
particular period
Only the fittest person in all respect & acceptable to the people of
Bangladesh was Sk. Mujibur Rahmn , one & only the national leader of
that time .Again I would say, no one can declare the independence of a
nation.We must consider the time & moment. One can only read out a
script on behalf of a National leader if one is asked to do so.

So, I do not see any reason for an unnecessary controvery and all these.....

Why Gen Massoud the real player of past military takeover of Bangladesh still been employed by Hasina regime. When all co-conspirator of this militaryy takeover left the government as well as the conutry, why Gen Massoud still has been employed by Hasaina regime ? What's the deal ? Is there any secret past deal between Sheikh Hasina and Gen. Massoud ? Instead of receving extension Gen Massoud should receive court martial for his role for military takeover. How long Sheikh Hasina can protect Gen Massoud ? My inderstanding is that he will face court martial by any non-Awami government in coming days. Of course Awami League is the real benificiary of Gen Massoud's takeover and Hasina is rewarding this Gen for her own interest.         সোমবার, ০৯ জানুয়ারী ২০১২ বিশেষ প্রতিনিধি: হাইকমিশনার হিসেবে লেফটেন্যান্ট জেনারেল মাসুদ উদ্দিন চৌধুরীর চাকরির মেয়াদ আরও এক বছর বাড়ানো হয়েছে। তবে সেনাবাহিনী থেকে তাকে অবসরে যেতে হবে। বর্তমানে তিনি হাইকমিশনার হিসেবে অস্ট্রেলিয়ায় দায়িত্ব পালন করছেন। তাকে এবার চুক্তিভিত্তিক নিয়োগ দেয়া হলো। তার চাকরি থেকে অবসরের প্রক্রিয়া ইতিমধ্যে শুরু হয়েছে। সূত্র জানায়, পররাষ্ট্র মন্ত্রণালয় থেকে তার কাছে শিগগিরই প্রয়োজনীয় কাগজপত্র স্বাক্ষর করার জন্য পাঠানো হবে। তিনি স্বাক্ষর করে দিলেই তার সেনাবাহিনী থেকে অবসরের আনুষ্ঠানিকতা শেষ হবে। পাশাপাশি চুক্তিভিত্তিক নিয়োগের আনুষ্ঠানিকতা সংক্রান্ত নথিপত্র স্বাক্ষর করে পররাষ্ট্র মন্ত্রণালয়ে পাঠাবেন। সূত্র জানায়, প্রধানমন্ত্রী শেখ হাসিনা তার এক বছরের চুক্তিভিত্তিক নিয়োগের বিষয়টি অনুমোদন দেন বৃহস্পতিবার। মাসুদ উদ্দিন চৌধুরী ১৯৭৫ সালে সেনাবাহিনীতে কমিশন লাভ করেন। সেনাবাহিনীতে প্রায় ৩৫ বছর চাকরি করলেন। তার চাকরির মেয়াদ বাড়তে পারে- এমন গুঞ্জন ছিল বেশ কিছুদিন ধরেই। অবশেষে সেই গুঞ্জনের সমাপ্তি হলো। এর আগে সরকারের তরফ থেকে দুই দফা তার চাকরির মেয়াদ বাড়ানো হয়েছে। সূত্র জানায়, তার চাকরির মেয়াদ বাড়ানোর ফাইল গত মাসের দ্বিতীয় সপ্তাহে প্রধানমন্ত্রীর কাছে উপস্থাপন করা হয়। এ প্রক্রিয়ার সঙ্গে সংশ্লিষ্ট একটি সূত্র জানায়, প্রধানমন্ত্রী তাকে এক বছরের চুক্তিভিত্তিক নিয়োগ দিলেও প্রথমে তার পরিকল্পনা ছিল ২৯শে ডিসেম্বরের পর তার চাকরির মেয়াদ সেনাবাহিনীতে রেখেই ছয় মাস বাড়ানো হবে। এরপর ছয় মাস শেষ হলে তাকে অবসরে পাঠিয়ে পরে দুই থেকে তিন বছরের জন্য হাইকমিশনার হিসেবে চুক্তিভিত্তিক নিয়োগ দেয়া হবে। এ নিয়ে বেশ কিছুদিন ধরেই আলোচনা ছিল। কিন্তু শেষ পর্যন্ত তা হয়নি। কারণ জেনারেল মাসুদকে সেনাবাহিনীতে রেখে চাকরির মেয়াদ বাড়ানোর ব্যাপারে বিরোধিতা করেন একটি অংশ। এ কারণে প্রধানমন্ত্রী ওই সিদ্ধান্ত থেকে সরে আসেন। পরে তিনি ঠিক করেন তাকে দুই থেকে তিন বছরের জন্য চুক্তিভিত্তিক নিয়োগ দেয়ার। কিন্তু তাতেও বাদ সাধেন তারা। এক বছরের উপরে কোনভাবে বাড়ানো যাবে না এমন যুক্তিতেই পরে প্রধানমন্ত্রী তার চাকরির মেয়াদ এক বছর বাড়ান। নতুন নিয়োগের কারণে তিনি আরও এক বছর হাইকমিশনার হিসেবে দায়িত্ব পালন করবেন। বর্তমানে তিনি অস্ট্রেলিয়াতে রয়েছেন। সেখানে তার স্ত্রী জেসমিন মাসুদ ছাড়াও এক ছেলে এক মেয়ে তাদের সঙ্গে থাকেন। আর বড় মেয়ে সপরিবারে কানাডা প্রবাসী।

Asslamualaikum. There shouldn't be any question in regards with the war crime trial. However, it must occur in a free and fair way.

 

Why the court is being called as International tribunal court where it has nothing international about it and why the accused are not even allowed to hire their lawyers!

 

Sir, I'm not sure why current govt and people like you are so afraid of a free and fair trial.

Please do not confuse people. Ghualm Azam was tried for restoration of his nationality and not for the crimes. Two are absolutely different issue. He never face trial for crimes he committed in 1971.

Golam Azam was tried before once. The verdict was given by famous and former Chief Justices, Habibur Rahman, Latifur Rahman, ATM Afzal, Mustafa Kamal. Again he was arrested for the almost same reasons, same allegations in nature.

 

Do you think the way current ICT is moving (Sayedi's trial is a best example), he or any Jamat leaders will get justice?

জামাতের রাজনীতির সাথে আমি জীবনেও জড়িত ছিলাম না। কিন্তু একটা জিনিস আমি কিছুতেই মেলাতে পারছি না, যে কোন মানুষের বিচার একবার হয়ে গেল তার আবার কিভাবে বিচার হয় সেই একই অপরাধে?


১৯৯৪ সালের ২২ জুন দেয়া ৫৪ পৃষ্ঠার রায়ে গোলাম আযম সম্পর্কে ১৯৭১ সালের অভিযোগ নাকচ করে দিয়ে বিচারপতিদের করা মন্তব্য ছিল এ রকম : There is nothing to directly implicate the petitioner (Golam Azam) in any of the atrocities alleged to have been perpetrated by the Pakistani Army or their associates the Rajakars, AL Badrs or the AL Shams. Except that the petitioner was hobnobbing with the Military Junta during the war of liberation, we do not find anything that the petitioner was in any way directly involved in perpetuating the alleged atrocities during the war of independence.

'১৯৭১ সালে মুক্তিযুদ্ধ চলাকালে যেসব বর্বরতার অভিযোগ রয়েছে, তা সংঘটনের সাথে অধ্যাপক গোলাম আযম কোনোভাবে সরাসরি জড়িত ছিলেন, এমন কোনো কিছু আমরা পাইনি।'
১৯৯৪ সালে জামায়াতে ইসলামীর সাবেক আমির অধ্যাপক গোলাম আযমের নাগরিকত্ব ফিরিয়ে দেয়ার বিষয়ে দেশের সুপ্রিম কোর্টের আপিল বিভাগের রায়ে এ কথা উল্লেখ রয়েছে।
রায়ে আরো উল্লেখ করা হয়, 'পাকিস্তানি আর্মি ও তাদের সহযোগী বাহিনী রাজাকার, আলবদর কিংবা আলশামসের বিরুদ্ধে ১৯৭১ সালে যেসব বর্বরতার অভিযোগ রয়েছে, তার একটির সাথেও অধ্যাপক গোলাম আযমের সরাসরি কোনো সম্পর্ক নেই।'
আপিল বিভাগের তৎকালীন বিচারপতি হাবিবুর রহমান, বিচারপতি এ টি এম আফজাল, বিচারপতি মুস্তাফা কামাল ও বিচারপতি লতিফুর রহমান এ ঐতিহাসিক রায় দেন। এই চার খ্যাতিমান বিচারপতির সবাই পরে বাংলাদেশের প্রধান বিচারপতির আসন অলঙ্কৃত করেন এবং তাদের মধ্যে বিচারপতি হাবিবুর রহমান ও বিচারপতি লতিফুর রহমান তত্ত্বাবধায়ক সরকারের প্রধান উপদেষ্টা নির্বাচিত হয়েছিলেন।

অথচ কারাগারে গোলাম আযমকে পাঠানো হল ওই একই অভিযোগে!


যেখানে বাঘা বাঘা বিচারপতিরা পর্যন্ত উনার সাথে মানবতাবিরোধী অপরাধের যোগসূত্র খুঁজে পাননি, সেখানে এই চুনোপুঁটিরা কি করবে? সেখানে কি কোন ন্যায়বিচার হবে? আসামীর ন্যায়বিচার রক্ষা করতে না পারলে তো সেদেশে আইন বলে কিছু থাকতে পারে না। আর আইন না থাকা মানে দেশ ধ্বংস হওয়া। আসামী মানেই তো অপরাধী না যতক্ষণ পর্যন্ত না তা প্রমাণিত হয়।

হয়তো এ কারনেই ৮৯ বছরের এই প্রবীন রাজনীতিক বারে বারে বলেছেন, শহীদী মৃত্যু সব মুমিনের বড় পাওয়া। হয়তো উনি জেনে গেছেন এই সরকার যেনতেনভাবে জামাত নেতাদের ফাঁসিতে চড়াবে। জীবনে উনি রাজনীতির অনেক টালমাটাল দেখেছেন, কিন্তু এত বেয়াদবের সরকার হয়তো জীবনে দেখেন নি। আর সেজন্যই বলছেন, বিছানায় শুয়ে শুয়ে মরার চেয়ে শহীদী মৃত্যু অনেক উত্তম। বাবারে গা শিউরে উঠে সাহস দেখে! অন্ততঃ গোলাম আযমের শত্রু আওয়ামী লীগের উচিত হবে না তার আকাংখিত শহীদী মৃত্যু আলিংগনের সুযোগ দেয়া!

সাঈদী সাহেবেরটাও তো ওদিকেই যাবে। চোর-বাটপারদের সাক্ষী-সাবুদ করা হলেও দেখা যাবে ফাঁসির রায় কেউই ঠেকাতে পারছে না। ট্রাইব্যুনালের বিচারপতিরা ঠিকই সরকারের আইজিপির মত (সরকার যে উদ্দেশ্য নিয়ে ক্ষমতায় এসেছে তা বাস্তবায়ন করবো: আইজিপি বিস্তারিত পড়ুন এখানে ) সরকারের উদ্দেশ্য বাস্তবায়ন করেই ছাড়বে। কারণ সেজন্যই এসব অযোগ্যদের ধরে ধরে বিচারপতি নিয়োগ দেয়া হয়েছে আর প্রসিকিউটরও বানানো হয়েছে বাছুড়দেরকে যেটা কাদের সিদ্দিকী বলেছিলেন। জামাতের তূখোড় আইনজীবিদের কাছে এরা কিছুই না। শাহরিয়ার কবিরও সেটা স্বীকার করেছেন।

ঠিক এভাবেই জামাত নেতাদেরকে এভাবে ফাঁসি দেয়া হবে।

Golam Azam was tried before once. The verdict was given by famous and former Chief Justices, Habibur Rahman, Latifur Rahman, ATM Afzal, Mustafa Kamal. Again he was arrested for the almost same reasons, same allegations in nature.

জামাতের রাজনীতির সাথে আমি জীবনেও জড়িত ছিলাম না। কিন্তু একটা জিনিস আমি কিছুতেই মেলাতে পারছি না, যে কোন মানুষের বিচার একবার হয়ে গেল তার আবার কিভাবে বিচার হয় সেই একই অপরাধে?


১৯৯৪ সালের ২২ জুন দেয়া ৫৪ পৃষ্ঠার রায়ে গোলাম আযম সম্পর্কে ১৯৭১ সালের অভিযোগ নাকচ করে দিয়ে বিচারপতিদের করা মন্তব্য ছিল এ রকম : There is nothing to directly implicate the petitioner (Golam Azam) in any of the atrocities alleged to have been perpetrated by the Pakistani Army or their associates the Rajakars, AL Badrs or the AL Shams. Except that the petitioner was hobnobbing with the Military Junta during the war of liberation, we do not find anything that the petitioner was in any way directly involved in perpetuating the alleged atrocities during the war of independence.

'১৯৭১ সালে মুক্তিযুদ্ধ চলাকালে যেসব বর্বরতার অভিযোগ রয়েছে, তা সংঘটনের সাথে অধ্যাপক গোলাম আযম কোনোভাবে সরাসরি জড়িত ছিলেন, এমন কোনো কিছু আমরা পাইনি।'
১৯৯৪ সালে জামায়াতে ইসলামীর সাবেক আমির অধ্যাপক গোলাম আযমের নাগরিকত্ব ফিরিয়ে দেয়ার বিষয়ে দেশের সুপ্রিম কোর্টের আপিল বিভাগের রায়ে এ কথা উল্লেখ রয়েছে।
রায়ে আরো উল্লেখ করা হয়, 'পাকিস্তানি আর্মি ও তাদের সহযোগী বাহিনী রাজাকার, আলবদর কিংবা আলশামসের বিরুদ্ধে ১৯৭১ সালে যেসব বর্বরতার অভিযোগ রয়েছে, তার একটির সাথেও অধ্যাপক গোলাম আযমের সরাসরি কোনো সম্পর্ক নেই।'
আপিল বিভাগের তৎকালীন বিচারপতি হাবিবুর রহমান, বিচারপতি এ টি এম আফজাল, বিচারপতি মুস্তাফা কামাল ও বিচারপতি লতিফুর রহমান এ ঐতিহাসিক রায় দেন। এই চার খ্যাতিমান বিচারপতির সবাই পরে বাংলাদেশের প্রধান বিচারপতির আসন অলঙ্কৃত করেন এবং তাদের মধ্যে বিচারপতি হাবিবুর রহমান ও বিচারপতি লতিফুর রহমান তত্ত্বাবধায়ক সরকারের প্রধান উপদেষ্টা নির্বাচিত হয়েছিলেন।

অথচ কারাগারে গোলাম আযমকে পাঠানো হল ওই একই অভিযোগে!


যেখানে বাঘা বাঘা বিচারপতিরা পর্যন্ত উনার সাথে মানবতাবিরোধী অপরাধের যোগসূত্র খুঁজে পাননি, সেখানে এই চুনোপুঁটিরা কি করবে? সেখানে কি কোন ন্যায়বিচার হবে? আসামীর ন্যায়বিচার রক্ষা করতে না পারলে তো সেদেশে আইন বলে কিছু থাকতে পারে না। আর আইন না থাকা মানে দেশ ধ্বংস হওয়া। আসামী মানেই তো অপরাধী না যতক্ষণ পর্যন্ত না তা প্রমাণিত হয়।

হয়তো এ কারনেই ৮৯ বছরের এই প্রবীন রাজনীতিক বারে বারে বলেছেন, শহীদী মৃত্যু সব মুমিনের বড় পাওয়া। হয়তো উনি জেনে গেছেন এই সরকার যেনতেনভাবে জামাত নেতাদের ফাঁসিতে চড়াবে। জীবনে উনি রাজনীতির অনেক টালমাটাল দেখেছেন, কিন্তু এত বেয়াদবের সরকার হয়তো জীবনে দেখেন নি। আর সেজন্যই বলছেন, বিছানায় শুয়ে শুয়ে মরার চেয়ে শহীদী মৃত্যু অনেক উত্তম। বাবারে গা শিউরে উঠে সাহস দেখে! অন্ততঃ গোলাম আযমের শত্রু আওয়ামী লীগের উচিত হবে না তার আকাংখিত শহীদী মৃত্যু আলিংগনের সুযোগ দেয়া!

সাঈদী সাহেবেরটাও তো ওদিকেই যাবে। চোর-বাটপারদের সাক্ষী-সাবুদ করা হলেও দেখা যাবে ফাঁসির রায় কেউই ঠেকাতে পারছে না। ট্রাইব্যুনালের বিচারপতিরা ঠিকই সরকারের আইজিপির মত (সরকার যে উদ্দেশ্য নিয়ে ক্ষমতায় এসেছে তা বাস্তবায়ন করবো: আইজিপি বিস্তারিত পড়ুন এখানে ) সরকারের উদ্দেশ্য বাস্তবায়ন করেই ছাড়বে। কারণ সেজন্যই এসব অযোগ্যদের ধরে ধরে বিচারপতি নিয়োগ দেয়া হয়েছে আর প্রসিকিউটরও বানানো হয়েছে বাছুড়দেরকে যেটা কাদের সিদ্দিকী বলেছিলেন। জামাতের তূখোড় আইনজীবিদের কাছে এরা কিছুই না। শাহরিয়ার কবিরও সেটা স্বীকার করেছেন।

Attack on most popular critic of Hasina regime  respected Professor of Dhaka University Asif Nazrul's office was expected from the fascist  regime of Sheikh Hasina.

It is known to all of us that, Professor's criticism of Hasina regime won't be tolerated by a fascist Hasina.
Hasina doesnot  tolerate any criticism like her late father.

The way another critic Amar Desh Editor Mahmudur Rahman was punished, Professor Asif Nazrul will face similar fate, even he might be abduccted or killed by notorious

RAB. Nation nis worried bout his fate. Attack on his office was a clear warning from the fascist regime to stop criticism of Hasina tegimeted/killed  by government regime force, Sheikh Hasina government should take responsibility. It's Hasina regimes duty to protect this professor's life for the greater interest of the republic.

I  condemn such attack and seek punishment for the criminals.
