SHARJAH // The mothers of two babies abandoned in a mosque earlier this year in Sharjah have been arrested.

A Somali imam on his way to morning prayers discovered the infants, born to different mothers, in March. Three of their parents, including both mothers, were apprehended in Dubai in a joint police effort and handed over to Sharjah police, said Col Abdullah al Dukhan, the Sharjah police deputy director general. The other father has reportedly absconded.

"It was really unusual for the two babies to be found abandoned at the same time in the same place," he said. "The babies were unrelated but all along we thought there was some kind of relationship or conspiracy among parents."

The Dubai General Directorate of Residency and Foreign Affairs helped identify the mother of the abandoned five-month-old boy as the Filipina maid PP. She allegedly fled her sponsor's home when pregnant and the sponsors reported the incident to authorities. She confessed to leaving her baby in the mosque and said she had been following media reports to keep up with the boy's welfare, police said.

After being apprehended PP was questioned about the second baby boy, who was six weeks old when abandoned. She said he belonged to AAA, another maid with whom she was sharing accommodations and who was then arrested.

Police said both women said their children were fathered by Bangladeshi workers, and said they had no means to look after their babies and were afraid of prosecution after having engaged in illegal sex.

AAA said her baby's father was a Bangladeshi national working as a labourer, according to police. The man was later apprehended. PP told police her infant's father was a Bangladeshi national who had fled the country after learning she was pregnant.

"Immorality is at its peak now and all these are the consequences of adultery," said Col al Dukhan.

Police continued to follow up on their well-being as they searched for the parents. Like most children found in the emirate, the two infants were transferred immediately to hospital, their first stop in a process that could eventually see them placed with foster families. The infants have now been shifted from the Al Qassimi Hospital to a social care centre, where they are said to be doing well.

The three parents have been referred to public prosecutors, Col al Dukhan said. The babies, named Khaled and Omar by their carers, may eventually be reunited with their parents if all the proper procedures are followed.

The courts will decide whether the parents should be punished for illegal sex and whether they should get their children back, should they want them. If they do not want them, they will have to say so in court and the trial judge will decide their fate.

There have been several instances of child abandonment in the northern emirates in recent years. Two babies were discovered in Ajman and Ras al Khaimah last February. Ajman police later arrested the unmarried parents of a three-month-old girl, who were charged with adultery and endangering the baby's life. Another two babies were found abandoned outside Sharjah mosques last year. Sharjah officials say they have developed a system to cope with the dozen or so cases they deal with every year.

The poison of General Zia's bigotry has spread like a cancer in Pakistan's body politic. Had he not emerged on the scene, it is possible that Pakistan would have taken the regular course of a confessional state to a modern, inclusive and democratic state

Bravo. Bangladesh has done it. It has successfully reversed the cynical Islamisation of its local General Zia. Not only is one fortified by their action that a Muslim majority nation state is capable of rolling back the Islamist project but as a Pakistani I am glad that at least some part of the former original Pakistan is now firmly allied with the principles that Jinnah laid down in his famous August 11, 1947 speech.

Bengalis have never been any less proud as Muslims than Pakistanis. Say what they may, champions of the so-called ideology of Pakistan cannot deny that had it not been for peasant nationalism in Bengal, the Pakistan movement would have fallen flat on its face. While opportunistic landowners jumped onto the Pakistan bandwagon in what became West Pakistan, it was the common man in the then East Pakistan who waged the struggle for a new nation. It may also be remembered that Huseyn Shaheed Suhrawardy, the founder of the Awami League, was also one of the founding fathers of Pakistan and that the Awami League was, at one point in its history, the Jinnah Awami Muslim League.

In 1965, when the Quaid-e-Azam's sister rose to take on a dictator, it was again East Pakistan that rallied to her cause. And how did we pay them back? I do not wish to go into the atrocities of 1971.

One of the many steps taken by this new confident and independent People's Republic of Bangladesh is the banning of Maulana Maududi's hate-filled literature. Maulana Maududi is widely disliked in Bangladesh for his role against the Bengalis. There are some who object to this decision on grounds of 'freedom of speech'. Well sirs, mind telling us where is the freedom of speech for non-Muslim minorities? It is quite like how some years ago many of our proud Pakistani Muslims defended Yousaf Youhanna's conversion to Islam on the grounds of freedom of religion. And then someone asked, "What if he converts back to Christianity?" Silence.

What is sad, however, is that Maududi's abuse against Pakistan and its founding father far outweighs his abuse against Bangladesh and yet Pakistan continues to tolerate Maududi's legacy. Much of his horrendous abuse against the Quaid-e-Azam has been documented in detail. What is more, Maududi and his party openly supported usurper General Zia's illegal military dictatorship.

The truth is that under the 1973 Constitution, a complete separation of church and the state may not be immediately possible, but if Pakistan can undo General Zia's legacy, it will become a much better place to live in. For us, it is an urgent undertaking. We have now learnt that the dead body of Prem Chand, who died in the Margalla plane crash, was marked 'Kafir'. Is there no end to such bigotry? Some might argue that this is because we asked for a Muslim majority state and a partitioned India. Be that as it may, it bears repeating that Jinnah tried very hard to keep Hindus safe and secure in Pakistan and his efforts paid off partially in Karachi. He also spoke of non-Muslim Pakistanis as being equal Pakistanis and having the closest association with the rest of Pakistan. Today, the minorities are marked separately as if they are less human, let alone less Pakistani.

To drive the message of equality and inclusiveness of Pakistani identity home, Jinnah appointed as his law minister Mr Jogindranath Mandal, a Bengali scheduled caste Hindu, and got Jagganath Azad, a Hindu Urdu poet, to write Pakistan's first national anthem. Mr Azad had to escape for his life soon afterwards when things became unbearable for the Hindus in Lahore and soon after Jinnah's death Mr Mandal was driven out. A transcript of Mandal's signed statement is readily available on the internet. It is nothing less than heartbreaking for a Pakistani who wants to see this flag flying high.

Perhaps the founding fathers should have been more militant in their secularism given that they had gotten the state by mobilising a religious identity, like Kemal Ataturk and Ismet Inonu did in Turkey. Their Turkish nationalism grew out of the group identity of Muslims of Anatolia and Thrace and they deployed Islam to mobilise the Turks, Kurds, Macedonians and even the Arabs living in Anatolia during the war of independence in a much more blatant fashion than the founding fathers of Pakistan. Yet, after the emergence of the modern Turkish Republic, Ataturk and Inonu began to redefine Turkish nationalism in completely secular terms. Consequently, even Turkish Jews are Turks before they are Jews.

In stark contrast to Turkey, especially after Jinnah, Pakistani secularism has met with one defeat after another. We are now at a point in our history that the highfalutin articles of the constitution protecting religious freedom in Pakistan have been defeated in the courts of law. Pakistan may have ratified the International Convention on Political and Civil Rights, but in reality the application of this is impossible unless of course Pakistan's leaders realise the urgency of the matter.

The poison of General Zia's bigotry has spread like a cancer in Pakistan's body politic. Had he not emerged on the scene, it is possible that Pakistan would have taken the regular course of a confessional state to a modern, inclusive and democratic state. While Islamisation was always a going concern in Pakistan since the Objectives Resolution, it was General Zia who ensured that it would always be negative and exclusionary, catering to the Maududian ideology. Pakistan must decisively roll back General Zia, taking a cue from Bangladesh, and declare all the changes inflicted on the legal and constitutional system of Pakistan from Zia's coup to that grand explosion in the sky, null and void. This would give Pakistan a fighting chance to slowly dig itself out of the hole it has dug itself into.

Remember the war against the Taliban is a generational undertaking. It will be fought in our schools, colleges and courts for the next 50 years. Let us prepare for the battle by learning from Bangladesh.

AHM Noman Khan, founder and executive director of Centre for Disability in Development (CDD), has won Ramon Magsaysay Award 2010 for his relentless efforts for the rights of the challenged.
Six other Asians -- Tadatoshi Akiba of Japan, Christopher Bernido and Ma. Victoria Carpio-Bernido of the Philippines, and Huo Daishan, Pan Yue and Fu Oiping of China -- have also received the prestigious award this year for their contribution in different fields.
Noman Khan is the ninth Bangladeshi to win the award regarded as Asia's equivalent to Nobel prize.
The Ramon Magsaysay Foundation featured Noman Khan as a pioneer mainstreaming the challenged in the development process of Bangladesh and working vigorously with all sectors to build a society that is truly inclusive and barrier free.
There are around 13 million physically and mentally challenged people in Bangladesh, a country where being challenged is considered a charity or social welfare issue, not rights, the foundation observed.
In his first reaction to winning the award, Noman Khan told The Daily Star, "It was a surprise. This is an achievement of my organisation as we the members of CDD work like a family."
"The award will promote rights of the challenged and encourage those who work in the field," said an elated Noman, adding that perhaps this was the first time that the award had focused on the challenged.
In a meeting with his colleagues at CDD, Noman Khan announced to donate the prize money for the welfare of the challenged through his organisation.
"The money will be spent for the welfare of the disabled and we will sort out a way to use the fund," said Noman.
The prize money is $50,000, worth about Tk 34 lakh.
Noman founded CDD in 1996 along with seven colleagues in the development field based on the concept "community-based rehabilitation" (CBR).
Later, the organisation devised a strategy Community Approaches to Handicap in Development (CAHD) to encourage communities to address the needs and rights of a challenged person and capacity building of NGOs to include these issues in their development work.
CAHD has been adopted in Nepal, India and the Philippines. CDD has also shared the strategy with organisations from Pakistan, Cambodia, China, Sri Lanka, Thailand, Indonesia, Japan, England, Germany, and many more countries.
Besides training development workers, CDD has developed Bangla Braille software and sign language. The organisation produces low-cost books and slate for the visually impaired and campaigns for the challenged people's access to information and communication technology.
The other Ramon Magsaysay laureates include Prof Muhammad Yunus, Editor of the daily Prothom Alo Matiur Rahman, Brac Chairman Fazle Hasan Abed, Founder of Bishwa Sahitya Kendra Prof Abdullah Abu Sayeed and Jafarullah Chowdhury .
OTHER RECIPIENTS
Tadatoshi Akiba has won the prize for his campaign to create a world free of nuclear war while Christopher Bernido and Ma. Victoria Carpio-Bernido jointly for ensuring innovative, low cost and effective basic education even under Filipino condition of great scarcity and daunting poverty.
Huo Daishan was awarded the prize for his relentless effort to save the river Huai in China and the people dependant on it while Pan Yue and Fu Oiping for their exemplary vision and zeal in advocating the inseparability of development and improving Chinese people's standard of living.
AHM Noman Khan, a citizen of Bangladesh, is among the seven individuals who were awarded Asia's premier prize, the Ramon Magsaysay Award for 2010.
The Board of Trustees of the Ramon Magsaysay Award Foundation (RMAF) on Monday made the announcement saying that this year seven individuals from Bangladesh, China, Japan, and the Philippines will receive the prestigious award.
The Awardees are:
AHM Noman Khan, from Bangladesh. He is being recognised for "his pioneering leadership in mainstreaming persons with disabilities in the development process of Bangladesh, and in working vigorously with all sectors to build a society that is truly inclusive and barrier-free. "
Tadatoshi Akiba, from Japan. He is being recognised for "his principled and determined leadership in a sustained global campaign to mobilize citizens, pressure governments, and build the political will to create a world free from the perils of nuclear war."
Christopher Bernido and Ma Victoria Carpio-Bernido, from the Philippines. They are being recognised for "their purposeful commitment to both science and nation, ensuring innovative, low-cost, and effective basic education even under Philippine conditions of great scarcity and daunting poverty."
Huo Daishan, from China. He is being recognised for "his selfless and unrelenting efforts, despite formidable odds, to save China's great river Huai and the numerous communities who draw life from it."
Pan Yue and Fu Qiping, from China. They are being recognised for "their exemplary vision and zeal, as public servants at two levels of the state bureaucracy, in advocating the inseparability of development and the environment in uplifting the lives of the Chinese people." Specifically, Pan Yue is being cited for "his bold pursuit of a national environmental program, insisting on state and private accountability, encouraging state-citizen dialogue, and raising the environment as an issue of urgent national concern." Fu Qiping is being cited in particular for "his enterprising leadership and undeniable success in demonstrating how village-level economic development can be achieved without damage to the environment. "
Established in 1957, the Ramon Magsaysay Award is Asia's highest honour and is widely regarded as the region's equivalent of the Nobel Prize. It celebrates the memory and leadership example of the third Philippine president, and is given every year to individuals or organisations in Asia who manifest the same sense of selfless service that ruled the life of the late and beloved Filipino leader.
"The Magsaysay awardees of 2010," says RMAF President Carmencita T Abella, "are seven remarkable individuals deeply engaged in reinventing the future for a better Asia, tapping into and strengthening the power of community. Working on critical issues that impact not only their respective countries, but indeed, all of Asia, they are showing how commitment, competence, and collaborative leadership can truly transform individual lives and galvanize community action."
"Their concerns are clearly quite diverse - nuclear disarmament, basic education, river pollution, disability in development, environmental protection, village prosperity. But there is one thing this year's Magsaysay laureates share: a greatness of spirit which infuses their leadership for change. They all build collaboration and seek consensus wherever possible. They all refuse to give up, despite adversity and opposition."
"Three of the awardees share a passionate concern for the environment, which the Foundation continues to give special attention to at this time."
The seven 2010 Magsaysay awardees join 277 other laureates who have received Asia's highest honor to date.
This year's Magsaysay Award winners will each receive a certificate, a medallion bearing the likeness of the late president, and a cash prize.
They will be formally conferred the Magsaysay Award during the Presentation Ceremonies to be held on 31 August 2010 at the Cultural Center of the Philippines, to which the public is cordially invited.

On why Jamaat-e-Islami does not deserve our sympathy                                                           

Without referring to the events of 1971 and the allegations of war crimes offences leveled against several Jamaat-e-Islami (JeI) leaders I would like to draw the reader's attention to other aspects of this case since the charges framed against the five accused remain to be proved and we should not preempt the findings of a court of law. The JeI finds itself in this present predicament solely out of its own doing and cannot blame anyone but itself. Its decision to participate and pressure the BNP to join in the 2008 elections against the better judgment of Khaleda Zia led to the Awami League gaining an overwhelming majority in Parliament which they are now using to their full advantage. That the elections might be rigged or manipulated under the dubious stewardship of Gen. Moin U. Ahmad never seems to have occurred to the JeI leaders. This single act of stupidity sealed the fate of the party and its five senior most leaders who are now languishing in jail.  

That the JeI had been repeatedly warned that the AL would achieve at least a two-thirds majority in the elections was ridiculed with the reply that under a democracy there would be limitations on what a majority government could do. It seems the JeI did not learn from the experience of the AL governments of 1972-1975 and 1996-2001 in which the party almost managed single handedly to ruin and decimate the country and in the latter case without even possessing a two-thirds majority.  The JeI's decision to participate in the elections was an act of pure selfishness and opportunism merely to take advantage of the weakened position of the BNP and to humour it's foreign backers in the West and the Middle East. Had the JeI and BNP boycotted the elections the illegal and unconstitutional Caretaker Government of Fakhruddin Ahmed would never have achieved even partial (prospective) legitimacy and the AL could not have carried out its political programme without sustained and credible opposition.  Unfortunately due to JeI's horrendous miscalculation and ineptitude the AL is able to brandish the label of a democratically elected government while systematically curtailing the people's rights, repressing the opposition and engaging in massive corruption. This is the elected dictatorship that Gen. Moin U. Ahmed had warned us about in one of his controversial speeches but that was before he delivered the country to the AL (and India) in true Mir Jafor fashion.  

The obvious reason for the JeI's political immaturity and incompetence is that while internally democratic it is ideologically and doctrinally rigid and is therefore incapable of absorbing outside opinion. Primarily for this reason many of its leaders and supporters suffer from intellectual arrogance and a certain pompousness in character such as Motiur Rahman Nizami, Delwar Hossain Sayeedi and Mahmudur Rahman, none of whom are original thinkers. Even after the election debacle the top leaders of the party were allowed to retain their positions. This last point proves that the JeI cannot be reformed and so no one should be surprised that there was no outburst after the arrest of its leaders as the monolithic structure of the party cannot quickly adapt to the new situation.  

In conclusion one may ask if the JeI has a right to our sympathy regardless of what may have been their involvement in the events of 1971.  My answer is no. Does the party deserve our condemnation? My answer is an unreserved yes. Should we nevertheless support the JeI? My answer is still no. Should we accept JeI help in saving the country from the fascist AL? My answer is yes but they will remain the junior partners whether they like it or not. The only question mark remains over the viability of the BNP which is heavily infiltrated with Indian stooges. I feel it unlikely that the BNP will be able to sustain a movement against the government unless it removes most of its top leadership and only after it takes a strong stand against Indian encroachment in Bangladesh. Unless it takes a principled stand on the last issue it will merely be viewed as the C Team of India after Sheikh Hasina's A Team and Sheikh Rehana's B Team.

The Al-bodor organizers justified the killing of innocent unarmed
civillians in the name of religion ....

will raise our national conscience to another higher level and is a
must without further delay ......

Punishment of criminals masquqreding under religious cover
is a first step in  right direction. It will definitely improve the
general law & order  situation of the right direction: All
criminals must  realise  that they will be eventually
punished, no matter  under what cover it is committed....

it is one of our nation's  TOP Priority ....

In todays' context the trials of 1971-death squad organizers is an internal
issue in Bangladesh, based on people's demand and election mandate.
 
Oh yes, " The victims of 71 are raising their Voices" from the graves :
the pains of the families for their loved ones
and  our nation's obligation and indebtness for the sons of the soil who gave
their lives in the hands of collaborators and Al-bodor cum Razaker death
squads has made the trial issue alive again.
 
The past is never dead. It's not even past....... the killers are still alive and
right inside Bangladesh kicing and laughing !!!!!!!!!! These are the people
who kicked us in the abdomen during our Liberation War ........
but we survived .... we achieved our victory on 16th December 1971.
 
[some analysts have suggested that,  for Jamaat's diaster the
election month of  December was an important factor factor !]
 
(1)Trials of  Al-bodor and Razakar death squads,  and

The mass killings in Bangladesh in 1971 is the most concentrated act of genocide in the twentieth century. In an attempt to crush forces seeking independence for Bangladesh , the Pakistani military regime unleashed a systematic campaign of mass murder which aimed at killing millions of Bengalis, and likely succeeded in doing so. Three million people were killed, 200,000 women raped during nine month period of time. Some Bengalis, who called themselves the Razakars, Al Badars & Al Shams, joined hands with the occupying Pakistan Armed Forces in the killing game. Many of them are now leaders in Bangladesh Jamaat-e-islami Party. Recently some of them even denied their involvement in this mass murder.

The International Crimes (Tribunals) Act 1973 (ICA), promulgated on July 20, 1973 empowers the government to try individuals on specific charges of crimes against humanity and peace, genocide, war crimes, violation of the Geneva Convention and international laws, for assistance or conspiracy to commit such crimes, and for failure to prevent commissioning of such crimes.

The present government already set up a tribunal under the act which is still applicable, as the general amnesty granted to war criminals by Bangabandhu Sheikh Mujibur Rahman in 1973 does not apply to individuals against whom there had been specific charges of war crimes. Hopefully we can also have an international tribunal where the Pakistani army officers who were responsible for such carnage will be tried also.

 

What does Islam say about 'crime against humanity' or 'war criminals':

 

'The Right to Life' has been given to man only by Islam. The first and the foremost basic right is the right to live and respect human life. The Holy Quran lays down: Whosoever kills a human being without (any reason like) man slaughter, or corruption on earth, it is as though he had killed all mankind ... (5:32) 

As far as the question of taking life in retaliation for murder or the question of punishment for spreading corruption on this earth is concerned, it can be decided only by a proper and competent court of law. If there is any war with any nation or country, it can be decided only by a properly established government. In any case, no human being has any right by himself to take human life in retaliation or for causing mischief on this earth. Therefore it is incumbent on every human being that under no circumstances should he be guilty of taking a human life.

If anyone has murdered a human being, it is as if he has slain the entire human race. These instructions have been repeated in the Holy Quran in another place saying:

Do not kill a soul which Allah has made sacred except through the due process of law ... (6:151)

Here also homicide has been distinguished from destruction of life carried out in pursuit of justice. Only a proper and competent court will be able to decide whether or not an individual has forfeited his right to life by disregarding the right to life and peace of other human beings. In the verse of the Holy Quran which has been mentioned in connection with the right to life, Allah has said:

"And whoever saves a life it is as though he had saved the lives of all mankind" (5:32).

Islam is submission to Allah's will. It is a way of life that guides your actions and forms your character. Islam is a state of awareness and appreciation of Allah's boundless attributes. As your soul submits, you are able to practice the meaning of peace, compassion, love, forgiveness, and charity that originate from one Source. The shades of superiority, prejudice and judgment fade as the world comes into focus with the eyes of your soul. In Islam, the best among us in the sight of Allah is not the white or the black, the male or the female, a person who calls himself or herself Christian, Jew, or Muslim, but rather, the one who is the most righteous. Terrorism has no religion! The true religion of Islam forbids the killing of innocent people, irrespective of the cause—religious, political or social beliefs. This is stated in the Quran, the holy book of Muslims.

[Quran 6:151] "...You shall not kill — GOD has made life sacred — except in the course of justice. These are His commandments to you, that you may understand."

The laws of the scriptures that apply to the Christians and Jews are repeated and emphasized for the Muslims also.

[Quran 5:32] "...we decreed for the Children of Israel that anyone who murders any person who had not committed murder or horrendous crimes, it shall be as if he murdered all the people. And anyone who spares a life, it shall be as if he spared the lives of all the people. ..."

Muslims have also been instructed by the Prophet (may Allah's blessings be on him) that if they should enter the enemy's territory, they should not indulge in pillage or plunder nor destroy the residential areas, nor touch the property of anyone except those who are fighting with them. It has been narrated in the hadith: "The Prophet has prohibited the believers from loot and plunder" (al-Bukhari; Abu Dawud). His injunction is: "The loot is no more lawful than the carrion" (Abu Dawud). Abu Bakr al-Siddiq used to instruct the soldiers while sending them to war, "Do not destroy the villages and towns, do not spoil the cultivated fields and gardens, and do not slaughter the cattle." The love of Allah is not reserved for people of religious sects or denominations that cling to an exclusive belief of guaranteed "salvation." God's infinite love flows to the charitable, righteous, benevolent, equitable, and the just: Those who recognize their accountability and work towards being good. [Quran 2:62] "Surely, those who believe, those who are Jewish, the Christians, and the converts; anyone who believes in GOD, and believes in the Last Day, and leads a righteous life, will receive their recompense from their Lord. They have nothing to fear, nor will they grieve."

"No prisoner should be put to the sword"-a very clear and unequivocal instruction given by the Prophet (S). "The Prophet has prohibited the killing of anyone who is tied or is in captivity." In the hadith there is a saying of the Prophet that: "Punishment by fire does not behove anyone except the Master of the Fire" (Abu Dawud). The injunction deduced from this saying is that the adversary should not be burnt alive. The Prophet may Allah's blessings be on him, has declared homicide as the greatest sin only next to polytheism. The Tradition of the Prophet reads: "The greatest sins are to associate something with Allah and to kill human beings." In all these verses of the Holy Quran and the Traditions of the Prophet the word 'soul' (nafs) has been used in general terms without any distinction or particularization which might have lent itself to the elucidation that the persons belonging to one's nation, the citizens of one's country, the people of a particular race or religion should not be killed. The injunction applies to all human beings and the destruction of human life in itself has been prohibited.

The rape or forced sex against consent is not only a crime against the victim whether it be a woman or minor, but a crime against the whole society and humanity.  Rape has also been alleged to be a weapon of ethnic cleansing by armies such as by the Pakistani army (as well as by the Pakistani collaborators, Razakars, Al-Badrs) in Bangladesh.

Tribunal orders keeping them in jail; order sought to arrest Sayedee

They are no stranger to court. They stood in the dock before. But their appearance at the International Crimes Tribunal yesterday marks a watershed. For it was the first time the four top Jamaat-e-Islami leaders were in court as accused in the long-awaited war crimes trial.

Jamaat Ameer Motiur Rahman Nizami, Secretary General Ali Ahsan Mohammad Mojahid, Senior Assistant Secretaries General Mohammad Kamaruzzaman and Abdul Quader Molla were brought to the courtroom around 10:30am.

During brief proceedings, the tribunal directed the prison authorities to keep them in custody until further orders in the first complaint case filed with it.

The war crimes prosecution filed the case on July 25 under the International Crimes Tribunal Act, and prayed for arrest warrants against the four.

In the case, they charged the Jamaat leaders with committing genocide and crimes against humanity and peace during the Liberation War in 1971
.

Some 25 lawyers led by Zainul Abedin, BNP leader and former secretary of the Supreme Court Bar Association, were at the tribunal to defend the four.

Ghulam Arieff Tipoo led the seven-member prosecution panel.

In their first move, the defence prayed for withdrawal of the arrest warrants. They also sought certified copies of the prosecution's complaint petition, all order sheets and relevant documents.

The three-member tribunal headed by Justice Nizanul Huq did not accept their applications, as proper procedure was not followed in the filing of those.

As per the court's instructions, the defence later submitted the applications to Registrar Md Shahinur Islam. The tribunal will tomorrow set a date to hear the prayers.

Though the judges would fix the hearing date in their chamber, they convened the court tomorrow as the prosecution yesterday submitted the second complaint case, which is against Delwar Hossain Sayedee, another detained Jamaat leader.

For yesterday's proceedings, security was tight in and around the old High Court building that houses the tribunal. The law enforcers swept the entire compound to make sure no explosives were planted.

Despite the stringent measures, people gathered to see the four Jamaat leaders, the first ones to have been produced before the tribunal in the war crimes trial.

Though the four are widely known, everyone tried to catch a glimpse of their faces when police placed them in the dock.

While being taken to the court building around 10:00am, Nizami, Mojahid, Kamaruzzaman and Quader Molla formed a line as if they were in a pecking order.

The tribunal allowed them to sit in chairs in the dock, which is unusual for someone facing trial.

The quartet was given chairs and fan in the lockup as well. They also had access to a well-furnished toilet.

While Nizami, Mojahid and Molla were in panjabis and pajamas, Kamaruzzaman came in shirt and pants.

Mojahid, who drew a lot of flak in 2007 for claiming that anti-liberation forces never even existed, was calm like the other three.

PROCEEDINGS
The tribunal's session started at 10:32am.

At the beginning, defence lawyer Zainul Abedin introduced himself to the court. After that, Tajul Islam submitted three separate applications on behalf of the defendants.

Besides praying for recalling of the arrest warrants and seeking certified copies of all the documents in the case, the defence wanted permission for the accused to appoint someone to take necessary legal moves.

The tribunal asked them to file their applications with the registrar. It then showed the detainees arrested in the first case.

As per the rules of procedure of the tribunal, any information, oral or in writing, obtained by the investigation agency including its own knowledge relating to the commission of a crime comes under section 3(2) of the International Crimes Tribunal Act.

Offences like war crime and genocide, crimes against humanity and peace like murder, abduction, confinement, torture and rape fall under this section.

The tribunal on July 26 issued arrest warrants against the four Jamaat leaders. But later, it received a police report that the order could not be executed, as the four were already in prison in different cases.

On July 29, the court directed the prison authorities to produce the Jamaat leaders before it yesterday.

"Let the suspects be kept in custody until further orders in the aforementioned complaint case," tribunal's Chairman Justice Nizanul Huq said, pointing at the detainees in the dock.

"They be remanded to prison with direction to produce them on call," he added.

The defence at that stage asked for 10 minutes to discuss the matter with the detained leaders. But the court refused them saying, "Not today."

The tribunal chairman said as the courtroom is small, everyone must cooperate in conducting the proceedings properly. He asked all to remain seated until the defendants were taken back from the courtroom and the judges left.

Justices ATM Fazle Kabir and AKM Zaheer Ahmed are the other two members of the tribunal.

In his reaction, Mofidul Hoque, a trustee of the Liberation War Museum, told The Daily Star, "It was a historic scene, as for the first time the enemies of humanity were standing trial. It was an extraordinary expression of the inherent strength of truth and justice."

DEFENCE'S STATEMENT
After submitting the applications to the registrar, defence lawyer Tajul Islam told reporters that the arrest warrants against the four were illegal.

He added that section 22 of the tribunal's rules of procedure says an arrest warrant would be issued after cognisance of an offence is taken.

Asked about section 9(1) of the rules that says the tribunal can issue a warrant during investigation for effective probe, the lawyer said there is no question of investigation as the tribunal does not even have a case before it.

CASE AGAINST SAYEDEE
The prosecution yesterday filed their second complaint petition to the tribunal registrar. The petition accuses Jamaat's Nayeb-e-Ameer Delwar Hossain Sayedee of genocide, crimes against humanity and peace in Pirojpur district during the Liberation War.

The registrar said the prosecution has prayed for an arrest warrant against Sayedee for proper and effective probe. Sayedee has been detained since late July in other cases.

The court will hear the petition tomorrow.
